On September 8 2011, Steve Pusey of the Wilmington Regional Office of the Division of Water Quality
(DWQ) inspected Black's Tire Service in Shallotte, Brunswick County to determine compliance with
Stormwater Management Permit Number SW8 110206 issued on February 28 2011 DWQ file review
and site inspection revealed that the site is not in compliance with the terms and conditions of this permit
Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter,
which summarizes the findings of the recent inspection
As indicated in the attached inspection report the following deficiencies must be resolved r 0/11 /14a
f 01 An engineers certification needs to be submitted for the stormwater system
,/ 2 Repair and stabilize with grass the erosion on pond slopes and berms
✓3 Remove sediment at outlet side of FES pipe located under new driveway and stabilize the area
✓4 Repair erosion and temporary inlet protection next to drop inlet, adjacent new driveway entrance
Check orifice pipe on outlet structure to ensure it is not clogged Remove sediment from around
the orifice pipe area as necessary
Please inform this Office in writing before October 10 2011, of the specific actions that will be undertaken
and the time frame that will be required to correct the deficiencies Failure to provide the requested
information or to respond to this letter by the due date, may initiate enforcement action including the
assessment of civil penalties of up to $25,000 per day If a written plan of action is not submitted to this
office by October 10, 2011 then DWQ staff will re -inspect the site and issue a Notice of Violation if the
listed deficiencies have not been addressed
Please be reminded that if an ownership change or a name change or a mailing address change has
occurred it is your responsibility to submit a completed and signed Name/Ownership Change form to the
Division Please include the name, mailing address and phone number of the party who is now

2 There was much erosion on pond slopes and berms These areas need to be stabilized with grass
3 Outlet FES pipe (under new driveway) is clogged and needs to be cleaned of all sediment at the outlet side
4 Erosion needs to be repaired next to drop inlet at new driveway entrance Temporary Inlet protection should be
repaired
5 Check orifice pipe on outlet structure to make sure it is not clogged Remove sediment from around orifice pipe inlet if

Comment DWQ received a complaint from a neighbor that soil from the site had
clogged the drainage ditch upstream of the pond outlet There was some sedimentation
in the ditch but water was flowing and it was not clogged Also grass sod had bee n
placed in area above the ditch where erosion had occured and it appeared stable
Since this ditch is not jurisdiction of State stormwater program, it should be handled by
other authorities such as county or city government if problems persist
