Inspection Summary:
The following actions need to be taken to bring the project into compliance:
1. A copy of the recorded deed restrictions needs to be submitted before any lots are sold.
2. Site instill under construction so not all permanent BMPs are complete. The pond has been built in accordance with
the approved plans of 9/23/10. The latest modification calls for increasing the pond size and eliminating 2 lots.

2. Both ponds on this project outlet to an existing ditch that has been enlarged. Erosion
problems near the outlet of the irregular shape pond have been resolved.

Steve, we repaired the areas in question and I am including two pictures of work performed.
AREA # 1
We reshaped and shaved the bank and armored with fabric and rip rap rock.
AREA # 2
We flattened and armored the bank with fabric and rip rap rock to give the ditch a gentler curve.

We are in agreement except we recommend that "area 2" should be flattened and fanned out
somewhat by removing or pushing dirt on the back side of ditch. The goal is to make the curve in the
swale smoother so that flow is guided gently towards the ditch. Then, armour with riprap.

1. We will give you a recorded deed before any lots are sold.
We have attached a photo of the area specified on line two of the report. This is out of pond q 1
but, I think this is the area in question. If it is not please contact me (Jamie Malpass (910)520-
7663).
Area # 1. We will slope back wall and armor with fabric and rip rap rock.
Area q 2. We will Armor the back side of the ditch with fabric and rip rap rock
3. After my conversation with Jeff Malpass he informed me that the wetlands do not need to be
flagged as per his conversation with you.
4. Project will be completed before January 4m

Dear Mr. Malpass:
On November 30, 2012, Steve Pusey of the Wilmington Regional Office of the Division of Water Quality
(DWQ) inspected Bristol Bay in Columbus County to determine compliance with Stormwater Management
Permit Number SW8 100807 issued on September 23, 2010. DWQ file review and site inspection
revealed that the site is not in compliance with the terms and conditions of this permit. Please find a copy
of the completed form entitled "Compliance Inspection Report' attached to this letter, which summarizes
the findings of the recent inspection.
As indicated in the attached inspection report, the following deficiencies must be resolved:
1. A Copy of the recorded deed restrictions needs to be submitted to this office before any lots are

2. ) The ponds outlet to an existing ditch that has been enlarged. There is an erosion issue in the
ditch near the pond #2 outlet / overflow location. This erosion issue needs to be fixed. The ditch
has an abrupt turn and the flow is eroding the bank. This turn needs to be made into a smoother
transition and the bank needs to be reinforced.
3. The wetlands need to be flagged in the field near the drainage ditch along the eastern side of the

Please inform this Office in writing before December 18, 2012 of the specific actions that will be
I undertaken and the time frame that will be required to correct the deficiencies. Failure to provide the
requested information, or to respond to this letter by the due date, may initiate enforcement action
including the assessment of civil penalties of up to $25,000 per day. If a written plan of action is not
submitted to this office by December 18, 2012, then DWQ staff will re-inspectthe site and issue a Notice
of Deficiency (NOD) if the listed deficiencies have not been addressed.
Please be reminded that if an ownership change, or a name change or a mailing address change has
occurred, it is your responsibility to submit a completed and signed Name/Ownership Change form to the
Division. Please include the name, mailing address and phone number of the party who is now
responsible for this permit. If you have any questions, please contact me at the Wilmington Regional

provided with the application.
Site is still under construction so not all of the permanent BMPs are complete. It appears the pond has been built in
accordance with the approved plans of 9/23/10. Proposed plans call for increasing the pond size and eliminating 2 lots.
The ponds outlet to an existing ditch that has been enlarged. There is an erosion problem in the ditch near the overflow 1
outlet location of the pond. The ditch has an abrupt turn and the flow is eroding the bank. This turn needs to be made
smoother and the bank reinforced.
Wetlands near the ditch should be flagged in the field.
