The Wilmington Regional Office received a complete Stormwater Management Permit
Application for Pender EMS on May 27, 2010. Staff review of the plans and specifications has
determined that the protect, as proposed, will comply with the Stormwater Regulations set forth
in Title 15A NCAC 2H 1000 and Session Law 2008-211 We are forwarding Permit No. SW8
100315 dated June 10, 2010 for the construction, operation, and maintenance of the subject
protect
This permit shall be effective from the date of issuance until June 10, 2020, and shall be subject
to the conditions and limitations as specified therein. Please pay special attention to the
Operation and Maintenance requirements in this permit Failure to establish an adequate
system for operation and maintenance of the stormwater management system will result in
future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adtudlcatory hearing upon written request within thirty (30) days following
receipt of this permit This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings, P O Drawer 27447, Raleigh, NC 27611-7447 Unless such demands are made this
permit shall be final and binding.

North Carolina as amended, and other applicable Laws, Rules, and Regulations

construction, operation and maintenance of one (1) wet detention pond in compliance
with the provisions of 15A NCAC 2H 1000 and Session Law 2008-211 (hereafter
collectively referred to as the "stormwater rules') the approved stormwater
management plans and specifications and other supporting data as attached and on file
with and approved by the Division of Water Quality and considered a part of this permit
This permit shall be effective from the date of issuance until June 10, 2020, and shall
be subject to the following specified conditions and limitations.
I. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data
2. This stormwater system has been approved for the management of stormwater
runoff as described in Section 1.8 on page 3 of this permit The stormwater
control has been designed to handle the runoff from 44,001 square feet of
impervious area
3 A 50' wide vegetative buffer must be provided adjacent impounded structures,
streams, rivers and tidal waters
4 The tract will be limited to the amount of built -upon area indicated on page 3 of
this permit, and per approved plans
5. All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans.
6 The runoff from all built -upon area within the permitted drainage area(s) of this
project must be directed into the permitted stormwater control system.

The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface
During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately.
The permittee shall at all time provide the operation and maintenance necessary
to assure the permitted stormwater system functions at optimum efficiency. The
approved Operation and Maintenance Plan must be followed in its entirety and
maintenance must occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months)
b Sediment removal.
C. Mowing and re -vegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and
specifications
f. Debris removal and unclogging of outlet structure, orifice device, flow
spreader, catch basins and piping.
g Access to the outlet structure must be available at all times.
4. Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ. The records will indicate the date,
activity, name of person performing the work and what actions were taken.
5. The facilities shall be constructed as shown on the approved plans This permit
shall become void unless the facilities are constructed in accordance with the
conditions of this permit, the approved plans and specifications, and other
supporting data.

6. Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation. Any deviations from the
approved plans and specifications must be noted on the Certification A
modification may be required for those deviations.
7. If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility
8. Access to the stormwater facilities for inspection and maintenance shall be
maintained via appropriate recorded easements at all times.
9. The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below:
a. Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc
b. Project name change.
C. Transfer of ownership.
d Redesign or addition to the approved amount of built -upon area or to the
drainage area
e Further development, subdivision, acquisition, lease or sale of any, all or
part of the project area The project area is defined as all property owned
by the permittee, for which Sedimentation and Erosion Control Plan
approval or a CAMA Major permit was sought
f Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan.
10. Prior to the construction of any permitted future areas shown on the approved
plans, the permittee shall submit final site layout and grading plans to the
Division for approval.
11. A copy of the approved plans and specifications shall be maintained on file by
the Permittee at all times
12 The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit. Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made
II. GENERAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and
approval by the Director In the event of a change of ownership, or a name
change, the permittee must submit a completed Name/Ownership Change Form
signed by both parties, to the Division of Water Quality, accompanied by the
supporting documentation as listed on page 2 of the form. The approval of this
request will be considered on its merits and may or may not be approved.

2. The permittee is responsible for compliance with all permit conditions until such
time as the Division approves the transfer request. Neither the sale of the
project nor the transfer of common area to a third party constitutes an approved
transfer of the stormwater permit.
3 Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215.6A to 143-215.6C.
4. The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction.
5. In the event that the facilities fail to perform satisfactorily, including the creation
of nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems.
6 The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted
stormwater management facility.
7. The permit remains in force and effect until modified, revoked, terminated or
renewed. The permit may be modified, revoked and reissued or terminated for
cause. The filing of a request for a permit modification, revocation and re -
issuance or termination does not stay any permit condition
8. Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual.
9 Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit.
10. The permittee shall notify the Division of any name, ownership or mailing
address changes at least 30 days prior to making such changes.
11. The permittee shall submit a permit renewal request at least 180 days prior to
the expiration date of this permit. The renewal request must include the
appropriate documentation and the processing fee.

Only complete application packages will be accepted and reviewed by the Division of Water Quality
(DWQ). A complete package includes all of the items listed below. A detailed application instruction sheet
and BMP checklists are available from http://h2o.enr.state.nc.us/su/bmp forms.hlm. The complete
application package should be submitted to the appropriate DWQ Office. (The appropriate office may be
found by locating project on the interactive online map at http//h2o.enr.state.nc.us/su/msi_maps.htm.)

VH. DEED RESTRICTIONS AND PROTECTIVE COVENANTS
For all subdivisions, outparcels, and future development, the appropriate property restrictions and protective
covenants are required to be recorded prior to the sale of any lot. If lot sires vary significantly or the proposed
BUA allocations vary, a table listing each lot number, lot size, and the allowable built -upon area must be
provided as an attachment to the completed and notarized deed restriction form. The appropriate deed
restrictions and protective covenants forms can be downloaded from
http://h2o ennstate.nc.us/su/bmp forms.htmkdeed restrictions. Download the latest versions for each
submittal.
In the instances where the applicant is different than the properly owner, it is the responsibility of the property
owner to sign the deed restrictions and protective covenants form while the applicant is responsible for ensuring
that the deed restrictions are recorded.
By the notarized signature(s) below, the permit holder(s) certify that the recorded property restrictions and
protective covenants for this project, if required, shall include all the items required in the permit and listed
on the forms available on the website, that the covenants will be binding on all parties and persons claiming
under them, that they will run with the land, that the required covenants cannot be changed or deleted
without concurrence from the NC DWQ, and that they will be recorded prior to the sale of any lot.

You have my approval for the change. The only reason I had to change the calculations for swale #3 is that to
include the vegetative filter strip, I had to increase the area of drainage area #3. 1 only had to increase it ever
so slightly. The square footage increased but not enough to make the overall acreage increase. It remained at
2,23 Ac disturbed area Since I had originally based my Qfor swale #3 on the square footage of drainage area
#3, 1 felt it necessary to re -calculate this value. It only increased the flow by a couple of hundredths but I felt it
still needed to be done. There were no other changes to swale #3 except that one value. Hey lust checking on
the 0&M signatures The last ones I submitted to you had Woody listed as Agent. I am currently trying to
track down the president. I have been all over the Secretary of State website, but there is no president listed.
I am going to make some calls today and hopefully I will have that letter to you tomorrow. Thanks again!

permit application for Pender EMS I checked the pond design to see if it would meet the
design criteria for 90% TSS removal and it did. This removed the requirement of a properly
sized level spreader and vegetative filter for the discharge from the wet pond for a 10 year
storm I then sized an outlet protection consisting of class B rip rap according to the Erosion
and Sedimentation Control Design Manual. I included Figure 8 06a from the manual showing
the sizing calculations Additionally we left the 30' vegetative filter for added pollutant
removal. Because we kept the 30' vegetative filter our disturbed area and drainage area #3
increased in size but not enough to change the total acreage I included page three from the
state stormwater permit application showing the updated square footage for drainage area #3
I also included the spreadsheets for grass swale #3, the wet detention pond, the supplement for
both, and Figures 1, 2, & 7 with the updated pond volumes and new outlet design. If you

Application for Pender EMS on March 16, 2010 A preliminary in-depth review of that
information has determined that the application is not complete The following information is
needed to continue the stormwater review
Please specify BMP and swale side slope vegetation and the wetland species to
be planted on the 10 1 vegetated shelf of a wet pond
A soils report for all engineered systems and curb outlet swale systems is
required The report should contain the estimated Seasonal High Water Table
(SHWT) elevation at each proposed BMP location reported in FMSL, not as a
depth below existing ground (BEG) If it's reported as a depth BEG, the bore map
must include the existing ground elevation at each bore location Please show
the SHWT elevation on the sectional drawing of the pond.
3 Please ensure that swale bottom elevations have an average of 1' separation
from the SHWT Show swale spot elevations on the drawing
4 Please revise page 3 of the application, data table, showing values for existing
BUA which should be 0.

project for the Stormwater Management Permit Application
The application is for a high -density project (with no curb or gutter), draining to C,Sw waters
The application is for a new site to be developed The subject sit has established vegetation
Currently there are no impervious areas on -site
Stormwater runoff from the area will drain via two grassed swales into a wet detention pond
Ultimately, stormwater runoff will flow into the Northest Cape Fear River
Silt fencing will be used within the project area Routine inspections and maintenance will be
performed to insure that the erosion control measures are in good condition and operating
properly. Repairs will be made immediately to any erosion control measures found to be
insufficient

Purposes of Corporation
This corporation is organized for the following purposes(s):

including, for such purposes, the making of distributions to organizations that qualify as exempt
organizations under Sections 501 (c)(3) and 170 (c)(2) of the Internal Revenue Code of 1986 (herein the
"Code")(or the corresponding provisions of any future United States Internal Revenue Code).
Prohibited Activities
No part of the net earnings of the corporation shall inure to the benefit of, or be distributable to its
members, directors, officers, or other private persons, except that the corporation shall be authorized and
empowered to pay reasonable compensation for services rendered and to make payments and distributions
in furtherance of the purposes set forth in these articles of incorporation. No substantial part of the
activities of the corporation shall be the carrying of propaganda, or otherwise attempting to influence
legislation, and the corporation shall not participate in or intervene in (including the publishing or
distribution of statements) any political campaign on behalf of or in opposition to any candidate for public
office. Notwithstanding any other provision of these articles, the corporation shall not carry on any other
activities not permitted to be carried on (a) by a corporation exempt from Federal income tax under section
501 (c)(3) of the Code or (b) by a corporation, contributions to which are deductible under section
170(c)(2)) of the Code.
Distributions upon Dissolution
Upon the dissolution of the corporation, the Board of Directors shall, after paying or making provision
for the payment of all of the liabilities of the corporation, dispose of all of the assets of the corporation
exclusively for the purposes of the corporation in such manner, or to such organization or organizations
organized and operated exclusively for charitable, educational, religious, or scientific or literary purposes
as shall at the time qualify as an exempt organization or organizations under section 501 (c)(3) of the Code
as the Board of Directors shall determine, or to federal, state, or local governments to used exclusively for
public purposes. Any such assets not so disposed of shall be disposed of by the Superior Court of the
county in which the principal office of the corporation is then located, exclusively for such purposes or to
such organization or organizations, such as the Court shall determine, which are organized and operated
exclusively for such purposes, or to such governments for such purposes. Where possible such assets shall
be disposed of to agencies providing rescue and emergency medical services in Pender County, North
Carolina.
