the outlet end of the pond, near the parking, has not been addressed at this time
His discussion with the onsrte maintenance personnel indicates that both this erosion item and the vegetation
issue should be addressed by Wednesday, July 28
I apologize for indicating otherwise previously, however, that was the sentiment on Friday

On July 1, 2010, Christine Nelson of the Wilmington Regional Office of the Division of Water
Quality (DWQ) conducted a follow-up inspection of the Family Entertainment Center of Shallotte
in Brunswick County to determine compliance with Stormwater Management Permit Number
SW8 080527 originally issued on December 16, 2008 and recently modified on June 25, 2010
DWQ file review and site inspection revealed that the site is not compliant with the terms and
conditions of this permit Please find a copy of the completed form entitled "Compliance
Inspection Report" attached to this letter, which summarizes the findings of the recent follow-up
inspection
Since the last inspection on June 11, 2010, several deficiencies previously identified have been
resolved As indicated in the attached inspection report, the following deficiencies must still be
resolved
1 Vegetation is not fully established on the vegetated shelf and pond side slopes Matting
has been put down in an attempt to establish vegetation on a portion of the pond side
slopes The lack of vegetation on the side slopes is also allowing some erosion to occur,
one area in particular that is eroding is by the parking lot on the outlet side of the pond
In the letter dated June 18, 2010 from Matthew Haley, Cape Fear Engineering, the actions
necessary to correct the deficiencies would be completed by July 18, 2010 Another follow-up
inspection will be conducted after July 18, 2010 to ensure the necessary actions have occurred
Please inform this Office in writing before July 18, 2010 if the actions specified in the plan of
action will not be completed as indicated

On June 18, 2010, Mr Chad Coburn of the Division of Water Quality (DWQ) conducted a site
inspection for the property at 343 Whiteville Road near Shallotte, NC (Parcel # 1970005015)
The following violation was noted during the inspection
Wetland Standards - Wetlands have been impacted by off -site sedimentation at the above -
mentioned site This is in violation of the following wetland standards
15A NCAC 02B 0231 (b) (1) requires that
Liquids, fill or other solids or dissolved gases may not be present in amounts that may
cause adverse impacts on existing wetlands uses
15A NCAC 02B 0231 (b) (5) requires that
Hydrological conditions necessary to support the biological and physical characteristics
naturally present in wetlands shall be protected to prevent adverse impacts on
(A) Water currents, erosion or sedimentation patterns,
(C) The chemical, nutrient and dissolved oxygen regime of the wetland,
(D) The movement of aquatic fauna,
(F) Water levels or elevations
Required Response - You are directed to respond to this letter in writing within 30 days of
receipt Your response must include the following
l Wetland Restoration Plan - Submit a Restoration Plan to thts office for review and
approval This plan must include details on how the sediment in wetlands will be
removed and how the wetlands will be restored This information must be clearly
depicted on a map that you provide as apart of this response This map should also
indicate all of the wetlands locations on the tract as well as the wetland areas that have
been impacted

Entertainment of Shallotte, LLC, Cape Fear Engineering (CFE) is submitting the
following Plan of Action in response to the Division's Notice of Inspection (NOI) dated
June 14, 2010
It should be noted that this Plan of Action has been reviewed by both Dr John Ward and
Brian McCall and both have confirmed that this Plan of Action is consistent with their
intentions to address the NOI and bring the site into compliance
Please find the specific deficiencies as identified in the NOI and the specific actions and
that will be undertaken to correct these deficiencies below Please note that all of the
following actions are to be completed within 30-days of the Division's receipt of this
Plan of Action
I The dumpster pad was permitted on the northwestern side of the building but was
constructed on the northeastern side of the building
As you know, Cape Fear Engineering is in the process of modifying the
Family Entertainment Center permit The relocation of the dumpster pad
will be addressed in our response to your June 15, 2010 Request for
Additional Information
2 The water elevation of the pond was found to be high and the orifice was not
draining, indicating the orifice may be clogged This pond was designed to
provide 1 5 ft of storage between the permanent pool elevation and the bottom of
the weir At the time of the inspection, approx 6 to 8 inches of storage was
available A tree limb was also found lodged in the outlet structure

1actions will be taken to unclog the orifice pipe and to remove
any debris from the outlet structure
Additionally, as requested in your Request for Additional Information
dated June 15, 2010, trash racks with maximum 6-inch square openings
are to be provided on the four intermediate weirs to prevent future
clogging of the outlet structure
3 Vegetation is not fully established on the vegetated shelf and pond side slopes
Some small, woody vegetation is beginning to grow on the side slopes It was
evident that a previous effort to vegetate the side slopes had been made The lack
of vegetation on the side slopes is also allowing some erosion to occur
Appropriate action will be taken to restore the eroded areas in and around
the pond and bulkhead Once eroded areas have been restored, the pond
banks and areas around the bulkhead will be re -seeded and straw will be
spread over the seeded areas to prevent the seed from being washed away
Nick Mills of the NCDENR Division of Land Quality was scheduled to
visit the site on Thursday, June 17, 2010, however, due to a scheduling
conflict this site visit is to be rescheduled for sometime next week
Any additionally areas of concern identified by Nick Mills during or as the
result of this upcoming site visit will also addressed
4 Trash was found in and around the pond during the inspection
The trash in and around the pond has already been removed Please note
that the pond will continue to be monitored for additional trash that may
accumulate during the remediation efforts and any such trash shall be
removed
I trust that this Plan of Action satisfactorily addresses the Division's need for a written
response to the NOI and is sufficient for you to continue your review and issuance of
both the Family Entertainment Center modification (SW8 080527) and the First Bank
offsite permit (SW8 100603) If this is not the case please let me know immediately so
that I can communicate to the client

civil penalties of up to $25,000 per day If a written plan of action is not submitted to this
office by June 23, 2010 then DWQ staff will re-evaluate whether the associated projects
should remain in the Express program If a written plan of action is not submitted to this
office by July 15, 2010 then DWQ Staff will re -inspect the site and issue a Notice of
Violation if the listed deficiencies have not been addressed

2 Ensure the orifice is not clogged and demonstrate that the outlet structure is operating as designed to provide the
permitted storage volume Remove debris from the outlet structure and if appropriate install a trash rack over the weirs
to prevent future problems
3 Stabilize and vegetate the pond side slopes Maintain vegetation on a regular basis at 6 inches Trim any woody
vegetation to 6 inches to prevent future problems
4 Remove the trash from in and around the pond on a regular basis to help prevent the orifice from clogging

Comment The water elevation of the pond was found to be high and the orifice was
not draining, indicating the orifice may be clogged This pond was designed to provide
1 5 ft of storage between the permanent pool elevation and the bottom of the weir At
the time of the inspection, approx 6 to 8 inches of storage was available A tree limb
was also found lodged in the outlet structure
Vegetation is not fully established on the vegetated shelf and pond side slopes Some
small, woody vegetation is beginning to grow on the side slopes It was evident that a
previous effort to vegetate the side slopes had been made The lack of vegetation on
the side slopes is also allowing some erosion to occur
Trash was found in and around the pond during the inspection
