Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR) All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified Please note that the attached updated permit now references DEMLR as the Division
responsible for issuance of the permit
On August 3, 2015, the Division of Energy, Mineral and Land Resources (DEMLR) received a completed
Name/Ownership change form and transferred ownership of the permit to Marsh Harbour Partners, Inc
As indicated on the Name/Ownership Change form, you have acknowledged receipt of a copy of the
permit, which includes the application and supplement forms, a copy of the approved plans and a copy of
the required Operation and Maintenance agreement from the previous permittee By acknowledging
receipt of the permit, and by signing the Name/Ownership Transfer form, you have accepted the
responsibility for complying with the terms and conditions outlined in this permit
On August 5, 2009, the Governor signed Session Law 2009-406 This law impacted any development
approval issued by the Division of Energy, Mineral and Land Resources under Article 21 of Chapter 143
of the General Statutes, which was current and valid at any point between January 1, 2008, and December
31, 2010 The law extended the effective period of any stormwater permit that was set to expire during
this time frame up to three (3) years from its current expiration date On August 2, 2010, the Governor
signed Session Law 2010-177, which granted an extra year for an extension of up to four (4) years
On August 4, 2015, the Division accepted a request to modify the permit from a high density townhome
development to a 24-lot high density single family subdivision The Division is hereby notifying you that
permit SW8 071024 has been modified and reissued on March 29, 2016 and to remind you that this
permit shall now be effective from the date of issuance until December 30, 2021, which includes all the
available extensions For your records, please find enclosed a copy of the transferred, modified and
updated permit, and a copy of the Name/Ownership Change form Please keep this cover letter and
updated permit on file at all times
This permit is subject to the conditions and limitations as specified therein Please pay special attention
to the conditions listed in this permit regarding the Operation and Maintenance of the BMP(s),
recordation of deed restrictions, procedures for changing ownership, transferring the permit, and renewing
the permit Failure to establish an adequate system for operation and maintenance of the stormwater
management system, to record deed restrictions, to transfer the permit, or to renew the permit, will result
in future compliance problems

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction, operation and maintenance of one (1) infiltration basin in compliance with the
provisions of 15A NCAC 2H 1000 (hereafter referred to as the "stormwater rules') and the
approved stormwater management plans and specifications and other supporting data as
attached and on file with and approved by the Division of Energy, Mineral & Land Resources
(hereafter referred to as the Division or DEMLR) and considered a part of this permit
This permit shall be effective from the date of issuance until December 30, 2021, and shall be
subject to the following specified conditions and limitations
I DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data
This stormwater system has been approved for the management of stormwater runoff
as described in Section 18 of this permit The stormwater control has been designed to
handle the runoff from 102,367 square feet of impervious area which includes 72,000
sf for lots, 24,188 sf for roads and 6,179 sf reserved for future development
The subdivision is permitted for 24 lots, each limited to a maximum of 3,000 square
feet of built -upon area
All runoff in excess of the design storm must pass through a 50-foot vegetated filter
The tract will be limited to the amount of built -upon area indicated on page 3 of this
permit, and per approved plans
All stormwater collection and treatment systems must be located in either public rights -
of -way, dedicated common areas or drainage easements The recorded plats for the
project must show all such required rights -of -way, common areas and drainage
easements, in accordance with the approved plans
The runoff from all permitted built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system

The stormwater management system shall be entirely constructed, vegetated and
operational for its permitted use prior to the construction of any built -upon surface
During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately
The permittee shall at all times provide the operation and maintenance necessary to
assure the permitted stormwater system functions at optimum efficiency The
approved Operation and Maintenance Plan must be followed in its entirety and
maintenance must occur at the scheduled intervals including, but not limited to
a Semiannual scheduled inspections (every 6 months)
b Sediment removal
c Mowing and revegetation of slopes and the vegetated filter
d Immediate repair of eroded areas
e Maintenance of all slopes in accordance with approved plans and
specifications
f Debris removal and unclogging of bypass structure, infiltration media, flow
spreader, catch basins, piping and vegetated filter
g A clear access path to the bypass structure must be available at all times
Records of maintenance activities must be kept and made available upon request to
authorized personnel of DEQ The records will indicate the date, activity, name of
person performing the work and what actions were taken
The facilities shall be constructed in accordance with the approved plans, the
conditions of this permit, specifications and other supporting data as attached to this
permit, and on file with the Division
If the stormwater system was used as an Erosion Control device, it must be restored
to design condition prior to operation as a stormwater treatment device, and prior to
occupancy of the facility

Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that the permitted facility has
been installed in accordance with this permit, the approved plans and specifications,
and other supporting documentation Any deviations from the approved plans and
specifications must be noted on the Certification A modification may be required for
those deviations
Access to the stormwater facilities for inspection and routine maintenance shall be
maintained via a recorded access easement to the nearest public right-of-way The
easement shall be maintained in a passable condition
The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below
a Any revision to any item shown on the approved plans, including the stormwater
management measures, built -upon area, details, etc
b Redesign or addition to the approved amount of built -upon area or to the
drainage area
c Further subdivision, acquisition, lease or sale of all or part of the project area
The project area is defined as all property owned by the permittee, for which
Sedimentation and Erosion Control Plan approval or a CAMA Major permit was
sought
d Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan
e Prior to the construction of any permitted future BUA areas reported on the
application
10 A copy of the approved plans and specifications shall be maintained on file by the
Permittee at all times
11 The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit Within the time frame specified in the
notice, the permittee shall submit a written time schedule to the Director for modifying
the site to meet minimum requirements The permittee shall provide copies of revised
plans and certification in writing to the Director that the changes have been made
III GENERAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and
approval by the Director The permittee shall submit a completed and signed
Name/Ownership Change Form, accompanied by the supporting documentation as
listed on the form, to the Division of Energy, Mineral and Land Resources at least 60
days prior to any one or more of the following events
a An ownership change including the sale or conveyance of the project area in
whole or in part, except in the case of an individual lot sale that is made subject
to the recorded deed restrictions,
b The sale or conveyance of the common areas to a Homeowner's or Property
Owner's Association, subject to the requirements of Session Law 2011-256,
c Bankruptcy,
d Foreclosure, subject to the requirements of Session Law 2013-121,
e Dissolution of the partnership or corporate entity, subject to NCGS 57D-2-01(e)
and NCGS 57D-6-07,
f A name change of the current permittee,
g A name change of the project,
h A mailing address change of the permittee,

as the Division approves the transfer request

Any person or entity found to be in noncompliance with the provisions of a stormwater
management permit or the stormwater rules is subject to enforcement action as set
forth in North Carolina General Statute 143, Article 21
4 The issuance of this permit does not preclude the Permittee from complying with any
and all statutes, rules, regulations, or ordinances, which may be imposed by other
government agencies (local, state, and federal) having jurisdiction
In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action, including
those as may be required by this Division, such as the construction of additional or
replacement stormwater management systems
The permittee grants DEQ / DEMLR Staff permission to enter the property during
normal business hours for the purpose of inspecting all components of the permitted
stormwater management facility
The permit remains in force and effect until modified, revoked, terminated, or renewed
The permit may be modified, revoked and reissued or terminated for cause The filing
of a request for a permit modification, revocation and reissuance, renewal or
termination does not stay any permit condition
Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual
Approved plans and specifications for this project are incorporated by reference and
are enforceable parts of the permit
10 The permittee shall submit a permit renewal application at least 180 days prior to the
expiration date of this permit The renewal request must include the appropriate
documentation and the processing fee

We have reviewed your letter dated September 23, 2015 and phone calls over the last weeks and
offer the following comments and information in regards to each item I will try to address each
item as you have them numbered on original comment letter
1 I have included 2 sets of detailed plans and specs
a I have taken portion of road details from original Marsh Harbour that included
this area and included it with these plans I should address road details
b The collection swale, inlets etc are per the original Abaco Village plans
2 I have included grading plans along with plan and profile from the original design for
Abaco Drive
3 There is no revision to the drainage area from the original plan so no basin change or
redesign should be necessary
4 Proposed Restrictive covenants are attached and correct the reference to the wrong permit
number and cover the per lot BUA
5 All technical information is the same as far as basin design and capacity Each of the 24
lots within the Abaco Drive area dram to the infiltration basin so we have allocated 3,000
s f which totals 72,000 s f with 6,179 for future use The Applicant has not indicated
what the future use will be or could be See table for breakdown of impervious We have
tried to contact the Design Engineer to provide the basin certification but to no avail so
far If he does not respond by the end of January we will make other arrangements

Thanks for your inquiry regarding Marsh Harbour Stormwater revisions
Mr Fredeen has ask me to help in this matter I have had a couple of phone conversations with Linda in regards
to this project After some initial confusion on all of our parts I feel like we have things working in the right
direction There are two parts to the revision of this project and that has caused some confusion, but as I said I '
feel that by my conversations with Linda, Mr Fredeen and his Attorney we are close to having everything
resolved I have the packages on may desk signed by Mr Fredeen and ready to send out with the exception of
one small piece of information I should have it completed by Monday afternoon and we will send the packages
out or deliver in person Monday afternoon or Tuesday Morning
With the changing of Mr Fredeens representative in this matter we understand we have taken a little longer that
everyone would have liked but we felt it necessary and better for all involved
I hope this addresses your concerns and we will soon have this matter resolved

I am also reviewing the information you submitted on September 2, 2015 for SW8 060535, and have the following
comments It appears that the BUA breakdown information you provided with the 060535 information may have
included the Abaco Townhome modification to 24 single family lots?
1 The lot BUA's and lot numbers provided on the separate BUA breakdown for Phase I Section 1(060535) do not
match up with the proposed lot listing attached to the deed restriction document Here's the side -by -side
comparison

Lot BUA has not been changed and the number of lots is increased Standard practice is to grade the lots higher
than the street, so runoff from the driveways of the new platted lots will be directed to the street, and
ultimately, into the curb outlet swale
a Swale #8 is relocated to be beside platted Lot 30 and may now pick up the driveway runoff from platted
Lots 27, 28, 29 and 30,
b Swale #7 is relocated to run between platted Lots 24 & 25 and may pick up the driveway runoff from
platted lots 25 and 26,
c Swale #4 will be affected because in the same space where there used to be 5 lots (formerly lots 35-39
22250 sf BUA), there are now 6 lots (platted lots 41-46 26700 sf BUA),
d Swales 1 and 2 are also impacted because in the space where there used to be 6 lots (formerly 48-53
26700 sf BUA) there are now 7 lots (platted lots 47-53 31150 sf BUA),
e I imagine swales 9 & 10 will be eliminated in favor of the high density infiltration basin?
Please provide updated swale velocity calculations and an updated swale drainage area map

the Wilmington Regional Office received and accepted a modified State Stormwater Management
Permit Application and request to change the project name for Marsh Harbour Phase I, Section 3-
Abaco Village at Marsh Harbour on August 4, 2015 A preliminary in-depth review of that
information has determined that the application is not complete The following information is
needed to continue the stormwater review
02H 1003(g)(1) - Provide 2 sets of detailed plans and specs for the project
The previously approved townhome development plans did not require road
details because parking lots were proposed Since the proposed development
has changed to single family lots, please add the road section detail and cul-de-
sac pavement radius to the detail sheet
Show any proposed collection devices such as grated inlets, piping, swa/es,
etc, that will convey runoff to the infiltration basin
02H 1003(g)(4) - Provide topographic maps of the project area showing original and
proposed contours and drainage patterns
Please show the grading for Abaco Drive, East and West, including the tops and
inverts of any runoff collection systems
02H 1003(g)(5) and 02H 1005(d) - Delineate all relevant boundaries including
drainage areas, SHWT, coastal wetlands, property/project boundaries and drainage
easements
The application reports a drainage area to the infiltration basin of 209,088 sf which
is an increase from the previously permitted 204,829 sf This will require that the
infiltration basin be redesigned Please bear in mind that only minor modifications to
existing permits are exempted from the more stringent design requirements of the
2008 coastal rules Specifically, a minor modification is one that does not increase
the net amount of built -upon area within the project, or does not increase the overall
size of the stormwater controls that were previously approved for that development
02H 1003(g)(9) - Provide recorded deed restrictions and protective covenants As
an alternative, proposed deed restrictions and protective covenants and a signed
agreement to provide the final recorded documents shall be accepted when final
documents are not available at the time of submittal
Please provide a copy of the amended deed restrictions which correct the
referenced permit number from SW8 050132 to SW8 060535 / SW8 071024 (as
indicated in the addmfo letter for SW8 060535) If you will be assigning each of the
24 lots under SW8 071024 a maximum of 3,258 sf, then you will also need to
include that change as part of the amendment

calculations, assumptions, drawings and procedures associated with the
stormwater management measures including but not limited to Built -upon area,
runoff coefficients, runoff volume, runoff depth, flow routing, inlet and outlet
configuration (if applicable), and other applicable information as specified
a The narrative is confusing to say the least Instead of trying to compare the
proposed condition to the existing condition, double -counting this and
subtracting that, it would appear to be much easier to just demonstrate 25%
overall low density based on the correct project area, and then deal with the
Abaco Village tract and the infiltration basin drainage area and BUA
b Based on what I read In the narrative, each of the 24 lots under SW8 071024
is allocated 4450 sf If that is true, then the lot BUA to report on this
application is 106,800 sf However only 78,213 sf is reported on that
application If 78,213 sf Is what is draining to the basin, then each of the 24
lots must be limited to 3,258 sf
c If the infiltration basin will accept the runoff from 24 lots @4450 sf each
(106, 800 total), then the infiltration basin will also need to be redesigned
because it is only designed to treat 102,367 sf Please refer to Comment #3
above and provide signed, sealed and dated calculations The additional BUA
over and above the previously permitted 102,367 sf must be evaluated at the
2008 design storm for SA waters
d The narrative indicates that the infiltration basin is existing Prior to approving
any modification, please submit the designer's certification for the basin
Please remember that a change to one number may have a domino effect on other numbers
Please check all plans, calculations and forms to ensure that the numbers are consistent

On May 29, 2015, the Division received a large package for modifications to two existing
permits There was a lot of information submitted and it has proven difficult to determine what
the requested changes are The reasons for this difficulty include the fact that the permit
numbers, phases, sections and lot numbers referenced on the applications are incorrect
and/or different than what was previously permitted At the current time, this is what we have
permitted
SW8 060535 (Section 1) is for 53 lots at 4450 sf per lot
SW8 060919 (Section 11) is for 33 lots at 4093 sf per lot
SW8 070651 (Section 111) is for 46 lots at 5310 sf per lot
SW8 071024 Townhomes of Abaco This protect is not affiliated with Marsh Harbor and is
currently permitted to John E Tantum, president of Slowflight of Cedar Point, Inc , as of April
18, 2008
The package we received contained one original low density application (and a copy) for
SW8 060535 containing the protect name "Phase I Sections I and 2", and one original high
density application (and a copy) for SW8 071024 containing the protect name "Phase I,
Section 3" Please note that none of the current permits refer to a Phase number and that
SW8 060535 only covers Section I The narrative suggests that 3 phases were established
within Section 1 Please confirm that it is your intention to incorporate a name change to SW8
060535 to reflect Phases 1 & 2 in Section I To avoid confusion with the existing permits for
Sections I and 11, we advocate to rename the project as Section I, Phases 1 & 2 instead
Per the NCSOS, Slowflight of Cedar Point, Inc was dissolved in 2010 You were not named
as a principal in Slowflight of Cedar Point, Inc , therefore, you have no standing to request to
modify the SW8 071024 permit from townhomes to single family lots If you are now the
owner of the entire tract that was previously permitted as The Townhomes of Abaco, this
modification can include that ownership change and the new 24 lot layout Please submit a
copy of the deed wherein the Townhomes of Abaco property was conveyed to Marsh
Harbour Partners, Inc , a signed Name/Ownership change form, and a new signed deed
restriction statement limiting the built -upon area on those 24 single family lots
Please also note that the permitted infiltration basin was never certified by an appropriate
licensed professional There may also be an overlap of project area The Marsh Harbour
Section I plans under SW8 060535 approved in 2006 include Abaco Drive, and Lots 40-47 to
the south, but the north side of Abaco Drive was not included as part of that permit and in fact
was owned by someone else The approved Townhomes of Abaco plan suggests that the
proposed 2008 Townhome project area overlaps the 2006 permitted lots 40-47 in Marsh
Harbour Section I

This package includes two sections
PERMIT MOD A modified the Low density Stormwater permit SW 8060535 for Marsh Harbour
(Phase 1, Sections 1 and 2) The modification slightly alters the lot layout, but does not increase
either the number of lots or exceed the permitted Built Upon Area (BUA)
PERMIT MOD B modifies Phase 2 High Density Storm water.permit SW 807024 for Marsh
Harbour Subdivision (Phase 1, Section 3) The infiltration basin permitted for this permit was
constructed and functions as designed and intended
Accompanying this request are two stormwater permit modification applications, low density,
multiple drawings (2006 low density plan, 2007 high density plan and 2007 and 2012 record
plats), Google earth image, copy of stormwater permits SW 8060535 and SW 807024, and
check for $505
➢ HISTORY NARRATIVE
Marsh Harbor Subdivision is located in the Town of Cedar Point (located off Sherwood Avenue),
Carteret County It is owned by Marsh Harbour Partners, Mr Leslie Fredeen, President The
entire subdivision covers 4143 acres (SEE MAP 1)
2006 — Of the total 4143 acres, 53 single family lots over 32 09 acres (Phase 1, Sections 1, 2 and
part of Section 3) were permitted as a Low Density project (See 2006 Crystal Coast Engineer
stormwater plan, MAP 4) Stormwater permit SW 8060535 allows for 25% of the 32 09 acres,
or 349,485 sf of BUA, including 113,627 sf for roads and 235,858 sf for the 53 lots The
allowable building BUA was divided evenly across the 53 lots, or 4450 sgft for each lot The
infrastructure, roads and the majority (47) of these lots have been developed (see Google earth
image)
2007 - In 2007, 7 1 acres (Phase 1, Section 3) of the 4143 acre parcel was permitted (SW
8071024) as a High density infiltration basin project, including 14 lots and road (See 2007
Crystal Coast Engineer stormwater plan) The High density permit provided stormwater storage
and treatment for 102,367 sf of impervious surfaces, including 53750 sf for 14 buildings and
44114 sf for parking (24514 sf for road and 19,600 sf for spaces) and 4503 sf for sidewalks
Of this BUA above, 35,600 sf (lots 40-47) and 24,514 sf (road) were previously accounted for in

No BUA Increases are requested Allowable BUA per the 2008 HD permit is 102367 sq ft Of this
102367 sf, 24154 was allotted for streets, and the Infiltration basin was sized for these areas
The modification leaves 24154 sf for street draining to the constructed infiltration basin The
remaining allowable BUA available for the 24 lots is 78213 sf for buildings, or 3,258 sgft per
each, with no modifications to the Infiltration basin
i MODIFICATION REQUEST CONCLUSION
No BUA Increases are requested MOD A revises the area of the LD permit to match the
existing record plat, modifying the layout of the lots When accounting for BUA permitted for
the 47 Lots and road, there remains 5939 sgft per each of the remaining six lots
In Section B modification, the size, layout and number of lots was modified, however no
additional BUA is proposed Specifically, the original area permitted for the buildings is now
uniformly divided over the 24 lots (3258 sqft each)
