Effective August 1, 2013 the State Stormwater program was transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR) All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified Please note that DEMLR is now your contact for any questions or issues regarding your
stormwater permit
On August 5, 2009, the Governor signed Session Law 2009-406 This law impacted any development
approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General
Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010
The law extended the effective period of any stormwater permit that was set to expire during this time
frame to three (3) years from its current expiration date On August 2, 2010, the Governor signed
Session Law 2010-177, which granted an extra year for a total of four (4) years extension
Accordingly, the permit, which was set to expire on October 16, 2017, shall now be effective from the
date of issuance until October 16. 2021 The permit issued on October 16, 2007 remains in full force
and effect, except as amended herein At least 180 days prior to the new expiration date of the permit,
you are required to submit a permit renewal application, fee and supporting documentation to the
Division Please note that if the permit is allowed to expire without being renewed, the more stringent
2008 coastal rules may be applied to any new permit applications for the development of that property
On August 5, 2014, DEMLR staff of the Wilmington Regional Office was in the area conducting
inspections of nearby projects and noticed that Oak Island Resort, located off Old Bridge Road and
Vanessa Drive near Southport in Brunswick County, has not been built Stormwater Management
Permit Number SW8 070685 was issued on October 16, 2007 for this high density development
Because the protect has not yet started construction, a follow-up inspection will be scheduled for a later
date
As a reminder, you are required to comply with the terms, conditions and limitations of your Stormwater
Management Permit according to Title 15A NCAC 02H 1003 and North Carolina General Statute 143-
214 7, including the construction of the stormwater system and the built -upon area in accordance with
the approved plan, certification of the system upon completion of construction, and the operation and
maintenance of the stormwater system after construction
If the protect has changed ownership, name or mailing address, please submit a completed and signed
Name/Ownership Change form to the Division of Energy, Mineral and Land Resources at least 30
calendar days prior to making the change Please include the name, mailing address and phone
number of the person or entity that is now responsible for this permit on the form
