Effective August 1, 2013 the State Stormwater program was transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR) All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified Please note that the attached updated and transferred permit now references DEMLR as the
Division responsible for issuance of the permit
On August 5, 2009, the Governor signed Session Law 2009-406 Phis law impacted any development
approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General
Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010 The
law extended the effective period of any stormwater permit that was set to expire during this time frame
up to three (3) years from its current expiration date On August 2, 2010, the Governor signed Session
Law 2010-177, which granted an extra year for a total extension of up to four (4) years
On January 28, 2016, the Division of Energy, Mineral and Land Resources (DEMLR) received a
Name/Ownership Change Form signed by Gasperson, Inc requesting that the Stormwater permit for the
subject project be transferred to Willis Automotive Repair, LLC A file review and site inspection was
performed on June 15, 2016 by DEMLR staff and the facility was found to be out of compliance The
Division received notification on February 5, 2018 that the necessary work had been completed and a
follow-up inspection was conducted on April 18, 2018, and as noted in the enclosed inspection report, the
site is currently in compliance with the terms and conditions of the existing state stormwater permit
As indicated on the Name/Ownership Change form, you have acknowledged receipt of a copy of the
permit, a copy of the approved plans, a copy of the required Operation and Maintenance agreement, a
copy of the recorded deed restrictions, and a copy of the Designer's Certification By acknowledging
receipt of the permit, and by signing the Name/Ownership Transfer form, you have accepted the
responsibility for complying with the terms and conditions outlined in this permit The Division is hereby
notifying you that permit SW8 070407 has been transferred on May 2, 2018 and to remind you that this
permit shall be effective until April 13, 2021, which includes the extensions referenced above For your
records, please find enclosed a copy of the updated permit including the application and supplement
forms, a copy of the most recent inspection report, and a copy of the Name/Ownership Change form
Please keep this cover letter and updated permit on file at all times
This permit is subject to the conditions and limitations as specified therein Please pay special attention

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules, and Regulations

construction, operation and maintenance of a wet detention pond in compliance with the
provisions of 15A NCAC 2H 1000 (hereafter, the "stormwater rules') and the approved
stormwater management plans and specifications and other supporting data as attached and
on file with and approved by the Division of Energy, Mineral and Land Resources (hereafter
the Division or DEMLR) and considered a part of this permit
This permit shall be effective from the date of issuance until April 13, 2021, and shall be
subject to the following specified conditions and limitations
I DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data
2 This stormwater system has been approved for the management of stormwater runoff
as described in Design Standards Condition 18 of this permit The stormwater control
has been designed to handle the runoff from a total of 73,980 square feet of
impervious area from the two subdivided lots Tract #1 is currently developed under
offsite permit No SW8 110110, and Tract #2 is currently developed with only the
permitted wet pond, and is owned by Willis Automotive Repair, LLC
The subdivision is permitted for two (2) lots, identified on the approved plans as Tract
#1 and Tract #2, each limited to a maximum amount of built -upon area as follows
Tract #1 @28,312 sf and Tract #2 @45,668 sf
4 All stormwater collection/conveyance measures and treatment systems must be
located in either dedicated common areas, public rights -of -way, or drainage
easements The final plats for the project will be recorded showing all such required
common areas, rights -of -way, and easements, in accordance with the approved plans
5 The runoff from all built -upon area within the permitted drainage area of this project
must be conveyed to the permitted stormwater control system
6 This wet detention pond must be operated with a 30' vegetated filter, as shown on the
approved plans

II SCHEDULE OF COMPLIANCE
1 The stormwater management system shall be constructed in its entirety, vegetated
and operational for its intended use prior to the construction of any built -upon surface
2 During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately
3 The permittee shall at all times provide the operation and maintenance necessary to
assure the permitted stormwater system functions at optimum efficiency The
approved Operation and Maintenance Plan must be followed in its entirety and
maintenance must occur at the scheduled intervals including, but not limited to
a Semiannual scheduled inspections (every 6 months)
b Sediment removal
c Mowing and re -vegetation of slopes and the vegetated filter
d Immediate repair of eroded areas
e Maintenance of all slopes in accordance with approved plans and
specifications
f Debris removal and unclogging of outlet structure, orifice device, flow spreader,
catch basins and piping
g Access to the outlet structure must be available at all times
4 Records of maintenance activities must be kept and made available upon request to
authorized personnel of DEMLR The records will indicate the date, activity, name of
person performing the work and what actions were taken
5 A decorative spray fountain will not be allowed in the stormwater treatment system,
because the permanent pool volume is less than 30,000 cubic feet

6 The following deed restriction statements apply to this transferred permit, and were
recorded on January 12, 2011, in Deed Book 3536 at Page 911 of the Onslow County
Register of Deeds Office
a The following covenants are intended to ensure ongoing compliance with State
Stormwater Management Permit Number SW8 070407, as modified and
reissued by the Division of Energy, Mineral and Land Resources under NCAC
2H 1000
b The State of North Carolina is made a beneficiary of these covenants to the
extent necessary to maintain compliance with the Stormwater Management
Permit
c These covenants are to run with the land and be binding on all persons and
parties claiming under them
d The covenants pertaining to stormwater may not be altered or rescinded without
the express written consent of the State of North Carolina
e Alteration of the drainage as shown on the approved plans may not take place
without the concurrence of the Division
f The maximum built -upon area for Tract #1 is 28,312 sf and for Tract #2 the
maximum BUA is 45,668 sf This allotted amount includes any built -upon area
constructed within the lot property boundaries, and that portion of the
right-of-way between the front lot line and the edge of the pavement Built upon
area includes, but is not limited to, structures, asphalt, concrete, gravel, brick,
stone, slate, coquina and parking areas, but does not include raised, open
wood decking, or the water surface of swimming pools
g All runoff on the lot must be conveyed to the permitted BMP This may be
accomplished via roof drain gutters, collection piping, grading the lot or grading
swales, all which serve to ultimately convey runoff to the permitted BMP Lots
that will naturally drain into the system are not required to provide these
measures
h Built -upon area in excess of the permitted amount will require a permit
modification
i Each lot within the subdivision whose ownership is not retained by the
permittee, must submit a separate Offsite Stormwater Management Permit
application package to the Division and receive a permit prior to any
construction on the lot
7 The facilities shall be constructed, operated and maintained in accordance with the
conditions of this permit, the approved plans and specifications, and other supporting
data as attached to and on file with the Division, and which is an enforceable part of
this permit
8 Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that the permitted facility has
been installed in accordance with this permit, the approved plans and specifications,
and other supporting documentation Any deviations from the approved plans and
specifications must be noted on the Certification A modification may be required for
those deviations The certification was received on June 30, 2009
If the stormwater system was (or will be) used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device
10 The permitted stormwater management facility (wet pond) is currently contained within
the property boundary of Tract #2 The permittee shall not subdivide the pond from
Tract #2 or sell Tract #2 without the pond, unless a permit modification has been
submitted to the Division and the Division has approved the changes

11 Access to the stormwater facilities for inspection and maintenance shall be provided
via appropriate recorded access easements to the nearest public right-of-way
12 The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below
a Any revision to any item shown on the approved plans, including the stormwater
management measures, built -upon area, details, etc
b Redesign or addition to the approved amount of built -upon area or to the
drainage area
c Further subdivision, acquisition, lease or sale of all or part of the project area as
reported on the application
d Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan
e The construction of any BUA on Tract #2
f The construction of any areas of #57 stone, or permeable pavement or the use
of certain landscape materials for BUA credit
13 A copy of the approved plans and specifications shall be maintained on file by the
Permittee for the life of the project The approved plan set consists of 1) the
Preliminary Plat recorded in Map Book 59 at Page 181, showing the subdivision lot
lines and the drainage easements, and 2) plan sheets dated 12/29/06 prepared by
Parker and Associates, Inc , Rev 3, dated 3/27/07 showing the pond and details
previously approved by the Division on October 28, 2010
14 The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit Within the time frame specified in the
notice, the permittee shall submit a written time schedule to the Director for modifying
the site to meet minimum requirements The permittee shall provide copies of revised
plans and certification in writing to the Director that the changes have been made
III GENERAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and
approval by the Director The permittee shall submit a completed and signed
Name/Ownership Change Form, accompanied by the supporting documentation as
listed on the form, to the Division of Energy, Mineral and Land Resources at least 60
days prior to any one or more of the following events
a An ownership change including the sale or conveyance of the protect area in
whole or in part, except in the case of an individual lot sale that is made subject
to the recorded deed restrictions,
b The sale or conveyance of the common areas to a Homeowner's or Property
Owner's Association, subject to the requirements of Session Law 2011-256,
c Bankruptcy,
d Foreclosure, subject to the requirements of Session Law 2013-121,
e Dissolution of the partnership or corporate entity, subject to NCGS 57D-2-01(e)
and NCGS 57D-6-07,
f A name change of the current permittee,
g A name change of the protect,
h A mailing address change of the permittee,
Any individual or entity found to be in noncompliance with the provisions of a
stormwater management permit or the requirements of the stormwater rules is subject
to enforcement procedures in accordance with NCGS 143, Article 21
The issuance of this permit does not preclude the Permittee from complying with any
and all statutes, rules, regulations, or ordinances, which may be imposed by other
government agencies (local, state, and federal) having jurisdiction

4 The permittee is responsible for compliance with all permit conditions until such time
as the Division approves the transfer request Neither the sale of the protect area in
whole or in part, nor the conveyance of common area to a third party constitutes an
approved permit transfer request
In the event that the facilities fail to perform satisfactorily, the Permittee shall take
immediate corrective action, including those as may be required by this Division, such
as the construction of additional or replacement stormwater management systems
6 The permittee grants DEMLR / DEQ Staff permission to enter the property during
normal business hours for the purpose of inspecting all components of the permitted
stormwater management facility
7 The permit may be modified, revoked and reissued or terminated for cause The filing
of a request for a permit modification, revocation and re -issuance or termination does
not stay any permit condition
8 Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual
Approved plans and specifications for this protect are incorporated by reference and
are enforceable parts of the permit
10 The permittee shall maintain the approved plans on site at all times
11 The permittee shall submit a permit renewal application and fee to the Division no
sooner than 180 days prior to the expiration date of this permit

Effective August 1, 2013, the State Stormwater program was transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR) All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they are
modified Please note that this letter references DEMLR as the Division responsible for issuance of the
permit
On August 5, 2009, the Governor signed Session Law 2009-406 This law impacted any development
approval issued by the former Division of Water Quality under Article 21 of Chapter 143 of the General
Statutes, which was current and valid at any point between January 1, 2008, and December 31, 2010 The
law extended the effective period of any stormwater permit that was set to expire during this time frame
to three (3) years from its current expiration date On August 2, 2010, the Governor signed Session Law
2010-177, which granted an extra year for a total of four (4) years extension Accordingly, the Division is
herewith notifying you that the subject permit is now effective from the date of issuance until April 13,
2021, which includes all available extensions
On December 19, 2017, the Wilmington Regional Office of the Division of Energy, Mineral and Land
Resources (DEMLR) inspected the Gasperson, Inc Subdivision located at 912 N Marine Boulevard in
Jacksonville, Onslow County to determine the status of compliance with the State Stormwater
Management Permit Number SW8 070407 originally issued on April 13, 2007 DEMLR file review and
site inspection revealed that the site is still not in compliance with the terms and conditions of this permit
Please find a copy of the completed form entitled "Compliance Inspection Report" attached to this letter,
which summarizes the findings of the recent inspection
As indicated in the attached inspection report, the following deficiencies must be resolved
1 The outlet area, level spreader and vegetated filter have not been restored The permit cannot be
transferred to Willis Automotive Repair, LLC, until the stormwater facility is determined to be in
compliance with the permit
A completed and signed Permit Transfer Application Form was received on January 28, 2016, and the
project was first inspected on June 15, 2016, and was determined to be out of compliance Failure to
address the listed deficiency by February 8, 2018 will result in the return of the transfer application as
incomplete If the transfer application is returned, you will need to resubmit the transfer request on the
new transfer application and include a $505 00 fee Please be advised that until Division approves of the
transfer of this permit, you are required to comply with the terms, conditions and limitations of the
Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H 1003 and
North Carolina General Statute 143-214 7, including the operation and maintenance of the permitted
stormwater system

The contractor had told O'Reily (who they contracted directly with) that the pond maintenance work had been
completed O'Reily then notified our client (current permittee) that the work had been completed I went out to check
first before contacting you, and they forgot to get the outlet cleaned and install the level spreader that was never
constructed When I tried to relay the remaining items to O'Redy, they apparently already paid the contractor in full and
that he reported that the outlet was not part of his scope and that he would need a change order to finish I've since
helped O'Reily contract this last part so it gets finished (we are authorizing final payment) The contractor is supposed
to go out the 19th, and then I'll let you know once it is ready for you inspect Sorry it is taking so longs It should be
ready in the next week or so Hope all is well with you

DEMLR was finally able to Inspect this project for transfer and found a few maintenance issues that
need to be addressed I attach the June 15, 2016 Inspection report
The report notes that despite all the recent heavy rains, the water level in the pond is low The
Inspector was not quite sure if this was due to a leak in the piped runoff conveyance system to the
pond, or a breach in the embankment or in the outlet structure, or if the pond was simply drawing
down via Infiltration Do you have any thoughts on that?
The other Item of note is the apparent lack of routine maintenance The Inspector noted a lot of
O cattails and excessive vegetation in the pond that needs to be removed
I note that Mr Willis is only purchasing Tract �I"— please confirm that he understands Tract #
Po O'Reill Auto Parts currently holds an offsite permit to utilize the pond as their treatment device, and
that the transferre permit will so reflect
Once you provide us with written confirmation that these maintenance items have been (or will be)
taken care of by July 24, 2016, we can move forward with the transfer Please forward this email to
Mr Willis — we do not have his email address on file
