Effectix e August 1 201 � the State Stormwater program was transferred from the Division of Water Quality
(DWQ) to the DiN ision of Energy Mineral and Land Resources (DEMLR) All previous references to D WQ
will remain in older stormwater permits issued prior to August 1 201-5 until they are modified Please note
that this permit references DEMLR as the DiN ision responsible for issuance of the permit
On August 5 2009 the GONernor signed Session Law 2009 406 This law impacted any development approval
issued b} the former Div ision of Water Quality under Article 21 of Chapter 14� of the Ceneral Statutes which
was current and valid at an) point between January 1 2008 and December 31 2010 The law extended the
effective period of any stormwater permit that was set to expire during this time frame to three (3) years from
its current expiration date On August 2 2010 the Gov error signed Session Law 2010 177 which granted an
extra year for d total of four (4) %ears extension
The Wilmington Regional Office recened a complete modified State Stormwater Management Permit
Application for the subject project on July 10 2018 To simplify permitting the permittee has chosen to
subject the entire site to 15A NCAC 02H 1000 effective Jarman 1 2017 (the 2017 Rules) and forego Nested
rights to the preN ions set of rules as prey iously permitted Staff renew of the plans and specifications has
determined that the project as proposed will comply with the Stormwater Regulations set forth in Title 15A
NCAC 2H 1000 effective Januar} 1 2017 We are forwarding modified PermitNo SW8 070226 dated July
10 2018 for the construction operation and maintenance of the stormwater control measures (SCMs) built
upon areas as well as the stormwater collection system and/or Vegetated conveyance system associated with
the subject project Please replace the pi eviously app of ed plan sheets with the attached modified and
approved version Please replace the previous application (SWU 101) wet pond supplement and operation
and maintenance agreement with the attached modified versions
In accordance with the extensions this permit shall be effective from the date of issuance until March 16
2021 which includes all available extensions The permittee and project shall be subject to the conditions and
limitations as specified therein and does not supersede any other agency permit that may be required Please
pav special attention to the permit conditions regarding the operation and maintenance of the SCMs
stormwater collection system and/or vegetated conNexances the limitation of built upon area modification of
the project the procedures for changing ownership of and/or transferring the permit and the need to renew the
permit Please also pay attention to the permit conditions that requires the recordation of deed restrictions and
protective covenants easements and the maintenance agreement w hich must all be proN Ided along w Ah
certification upon completion of the project Failure to comply with these requirements will result in future
compliance problems
Please refer to Attachment 1 for a detailed description of the current proposed major modification and a list of
all the past modifications approved during the effective period of the permit

In accordance with the provisions of Article 21 of Chapter 143 General Statutes of North
Carolina as amended and other applicable Laws Rules and Regulations

construction operation and maintenance of one (1) wet pond ( stormwater control measures or
SCMs ) in compliance with the provisions of Title 15A NCAC 2H 1000 effective January 1 2017 (the
stormwater rules ) and the approved stormwater management plans application supplement
specifications and other supporting data (the approved plans and specifications ) as attached and/or
on file with and approved by the Division of Energy Mineral and Land Resources (the Division or
DEMLR ) and considered an enforceable part of this permit
This permit shall be effective from the date of issuance until March 16 2021 and shall be subject to
the following specified conditions and limitations
I DESIGN STANDARDS
1 This permit is effective only with respect to the management and volume of stormwater
described in the approved plans and specifications The maximum amount of built upon area
(BUA) allowed for the entire protect is 297 035 square feet
2 The drainage area for the on site stormwater system will be limited to the amount of built upon
area indicated in this permit and the approved plans and specifications The runoff from all built
upon area within the permitted drainage area of this project must be directed into the permitted
stormwater control measure The stormwater control measure has been designed using the
runoff treatment method to handle the runoff from 297 035 square feet of impervious area This
permit does not provide any allocation of built upon area for future development
3 Each of the three outparcel lots permitted to drain to this system are limited to a maximum
amount of built upon area as indicated in Attachment B of this permit and as indicated in the
approved plans and specifications
4 Each commercial lot whose ownership is not retained by the permittee shall submit a separate
off site stormwater permit application to the Division and receive approval prior to construction
Prior to the discharge of stormwater runoff from any lot into the approved stormwater system
the permittee shall ensure that the owner of the commercial lot has obtained the separate off
site stormwater management permit

5 A 50 foot wide vegetative setback must be provided and maintained adjacent to all surface
waters measured horizontally from the normal pool elevation of impounded structures from the
top of bank of each side of streams or rivers and from the mean high waterline of tidal waters
perpendicular to the shoreline in accordance with the stormwater rules and the approved plans
and specifications
6 The stormwater control measure is permitted based on the design criteria presented in the
sealed signed and dated supplement and as shown in the approved plans and specifications
This stormwater control measure must be provided and maintained at the design condition The
approved supplement is incorporated by reference into this permit
7 The peak flow from the 10 year storm event shall not cause erosion downslope of the
stormwater outlet discharge point
8 Decorative spray fountains will be allowed in the stormwater treatment system if documentation
is provided demonstrating that the proposed fountain will not cause resuspension of sediment
within the pond or cause erosion of the pond side slopes
9 When using a wet pond for irrigation it is recommended that some water be maintained in the
permanent pool the vegetated shelf is planted with appropriate species that can handle
fluctuating conditions and human health issues are addressed
10 The SCM landscape planting plan shown in the approved plans shall be followed in its entirety
during construction After the plants are established the operation and maintenance agreement
must be followed
II SCHEDULE OF COMPLIANCE
1 The protect and SCM shall be constructed operated and maintained in accordance with the
conditions of this permit and the approved plans and specifications
2 The on site stormwater system shall be entirely constructed vegetated and operational prior to
the construction of any individual lot development within the drainage area per the approved
plans and specifications
3 During construction erosion shall be kept to a minimum and any eroded areas of the on site
stormwater system will be repaired immediately If the stormwater system is used as an Erosion
Control device it must be restored to design condition prior to operation as a stormwater
treatment device and prior to occupancy of the facility
4 All stormwater control measures stormwater collection systems vegetated conveyance
systems and/or maintenance accesses must be located in public rights of way dedicated
common areas that extend to the nearest public right of way and/or permanent recorded
easements that extend to the nearest public right of way for the purpose of inspection
operation maintenance and repair
5 The permittee shall provide and perform the operation and maintenance necessary as listed in
the signed Operation and Maintenance Agreement to assure that all components of the
permitted on site stormwater system functions at the approved design condition The approved
Operation and Maintenance Agreement is incorporated by reference into this permit and must
be followed in its entirety and maintenance must occur at the scheduled intervals
6 The operation and maintenance agreement must be recorded with the Office of the Register of
Deeds
7 Records of maintenance activities must be kept and made available upon request to authorized
personnel of the Division The records will indicate the date activity name of person performing
the work and what actions were taken
8 The final plats for the project must be recorded with the Office of the Register of Deeds The
recorded plat must reference the Operation and Maintenance Agreement and must also show all
public rights of way dedicated common areas and/or permanent drainage easements in
accordance with the approved plans

The maximum built upon area assigned to each outparcel via this permit and directed to
this SCM may not be increased or decreased by either the individual lot owner or the
permittee unless and until the permittee notifies the Division and obtains written approval
from the Division
10 The permittee shall monitor each outparcel for new construction to ensure compliance with the
conditions of the permit and the approved plans and specifications including obtaining their own
permit to drain to this system
11 The permittee is responsible for verifying that the proposed built upon area for the entire project
does not exceed the maximum allowed by this permit
12 Upon completion of the project the permittee shall determine whether or not the project is in
compliance with the permitted plans and take the necessary following actions
a If the permittee determines that the protect is in compliance with the permitted plans then
within 45 days of completion the permittee shall submit to the Division one hard copy and
one electronic copy of the following
i The completed and signed Designers Certification provided in Attachment A
noting any deviations from the approved plans and specifications Deviations
may require approval from the Division
n A copy of the recorded maintenance agreement
ui Unless already provided a copy of the recorded deed restrictions and protective
covenants and
IV A copy of the recorded plat delineating the public rights of way dedicated
common areas and/or permanent recorded easements when applicable
b If the permittee determines that the protect is not in compliance with the permitted plans
the permittee shall submit an application to modify the permit within 30 days of completion
of the protect or provide a plan of action with a timeline to bring the site into compliance
13 No person or entity including the permittee shall alter any component shown in the approved
plans and specifications Prior to the construction of any modification to the approved plans the
permittee shall submit to the Director and shall have received approval for modified plans
specifications and calculations including but not limited to those listed below
a Any modification to the approved plans and specifications regardless of size including the
stormwater control measures built upon area details etc
b Redesign or addition to the approved amount of built upon area or to the drainage area
c Further development subdivision acquisition lease or sale of any all or part of the protect
area as reported in the approved plans and specifications
d Altering modifying removing relocating redirecting regrading or resizing of any
component of the approved stormwater control measure stormwater collection system
and/or vegetative conveyance system shown on the approved plan
e The construction of any allocated future BUA
f The construction of any permeable pavement for BUA credit that was not included in the
approved plans and specifications
g The construction of any #57 stone area public trails or landscaping material to be
considered a permeable surface that were not included in the approved plans and
specifications
h Other modifications as determined by the Director
14 The Director may notify the permittee when the permitted site does not meet one or more of the
minimum requirements of the permit Within the time frame specified in the notice the permittee
shall submit a written time schedule to the Director for modifying the site to meet minimum
requirements The permittee shall provide copies of modified plans and certification in writing to
the Director that the changes have been made
15 Prior to transfer of the permit a file review and site inspection will be conducted by Division
personnel to ensure the permit conditions have been met and that the protect and the on site
stormwater system complies with the permit conditions Any items not in compliance must be
repaired replaced restored or resolved prior to the transfer Records of maintenance activities
performed to date may be requested

III GENERAL CONDITIONS
1 Any individual or entity found to be in noncompliance with the provisions of a stormwater
management permit or the requirements of the stormwater rules is subject to enforcement
procedures as set forth in NCGS 143 Article 21
2 The issuance of this permit does not preclude the permittee from complying with and obtaining
any other permits or approvals that are required for this development to take place as required
by any statutes rules regulations or ordinances which may be imposed by any other Local
State or Federal government agency having jurisdiction Any activities undertaken at this site
that cause a water quality violation or undertaken prior to receipt of the necessary permits or
approvals to do so are considered violations of NCGS 143 215 1 and subject to enforcement
procedures pursuant to NCGS 143 215 6
3 If the facilities fail to perform satisfactorily the permittee shall take immediate corrective actions
This includes actions required by this Division and the stormwater rules such as the construction
of additional or replacement on site stormwater systems These additional or replacement
measures shall receive a permit from the Division prior to construction
4 This permit is not transferable to any person or entity except after notice to and approval by the
Director The permittee shall submit a completed and signed State Stormwater Request Form
for Permit Transfer or Permit Information Update accompanied by the supporting
documentation as listed on the form to the Division at least 60 days prior to any one or more of
the following events
a Any ownership change including
i The assignment of declarant rights to another individual or entity
u The sale or conveyance of the common areas to a Homeowners or Property Owners
Association subject to the requirements of Session Law 2011 256
ni The sale or conveyance of the protect area in whole or in part except in the case of
an individual lot sale that is made subject to the recorded deed restrictions and
protective covenants
IV Dissolution of the partnership or corporate entity subject to NCGS 57D 2 01(e) and
NCGS 57D 6 07
b Bankruptcy
c Foreclosure subject to the requirements of Session Law 2013 121
d A name change of the current permittee
e A name change of the project
f A mailing address change of the permittee
5 The permittee is responsible for compliance with all terms and conditions of this permit until the
Division approves the transfer request Neither the sale of the project in whole or in part nor
the conveyance of common area to a third party constitutes an approved transfer of the permit
6 The permittee grants Division Staff permission to enter the property during normal business
hours to inspect all components of the permitted project
7 The permit issued shall continue in force and effect until the permittee files a request with the
Division for a permit modification transfer renewal or rescission however these actions do not
stay any permit conditions
8 Approved plans application documents supplements calculations operation and maintenance
agreement and specifications for this project are incorporated by reference and are enforceable
parts of the permit A copy of this permit application supplements operation and maintenance
agreement and approved plans and specifications shall be maintained on file by the permittee
9 Unless specified elsewhere permanent seeding requirements for the on site stormwater system
must follow the guidelines established in the North Carolina Erosion and Sediment Control
Planning and Design Manual
10 The issuance of this permit does not prohibit the Director from reopening and modifying the
permit revoking and reissuing the permit or terminating the permit for cause as allowed by the
laws rules and regulations contained in Title 15A NCAC 2H 1000 and NCGS 143 215 1 et al

11 A permit renewal request must be submitted at least 180 days prior to the expiration date of this
permit The renewal request must include the appropriate application documentation and the
processing fee as outlined in Title 15A NCAC 02H 1045(3)

Wet Detention Pond Maintenance Requirements I
The wet detention basin system is defined as the wet detention basin pretreatment Including forebays and the vegetated filter if
one is provided
Important maintenance procedures
Immediately after the wet detention basin is established the plants on the vegetated shelf and perimeter of the
basin should be watered twice weekly if needed until the plants become established (commonly six weeks)
No portion of the wet detention pond should be fertilized after the first initial fertilization that is required to
establish the plants on the vegetated shelf
Stable groundcover should be maintained in the drainage area to reduce the sediment load to the wet detention
basin
If the basin must be drained for an emergency or to perform maintenance the flushing of sediment through the
emergency drain should be minimized to the maximum extent practical
Once a year a dam safety expert should inspect the embankment
After the wet detention pond is established it should be inspected once a month and within 24 hours after every storm event
greater than 1 0 inches (or 1 5 inches if in a Coastal County) Records of operation and maintenance should be kept in a
known set location and must be available upon request

correspondence from a wetlands specialist about the fact that there are know surface waters on the
site
For some reason I forgot that the delineation only showed a wetland line and no surface
waters There Is no blue line stream or surface waters shown on the USGS quad At the time I was
originally Involved In the project I believe that there was a drought condition and the Wetland was
considerably drier than It Is now after the wettest May on record
In order to correct this misunderstanding on my part I met a wetlands specialist on site His findings
will be attached to the paper copy of this response which will be delivered to your office either this
afternoon or on Monday

The proposed development will be a modification of an existing permitted system The drainage
areas consist of three out parcels which are not adjacent to the main 10 acre tract These outparcels
already have permitted BUA s associated with them and one of them has been developed (McDonald s)
This application deals with the development of the 10 acre tract which currently is the site of a
waste treatment system and the existing wet detention basins The waste treatment system is being
demolished and the current user (McDonald s) is now tributary to the Pluris Hampstead collection
system Of the two wet detention basins on the tract one is used to treat the runoff from the
McDonald s site The other basin is not receiving any appreciable flow
The proposed plan seeks to consolidate the basins into one basin The design storm used will
remain the same 15 as the development is in the coastal counties but does not drain to SA waters and
the existing permit uses the 15 design storm
The proposed basin uses the HRT method The calculations for main pool size and average
depth exclude the foerbay The forebay in this design exceeds 20/ due to the fact that it will be
excavated in the same location as one of the existing basins This larger forebay will serve to make the
system design more conservative

Also please note that the entire required permanent pool volume is provided in the main pool excluding
any of the forebay volume This means that the actual hydraulic residence time is greater than the
required residence time If you remove the forebay factor from the HRT equation the required volume
would be 103 552 cubic feet Adding the main pool and the forebay volume together would exceed this
volume Back calculating the hydraulic residence time (HRT) from the total combined volumes of the
forebay and main pool and excluding the forebay factor yields the following
Total combined volume = 131 848 cubic feet
Design storm volume = 36 983 cubic feet
HRT = (131 848 cubic feet 5 days)/ 36 983 cubic feet = 17 8 days
This extended HRT makes this design very conservative and provides equal or better treatment
compared to the required Minimum Design Criteria and exceeds the current stormwater control and
treatment standards and protects the adjacent surface waters
The outlet of the basin will be directed to the cypress pond on the property Since this pond
does not drain to SA waters to level spreader or vegetated filter are provided or required Please note

On June 20 2018 WithersRavenel conducted a site review of the Cypress Grove project for the
purpose evaluating the presence of wetlands streams and surface waters within the project The
project consists of a ±100 acre parcel (PIN 3282 88 7389 0000) located at 71 Pansy Lane in
Hampstead Pender County (Lat 34 370594 N Long 77 711720 W) The project is located in the
Cape Fear River basin (HUC 03030007) and the site drains to Harrisons Creek (Stream Index 18
74 49 Surface Water Classification C Sw)
Site Conditions
The proposed project area has been previously cleared and partially graded as part of previously
development activities that were never completed The property contains a wastewater treatment
system and drip field The northern portion of the property contains mature forest containing both
uplands and wetlands while the remainder of the property consists of uplands that were previously
cleared of vegetation
The vegetation within the onsite forested wetlands consists of mixture of bald cypress (Taxodium
distichum) blackgum (Nysso blflora) red maple (Acer rubrum) gallberry (Ilex glabro) buttonbush
(Cepholonthus ocadentalis) and royal fern (Osmunda spectabdis)
The vegetation within the forested uplands consists of a mixture of live oak (Quercus virgmiana)

Wetland/Stream/Surface Water Determination
Prior to conducting the site visit WR reviewed aerial photographs the USDA Soil Survey for Pender
County (1990) the 2016 USGS Quadrangle Map (Hampstead) and Pender County GIS data (I e
topography streams etc) WR reviewed the project for the presence of wetlands streams and
surface waters jurisdictional to the US Army Corps of Engineers (USACE) and/or NC Division of
Water Resources (NCDWR) based on protocols set forth in the 1987 USACE Wetlands Delineation
Manual and 2010 Atlantic and Gulf Coastal Plain Regional Supplement (Version 2 0)
There are no streams or surface waters within the subject property
The site review Identified wetlands within the northern portion of the subject property as depicted
in the attached Wetland Location Exhibit However there are no wetlands within the proposed
project area (development area) and therefore the project will not result in disturbance to onsite
wetlands Therefore authorization from the USACE and NCDWR is not required for the proposed
development activities
Coastal Stormwater Rules Vegetated Setback Review
There are no streams or surface waters depicted within or adjacent to the subject property on the
USGS Quad and Pender County Soil Survey Additionally the onsite wetlands are not classified as
surface waters Therefore there are no perennial streams intermittent streams or perennial
surface waters within or adjacent to the project that should be subject to the 50 ft vegetated
setback required by the Coastal Stormwater Rules
Summary
In conclusion the proposed development activities will occur entirely within uplands and
authorization from the USACE or NCDWR is not required

information indicates that the application was updated However Section III 1 c of the application still
identifies Cypress Coex LLC as the developer of the property Please identify Cypress Coex LLC as the
property owner in Section III 1 c of the application
The application page has been revised and is attached
2 15A NCAC 02H 1042(2)(a)(iv) In the revised Section IV 10 of the application the total drainage area
presented is not consistent with the sum of the onsrte and offsite drainage areas (374 616 + 197 080 =
571 696) The onsrte drainage area differs from the onsrte drainage area listed in the table summarizing
the lots contributing to the stormwater control measure Please confirm the drainage area of the site is
presented consistently between the application documents

in your comment above Sorry for the confusion
3 15A NCAC 02H 1042(2)(g)(ui) The response to Item 5 of the previous request for additional
information references and delineates a 30 foot setback 15A NCAC 02H 1019(6)(b) effective January 1
2017 requires a 50 foot setback from all surface waters for these types of projects which is the same
width as the vegetated buffer identified in Permit Condition 13 of the modification dated September 16

please identify the 50 foot vegetated setback on the plans that either meet the requirements of 15A NCAC
02H 1003(4) or applies a more conservative approach such as the one presented in the revised items
submitted on June 14 2018
After replying to you first request for additional information I reflected on the prior designs for this site
It had been along time since I originally permitted this project I contacted the applicant and we met
with a wetlands specialist on the site The original plans did not delineate a surface water because there
is none on the site There is no blue line stream or waterbody shown on the USGS quad map The
specialist has analyzed the site and his correspondence is attached
The narrative has been revised to show only wetlands on site In addition page 3 of the application has
been revised to show no surface waters on site This change the calculation for impervious area and total
project area in Items 7V7 and 8 The percentage of impervious area as it relates to the drainage area in
item 10 of this section did not change as the wetland area was already not considered part of the
drainage area
Again I apologize for the confusion on this issue
4 15A NCAC 02H 1003(3)(a) and 1053(7) The supplement and plans indicate that the next available
outlet is set at 42 76 fit However the calculations indicate the riser elevation is set at 43 76 ft Please
confirm the temporary pool elevation set at the next available outlet the resulting provided storage
volume and the drawdown time of the minimum required storage based on the entire provided head
The calculations have been revised to show the riser elevation of 42 76 feet This change did not alter the
drawdown time as it was calculated using ahead of 0 76 feet (42 76 42 00) The resulting storage was
also not impacted as it was calculated in as andarfashion

See the attached digital response to your second add info letter This does not include the
correspondence from a wetlands specialist about the fact that there are know surface waters on the
site
For some reason I forgot that the delineation only showed a wetland line and no surface
waters There is no blue line stream or surface waters shown on the USGS quad At the time I was
originally involved in the project I believe that there was a drought condition and the Wetland was
considerably drier than it is now after the wettest May on record
In order to correct this misunderstanding on my part I met a wetlands specialist on site His findings
will be attached to the paper copy of this response which will be delivered to your office either this
afternoon or on Monday

Management Pcrmit Application for the subject project on June 7 2018 with additional information
received on June 14 2018 and June 18 2018 A prehmmary in depth renew ofthat information has
determined that the application is not complete and that additional information is needed I o continue the

1J 2 15A \CAC 0214 1042(2)(a)(IV) In the revised Section IV 10 of the application the total
drainage area presented is not consistent with the sum of the onsite and offsite drainage area
(374 616 + 197 080 = 571 696) 1 he onsite drainage area differs from the onsite drainage area
listed in the table summannng the lots contributing to the stormwater control measure Please
confirm the drainage area of the site is presented consistently between the application
documents
3 15A NCAC 0211 1042(2)(g)(ui) I he response to Item 5 of the previous request for additional
information references and delineates a 30 foot setback 15A NCAC 0211 1019(6)(b) effective
January 1 2017 requires a 50 foot setback from all surface waters for these lvpes of projects
which is the same width as the vegetated buffer identified in Pcrmit Condition 13 of the
modification dated September 16 2010 If there are surface waters on this site as indicated in
other portions of the application documents please identify the 50 foot vegetated setback on the
plans that either meet the requirements of 15A NCAC 0211 1003(4) or applies a more
conservative approach such as the one presented in the rep ised items submitted on June 14 2018
/4 15A NCAC 0211 1003(3)(a) and 1053(7) 1 he supplement and plans indicate that the next
available outlet is set at 42 76 ft I lowever the calculations indicate the riser elevation is sct at
43 76 ft Please confirm the temporary pool elevation set at the next available outlet the resulting
provided storage volume and the drawdown time of the minimum required storage based on the
entire provided head

system for the parcels in question
5 15A NCAC 02H 1042(2)(g)(ui) Section iV 6 of the application indicates that there are 14 acres of
surface water located on the property Please provide the boundaries of all surface waters wetlands
regulatory flood zones protected vegetated setbacks (in accordance with 1003(4) and 1019(6)(b))
and/or protected riparian buffers
Please note that all buildings are setback a minimum of 30 feet from the wetland line The unit
numbers that would be affected by the required 30 setback to surface waters are numbers 28 33 In
these areas the surface waters are well beyond the wetland line The seasonal high water table is at 42 0
feet That is essentially the elevation of the pond sutface There are some contours in these areas to show
that the grade is above that elevation I do not have iopo graphic data showing the actual pond bank so I
conservatively used the wetland line as a boundary for the setback There are no delineated flood zones
on this project according to the current FIRM map I have added leaders and labels for the wetland line

Sheet C5 0 has been revised to show grading around the proposed buildings Because of the
slight topography around some of the structures a note was added stating that all of the buildings be
guttered with the flow directed toward the collection system either by piped conveyance or side yard
finished grading Please note that the road has a standard curb and gutter on each side
7 15A NCAC 02H 1042(2)(g)(v) The site plan does not include a front sidewalk/access to what appears
to be the front door of the units The only access provided is the driveways Please confirm that all
proposed built upon area has been included and shown on the plans
There are no plans for individual sidewalks at each unit This plan reflects all planned BUA
8 15A NCAC 02H 1003(3)(a) and 1053(7) The temporary pool elevation is considered to be the next
available outlet The application documents list this elevation as 42 76 ft (note the forebay on the wet
pond section identifies the temporary pool elevation as being 42 75 ft) However the outlet structure
detail on sheet C5 3 appears to indicate that the next available outlet is set at 43 00 ft Additionally the
hydraulics of any additional capacities should be considered when calculating the drawdown rate Please
confirm the elevation of the temporary pool the resulting provided storage volume and reconsider the
drawdown of the minimum required storage based on the entire provided head
The riser rim elevation has been revised to 43 76 o reflect the temporary pool elevation

a Due to the unique design of the vegetated shelf (a 6 foot wide flat surface set 1 foot beneath the
permanent pool elevation) the equation to determine the volume over the vegetated shelf shown in

calculation please provide additional calculations to support the volume over the vegetated shelf for this
unique design and the resulting average depth
I have revised the calculations to show the volume over the shclfas calculated
((Area of the PP —Area of the she f bottom on the inside) + (Area of the shelf bottom on the
outside —Area of the shelf bottom on the inside))/2 x the depth (I_ft) I then subtracted this

half the pipe depth as opposed to the higher peak stage depth thus decreasing the pipe wetted
area making the velocity calculation conservative

is directed to the fared end section and is daylighted at the permanent pool surface This mlet is
located on the side slope ofthe forebay which has a 2 1 slope and a depth of 5 feet Due to the
oversized forebay as previously discussed above there is ample room for the flow from this inlet
to dissipate without interacting with an erodible surface such as a basin wall side slope or
bottom

I will drop off a revised package tomorrow or Thursday at the latest The changes are as follows
1 1 had Jimmy Ellington send an email waiving vested rights
2 1 revised page 2 of the application Section III la to read Jimmy Ellington Manager Roundhouse Properties

3 On page 3 of the application I consolidated the subject area of development and the three offsite areas into
one drainage area I have attached a sheet to the back of the application showing the breakdown in sub areas
and BUA for each
4 1 have amended to supplement to show that the forebay is larger than the MDC allows The note at the
bottom of the supplement still stands This design has plenty of storage in the main pool and the oversized
forebay will not harm the effectiveness of the basin This forebay sizing was done to try and capture some of
the previous ponds volume while reducing excavation costs
5 The 0 and M and supplement forms had the correct Temporary pool elevation on them and so I changed
the plan sheet to reflect the correct 42 76 elevation At your request I added an outlet structure detail to the
plan
6 1 have revised the transfer application to show both parties signing it and have included an O and m signed
by Mr Rawl who will be responsible for the BMP once the transfer goes through (There is an original 0 and
M signed by the current permittee with the permit application)

The proposed development will be a modification of an existing permitted system The drainage
areas consist of three out parcels which are not adjacent to the main 10 acre tract These outparcels
already have permitted BUA s associated with them and one of them has been developed (McDonald s)
This application deals with the development of the 10 acre tract which currently is the site of a
waste treatment system and the existing wet detention basins The waste treatment system is being
demolished and the current user (McDonald s) is now tributary to the Pluris Hampstead collection
system Of the two wet detention basins on the tract one is used to treat the runoff from the
McDonald s site The other basin is not receiving any appreciable flow
The proposed plan seeks to consolidate the basins into one basin The design storm used will
remain the same 15 as the development is in the coastal counties but does not drain to SA waters and
the existing permit uses the 15 design storm
The proposed basin uses the HRT method The calculations for main pool size and average
depth exclude the foerbay The forebay in this design exceeds 20/ due to the fact that it will be
excavated in the same location as one of the existing basins This larger forebay will serve to make the
system design more conservative
The outlet of the basin will be directed to the cypress pond on the property Since this pond

Cameron brought me the express request for this project I see that you have questions about the deed restrictions My
standard response is if the townhouses will have property transferred outside of the unit itself then deed restrictions are
required However if no additional property outside of the footprint of the building patios etc will be transferred to the
new owners then there is no need to place deed restrictions because the new owners do not have any additional property
to do add anything (sheds additional patio area etc)
Also the applicant listed on the express request is different than the permittee Can you confirm who will be submitting
this application? Only the current permittee can submit a modification Is a transfer needed?

The proposed development will be a modification of an existing permitted system The drainage
areas consist of three out parcels which are not adjacent to the main 10 acre tract These outparcels
already have permitted BUA s associated with them and one of them has been developed (McDonald s)
This application deals with the development of the 10 acre tract which currently is the site of a
waste treatment system and the existing wet detention basins The waste treatment system is being
demolished and the current user (McDonald s) is now tributary to the Pluris Hampstead collection
system Of the two wet detention basins on the tract one is used to treat the runoff from the
McDonald s site The other basin is not receiving any appreciable flow
The proposed plan seeks to consolidate the basins into one basin The design storm used will
remain the same 15 as the development is in the coastal counties but does not drain to SA waters and
the existing permit uses the 15 design storm
The proposed basin uses the HRT method The calculations for main pool size and average
depth exclude the foerbay The forebay in this design exceeds 20/ due to the fact that it will be
excavated in the same location as one of the existing basins This larger forebay will serve to make the
system design more conservative
The outlet of the basin will be directed to the cypress pond on the property Since this pond

Please see the express request for stormwater for the Cypress Grove Townhome project This is a

In addition to the express request I have the following question for Linda Georgette or any staff that
could help
This is a high density project with outparcels that already have been permitted One is the
McDonald s and the other two are future development The townhome project (a 10 acre tract) will
have 56 units and they will be sold The units will be in clusters of buildings so the roads yards and
pond areas will be mostly common area The individual lots will be similar to condo lots In a case
like this you would not be deed restricting the individual lots in the Townhome portion of the project as
much as the BUA for the entire tract I think Which deed restriction doc should I use? Do you want
me to just allocate a typical BUA for each unit and then an additional common area BUA?

I just re inspected the site and found a couple problems that need to be resolved The main issue is that a copy of the
recorded deed restrictions for the outparcel lots must be submitted to our office The deadline for this submittal is June
