Regional Office of the Division of Water Quality (DWQ) performed a follow up inspection at Cypress Station in Pender County to determine compliance with Stormwater Management Permit Number SW8 070226 issued on March 16 2007 DWQ file review and site inspection revealed that the site is not compliant with the terms and conditions of this permit Please find a copy of the completed form entitled Compliance Inspection Report attached to this letter Recorded deed restrictions need to be submitted for outparcels associated with this development In accordance with the stormwater management regulations deed restrictions and protective covenants are required for high density developments with outparcels where outparcel lots will be subdivided from the main tract and sold A copy of the recorded deed restrictions must be forwarded within 30 days of the date of recording A review of our files indicates that as of this date a copy of the recorded deed restrictions has not been received Wilmington Regional Office of the Division of Water Quality (DWQ) re inspected Cypress Station in Pender County to determine compliance with Stormwater Management Permit Number SW8 070226 issued on March 16 2007 and modified September 16 2010 Progress has been made to address the compliance issues The wet pond vegetated shelf and pond banks have been planted and are starting to grow Also the level spreader / vegetated filter areas have been improved However DWQ file review and site inspection revealed that the protect is still not compliant with the terms and conditions of this permit We are placing the most emphasis on drainage area B since McDonald s is now requesting an offsite permit for that drainage area Please find a copy of the completed form entitled Compliance Inspection Report attached to this letter which summarizes the findings of the recent inspection As indicated in the attached inspection report the following deficiencies must be resolved 1 A signed sealed copy of the Engineers Certification must be submitted for drainage Area B after the work is complete Since the work will not be fully complete at this time for drainage Area A an engineer s certificate can be submitted at a later date for that area However as a minimum the work described in item 3 below must be completed 2 A copy of the recorded deed restrictions must be submitted 3 Stormwater Measures Water Quality (DWQ) inspected Cypress Station in Pender County to determine compliance with Stormwater Management Permit Number SW8 070226 issued on March 16 2007 and modified on September 16 2010 DWQ file review and site inspection revealed that the site is not compliant with the terms and conditions of this permit Please find a copy of the completed form entitled Compliance Inspection Report attached to this letter which summarizes the findings of the recent inspection As indicated in the attached inspection report the following deficiencies must be resolved 1 A copy of the recorded deed restrictions needs to be submitted for this project 2 On both ponds A and B slopes need to be re graded as necessary to fix erosion problems and ensure that slopes are in accordance with the plans Ponds need to be stabilized with plants on the vegetated shelf and grass on the berms and slopes as applicable Level spreaders and vegetated filter strips need to be constructed downstream of pond outlets as per the approved plans All trash and debris must be removed from the pond areas including trash collected inside of outlet structures or other devices Pond slopes are unstable and there is
