On June 13 2011 the Wilmington Regional Office of the Division of Water Quality (DWQ)
received a copy of the recorded deed restriction document for this high density development
with outparcels In accordance with the stormwater management regulations deed restrictions
and protective covenants are required for high density developments with outparcels where
outparcel lots will be subdivided from the main tract and sold
Therefore DWQ file review and site inspection now reveal that the site is compliant with the
terms and conditions of this permit Please find a copy of the completed form entitled
Compliance Inspection Report attached to this letter
Please be advised that you are required to comply with the terms conditions and limitations of
your Stormwater Management Permit under Title 15A North Carolina Administrative Code 2H
1003 and North Carolina General Statute 143 214 7 including operation and maintenance of
your permitted stormwater system
If the protect has changed name ownership or mailing address a formal change of
name/ownership form must be submitted to DWQ within 30 calendar days detailing the change

On June 6 2011 Steve Pusey of the Wilmington Regional Office of the Division of Water
Quality (DWQ) performed a follow up inspection at Cypress Station in Pender County to
determine compliance with Stormwater Management Permit Number SW8 070226 issued on
March 16 2007 DWQ file review and site inspection revealed that the site is not compliant with
the terms and conditions of this permit Please find a copy of the completed form entitled
Compliance Inspection Report attached to this letter
Recorded deed restrictions need to be submitted for outparcels associated with this
development In accordance with the stormwater management regulations deed restrictions
and protective covenants are required for high density developments with outparcels where
outparcel lots will be subdivided from the main tract and sold A copy of the recorded deed
restrictions must be forwarded within 30 days of the date of recording A review of our files
indicates that as of this date a copy of the recorded deed restrictions has not been received in
this Office
Failure to record and/or provide a copy of the recorded deed restrictions prior to selling lots is a
violation of your permit and subject to enforcement action Please forward a copy of the
recorded deed restrictions to this Office at the address below by June 30 2011 or enforcement
action may be initiated and may Include recommendations for civil penalties and revocation of
the permit

addressing the deficiies that you listed thereon we are implementing the following
corrective actions to ad resv your concerns and/or deficiencies hsted in iterri #3
For Drainage A ea A the inside slopes of the pond and fore bay are being re
graded to fix the = that has taken place sediment and trash will be removed from
the pond and outlet e all slopes that are being re -graded will be reseeded and any
barren area v%nl I also be reseeded The area adjacent to the pond is being reseeded and
graded to help prevertt rosion of the pond
For Drainage ea B" The areas adjacent to the pond will be regarded to reduce
erosion and grass seed will planted on the barren areas adjacent to the pond, along with
matting to help stabili7e the slopes and stop erosion Trash and/or debris will be removed
from the pond
In addressing the level spreader areas, the berm between the two level spreaders
has been removed to heprevent erosion issues m the future The sides of the level
spreaders Zvi ll be rewor ed to reduce the slopes Riprap will be added to the scour
hole/blmd swale area oflthe level spreaders to reduce the velocity and help prevent any
erosion issues in the futihre
At this time the dvork on the pond iii Drainage area B" and the level spreader
area has been done and the work on the pond in drainage area A is ongoing Along with

On April 27 2011 Steve Pusey of the Wilmington Regional Office of the Division of Water
Quality (DWQ) re inspected Cypress Station in Pender County to determine compliance with
Stormwater Management Permit Number SW8 070226 issued on March 16 2007 and
modified September 16 2010 Progress has been made to address the compliance issues
The wet pond vegetated shelf and pond banks have been planted and are starting to grow
Also the level spreader / vegetated filter areas have been improved
However DWQ file review and site inspection revealed that the protect is still not compliant with
the terms and conditions of this permit We are placing the most emphasis on drainage area B
since McDonald s is now requesting an offsite permit for that drainage area Please find a copy
of the completed form entitled Compliance Inspection Report attached to this letter which
summarizes the findings of the recent inspection
As indicated in the attached inspection report the following deficiencies must be resolved
1 A signed sealed copy of the Engineers Certification must be submitted for drainage
Area B after the work is complete Since the work will not be fully complete at this time
for drainage Area A an engineer s certificate can be submitted at a later date for that
area However as a minimum the work described in item 3 below must be completed
2 A copy of the recorded deed restrictions must be submitted
3 Stormwater Measures
Drainage Area A
Inside slopes of pond A need to be re graded to fix erosion problems and excess
sediment and/or trash should be removed from the bottom of the pond and inside outlet
structure Pond should be re seeded as necessary to repair newly graded areas and
other barren areas
Riprap or turf reinforcement matting needs to be added to the steep banks in the area of
the level spreader / vegetated filter Riprap should be added in the bottom of the scour
hole / blind swale of level spreader

to re seed and add straw to this area for protection of new seed Trash and debris need
to be removed from the bottom of the pond

hole / blind swale of level spreader
Please inform this Office in writing before May 13 of the specific actions that will be undertaken
and the time frame that will be required to correct the deficiencies Failure to provide the
requested information when required may initiate enforcement action including the assessment
of civil penalties of up to $25 000 per day If a written plan of action is not submitted to this
office by May 13 then DWQ staff will re inspect the site and issue a Notice of Violation if the
listed deficiencies have not been addressed

On March 25 2011 Steve Pusey of the Wilmington Regional Office of the Division of
Water Quality (DWQ) inspected Cypress Station in Pender County to determine
compliance with Stormwater Management Permit Number SW8 070226 issued on
March 16 2007 and modified on September 16 2010 DWQ file review and site
inspection revealed that the site is not compliant with the terms and conditions of this
permit Please find a copy of the completed form entitled Compliance Inspection
Report attached to this letter which summarizes the findings of the recent inspection
As indicated in the attached inspection report the following deficiencies must be
resolved
1 A copy of the recorded deed restrictions needs to be submitted for this project
2 On both ponds A and B slopes need to be re graded as necessary to fix erosion
problems and ensure that slopes are in accordance with the plans Ponds need
to be stabilized with plants on the vegetated shelf and grass on the berms and
slopes as applicable Level spreaders and vegetated filter strips need to be
constructed downstream of pond outlets as per the approved plans All trash
and debris must be removed from the pond areas including trash collected
inside of outlet structures or other devices Pond slopes are unstable and there
is extensive erosion from the side slopes into the pond bottom Silt fencing is
failing in several areas especially where ponds discharge into the wetlands
This must be repaired
3 Pond A It appears that the outlet structure is incomplete The drawdown device
and trash rack have not been installed Elevations may not be consistent with
the plans
4 Pond B A trash rack needs to be installed on the outlet structure
5 The issues listed above must be resolved and an engineers certification must
be received by this office before any impervious areas can be constructed in
these drainage areas In particular Pond B must be re certified by a professional
engineer after repair work is complete

Please inform this Office in writing before April 26 2011 of the specific actions that will
be undertaken and the time frame that will be required to correct the deficiencies
Failure to provide the requested information when required may initiate enforcement
action including the assessment of civil penalties of up to $25 000 per day If a written
plan of action is not submitted to this office by April 26 2011 then DWQ staff will re
inspect the site and issue a Notice of Violation if the listed deficiencies have not been
addressed
