The Wilmington Regional Office received a complete, modified State Stormwater Management Permit
Application for the subject project on February 27, 2018 Staff review of the plans and specifications has
determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title
15A NCAC 2H 1000 effective January 1, 2017 We are forwarding modified Permit No SW8 060901
dated February 9, 2018, for the construction, operation and maintenance of the stormwater control
measures (SCMs), built -upon areas, as well as the stonnwater collection system and/or vegetated
conveyance system associated with the subject project
This permit shall be effective from the date of issuance until September 21, 2020 and shall be subject to
the conditions and limitations as specified therein, and does not supersede any other agency permit that
may be required Please pay special attention to the permit conditions regarding the operation and
maintenance of the SCMs, Stormwater collection system, and/or vegetated conveyances, the hmttation of
built -upon area, modification of the project, the procedures for changing ownership of and/or transferring
the permit and the need to renew the permit Please also pay attention to the permit conditions that
requires the recordation of deed restrictions and protective covenants, easements, and the maintenance
agreement, which must all be provided along with certification upon completion of the project Failure to
comply with these requirements will result to future compliance problems

North Carolina as amended, and other applicable Laws, Rules, and Regulations

construction, operation and maintenance of two (2) wet detention pond(s) in compliance
with the provisions of 15A NCAC 2H 1000 (hereafter referred to as the "stormwater
rules') and the approved stormwater management plans and specifications and other
supporting data as attached and on file with and approved by the Division of Energy,
Mineral & Land Resources (hereafter referred to as the Division or DEMLR) and
considered a part of this permit
This permit shall be effective from the date of issuance until September 21, 2020, and
shall be subject to the following specified conditions and limitations
I DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data
This stormwater system has been approved for the management of stormwater
runoff as described in Section 15 of this permit The stormwater controls
identified as Pond 9 for the Sales Center and Pond 10 for the Wellness Center
have been designed to handle the runoff from 405,110 square feet and 240,000
square feet of built -upon area, respectively The total impervious area is
645,100 square feet The tract development will be limited to the amount of built -
upon area
All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements The final plats for the project
will be recorded showing all such required easements, in accordance with the
approved plans

The runoff from all built -upon area within the permitted drainage area(s) of this

1 The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface
2 During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately
3 Records of maintenance activities must be kept and made available upon
request to authorized personnel of DEMLR The records will indicate the date,
activity, name of person performing the work and what actions were taken
4 The facilities shall be constructed, operated and maintained in accordance with
the provisions of this permit, the approved plans and specifications, and the
supporting documents attached to this permit and on file with the Division
5 Upon completion of construction prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation Any deviations from the
approved plans and specifications must be noted on the Certification A
modification may be required for those deviations

6 The permittee shall at all times provide the operation and maintenance
necessary to assure the permitted stormwater system functions at optimum
efficiency The approved Operation and Maintenance Plan must be followed in its
entirety and maintenance must occur at the scheduled intervals including, but not
limited to
a Semiannual scheduled inspections (every 6 months)
b Sediment removal
c Mowing and re -vegetation of slopes and the vegetated filter
d Immediate repair of eroded areas
e Maintenance of all slopes in accordance with approved plans and
specifications
f Debris removal and unclogging of outlet structure, orifice device, flow
spreader, catch basins and piping
a Access to the outlet structure must be available at all times
Decorative spray fountains will be allowed in the stormwater treatment system,
subject to the following criteria
a The fountain must draw its water from less than 2' below the permanent
pool surface
b Separated units, where the nozzle, pump and intake are connected by
tubing, may be used only if they draw water from the surface in the
deepest part of the pond
c The falling water from the fountain must be centered in the pond, away
from the shoreline
d The maximum horsepower for the fountain's pump is based on the
permanent pool volume as designated in section 15 of this permit
8 If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility
9 Access to the stormwater facilities for inspection and maintenance shall be
maintained via appropriate recorded easements at all times
10 The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made

11 The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below
a Any revision to any item shown on the approved plans, including the
stormwater management measures, built -upon area, details, etc
b Protect name change
c Transfer of ownership
d Redesign or addition to the approved amount of built -upon area or to the
drainage area
e Further subdivision, acquisition, lease or sale of all or part of the project
area The project area is defined as all property owned by the permittee,
for which Sedimentation and Erosion Control Plan approval or a CAMA
Major permit was sought
f Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan
g The construction of any permeable pavement for BUA credit
12 Prior to the construction of any permitted future areas shown on the approved
plans, the permittee shall submit final site layout and grading plans to the
Division for approval
13 A copy of the approved plans and specifications shall be maintained on file by
the Permittee at all times At the time the permit is transferred to a new owner,
the permittee shall forward the approved plans to the new owner
14 If the use of permeable pavement for BUA credit within the lot is desired, the
permittee shall direct the lot owner to submit an application with all supporting
documentation and the application fee to the Division and receive a permit prior
to construction of the permeable pavement
III GENERAL CONDITIONS
This permit is not transferable to anperson or entity except after notice to and
approval by the Director The permittee shall submit a completed and signed
Name/Ownership Change Form, accompanied by the supporting documentation
as listed on the form, to the Division of Energy Mineral and Land Resources at
least 60 days prior to any one or more of the following events
a An ownership change including the sale or conveyance of the project area
in whole or in part, except in the case of an individual lot sale that is made
subject to the recorded deed restrictions,
b The sale or conveyance of the common areas to a Homeowner's or
Propertyy Owner's Association, subject to the requirements of Session Law
2011-256,
c Bankruptcy,
d Foreclosure, subject to the requirements of Session Law 2013-121,
e Dissolution of the partnership or corporate entity, subject to NCGS 57D-2-
01(e) and NCGS 57D-6-07,
f A name change of the current permittee,
g A name change of the project,
h A mailing address change of the permittee,
2 The permittee is responsible for compliance with all permit conditions until such
time as the Division approves the transfer request Neither the sale of the protect,
in whole or in part, nor the conveyance of common area to a third party
constitutes an approved transfer of the stormwater permit

3 The permittee grants DEMLR Staff permission to enter the property during
normal business hours for the purpose of inspecting all components of the
permitted stormwater management facility
4 Any individual or entity found to be in noncompliance with the provisions of this
stormwater management permit or the requirements of the Stormwater rules is
subject to enforcement procedures as set forth in NCGS 143 Article 21
The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal) having jurisdiction
6 In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems
7 The permit remains in force and effect until modified, revoked, terminated or
renewed The permit may be modified, revoked and reissued or terminated for
cause The filing of a request for a permit modification, revocation and re -
issuance or termination does not stay any permit condition
8 Unless specified elsewhere, permanent seeding requirements for the stormwater
control must follow the guidelines established in the North Carolina Erosion and
Sediment Control Planning and Design Manual
9 Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit
10 The permittee shall notify the Division of any name, ownership or mailing address
changes at least 30 days prior to making such changes
11 The permittee shall submit a permit renewal request at least 180 days prior to the
expiration date of this permit The renewal request must include the appropriate
documentation and the processing fee

This revision request is for a portion of a permitted protect in Brunswick Forest Phase 6 Section 1 was
permitted in September of 2006 with 2 wet retention / detention ponds and then revised later for
reallocation of future BUA in March of 2007 and September 2016 The infrastructure of Lot 2 will use up
approximately 0 35 acres of the allotted future amount for this area No pond design was changed in
the slightest and all the approved design parameters such as area, depth, shelf configuration and
outlets remain unchanged Both ponds have been built and certified
The only things that have changed or been clarified are the impervious BUA allocations These changes
are reflected in the attached chart

PROJECT DESCRIPTION -
The purpose of this revision is to reallocate a portion of the permitted future
impervious area to proposed Off -Site BUA due to the proposed construction
of LOT 2 (DEMLR# SW8 060901 and DLQ Bruns-2007-016) The developers
and future owners of Lot 2 are not the same as the owners of the permit
(Funston Land and Timber, LLC) This plan is to be considered a "minor
modification" to the original permit using up permitted future BUA with the
off -site supplement from the permit owner signed This plan and permit
modification is basically a verification of impervious areas and terms of the
original permit as applies to this project The commercial area of Phase 6 was
allotted 4 29 acres of future BUA as shown in the attached previous revision
The proposed infrastructure of Lot 2 will use up 0 35 acres of this allotted
amount Attached you will find a spreadsheet showing the permitted BUA
totals, as reported on permit, and revised proposed and future quantities for
Pond 9 It is important to note that no changes are being made to the
permitted drainage area or pond design This is just a simple reallocation of
permitted BUA with no change to the total impervious area Pond 10 was
included on the permit but will remain unchanged
Lot 2 is located in the Phase 6 commercial area and is bordered on the East
by Phase 6 Commercial Lot 1 and to the south by Evangeline Drive The
project is located in the Town of Leland in Brunswick County
The developable site is rolling to flat topography The soils in the project area
are primarily foreston loamy fine sand that are moderately well drained The
hydrologic classification of the soil is B Runoff will be collected in drop inlets
placed in the inverted crown parking lot and will travel by means of storm
sewer and tie in to the existing storm system located on Evangeline Drive
then transported to the existing off -site drainage pond/basin 9
