The Wilmington Regional Office received a complete Stormwater Management Permit
Application for Ocean Isle Palms Phase 1 on November 19, 2007 Staff review of the plans
and specifications has determined that the protect, as proposed, will comply with the
Stormwater Regulations set forth in Title 15A NCAC 2H 1000 We are forwarding Permit No
SW8 060338MOD, dated November 29, 2007, for the construction of the protect, Ocean Isle
Palms Phase 1
This permit shall be effective from the date of issuance until November 29, 2017, and shall be
subject to the conditions and limitations as specified therein Please pay special attention to
the Operation and Maintenance requirements in this permit Failure to establish an adequate
system for operation and maintenance of the stormwater management system will result in
future compliance problems
If any parts, requirements, or limitations contained in this permit are unacceptable, you have
the right to request an adtudicatory hearing upon written request within sixty (60) days
following receipt of this permit This request must be in the form of a written petition,
conforming to Chapter 150B of the North Carolina General Statutes, and filed with the Office of
Administrative Hearings, P O Drawer 27447, Raleigh, NC 27611-7447 Unless such demands
are made this permit shall be final and binding

construction, operation and maintenance of a three (3) wet detention pond(s) in
compliance with the provisions of 15A NCAC 2H 1000 (hereafter referred to as the
"stormwater rules') and the approved stormwater management plans and specifications
and other supporting data as attached and on file with and approved by the Division of
Water Quality and considered a part of this permit
This permit shall be effective from the date of issuance until November 29, 2017 and
shall be subject to the following specified conditions and limitations
I DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data
This stormwater system has been approved for the management of stormwater
runoff as described in Section 15 on page 3 of this permit The subdivision is
permitted for 230 lots, each allowed a maximum of 6,000 square feet of built -
upon area The Amenity Center and Canoe and Kayak Club are limited to a
maximum of 93,654 square feet and 3,485 square feet, respectively, of built -upon
area
Approved plans and specifications for this project are incorporated by reference
and are enforceable parts of the permit
4 The runoff from all built -upon area within the permitted drainage area of this
project must be directed into the permitted stormwater control system

II SCHEDULE OF COMPLIANCE
1 No homeowner/lot owner/developer shall fill in, alter, or pipe any drainage feature
(such as swales) shown on the approved plans as part of the stormwater
management system without submitting a revision to the permit and receiving
approval from the Division
2 The permittee is responsible for verifying that the proposed built -upon area for
the entire lot does not exceed the maximum allowed by this permit Once the lot
transfer is complete, the built -upon area may not be revised without approval
from the Division of Water Quality, and responsibility for meeting the built -upon
area limit is transferred to the individual property owner
3 If an Architectural Review Board or Committee is required to review plans for
compliance with the BUA limit, the plans reviewed must include all proposed
built -upon area Any approvals given by the Board do not relieve the homeowner
of the responsibility to maintain compliance with the permitted BUA limit
4 The Director may notify the permittee when the permitted site does not meet one
or more of the minimum requirements of the permit Within the time frame
specified in the notice, the permittee shall submit a written time schedule to the
Director for modifying the site to meet minimum requirements The permittee
shall provide copies of revised plans and certification in writing to the Director
that the changes have been made
5 The stormwater management system shall be constructed in its entirety,
vegetated and operational for its intended use prior to the construction of any
built -upon surface

6 The permittee shall submit to the Director and shall have received approval for
revised plans, specifications, and calculations prior to construction, for any
modification to the approved plans, including, but not limited to, those listed
below
a Any revision to the approved plans, regardless of size
b Project name change
c Transfer of ownership
d Redesign or addition to the approved amount of built -upon area
e Further subdivision, acquisition, or sale of all or part of the protect area
The protect area is defined as all property owned by the permittee, for
which Sedimentation and Erosion Control Plan approval or a CAMA Major
permit was sought
f Filling in, altering, or piping of any vegetative conveyance shown on the
approved plan
7 The Director may determine that other revisions to the protect should require a
modification to the permit
8 All stormwater collection and treatment systems must be located in either
dedicated common areas or recorded easements The final plats for the protect
will be recorded showing all such required easements, in accordance with the
approved plans
9 During construction, erosion shall be kept to a minimum and any eroded areas of
the system will be repaired immediately
10 Upon completion of construction, prior to issuance of a Certificate of Occupancy,
and prior to operation of this permitted facility, a certification must be received
from an appropriate designer for the system installed certifying that the permitted
facility has been installed in accordance with this permit, the approved plans and
specifications, and other supporting documentation Any deviations from the
approved plans and specifications must be noted on the Certification
11 If the stormwater system was used as an Erosion Control device, it must be
restored to design condition prior to operation as a stormwater treatment device,
and prior to occupancy of the facility
12 Permanent seeding requirements for the stormwater control must follow the
guidelines established in the North Carolina Erosion and Sediment Control
Planning and Design Manual
13 The permittee shall at all times provide the operation and maintenance
necessary to assure that all components of the permitted stormwater system
function at optimum efficiency The approved Operation and Maintenance Plan
must be followed in its entirety and maintenance must occur at the scheduled
intervals including, but not limited to
a Semiannual scheduled inspections (every 6 months)
b Sediment removal
c Mowing and re -vegetation of side slopes
d Immediate repair of eroded areas
e Maintenance of side slopes in accordance with approved plans and
specifications
f Debris removal and unclogging of structures, orifice, catch basins and
piping
g Access to all components of the system must be available at all times

14 Records of maintenance activities must be kept and made available upon
request to authorized personnel of DWQ The records will indicate the date,
activity, name of person performing the work and what actions were taken
15 This permit shall become void unless the facilities are constructed in accordance
with the conditions of this permit, the approved plans and specifications, and
other supporting data
16 Prior to the sale of any lot, the following deed restrictions must be recorded
a The following covenants are intended to ensure ongoing compliance with
State Stormwater Management Permit Number SW8 060338MOD, as
issued by the Division of Water Quality under NCAC 2H 1000
b The State of North Carolina is made a beneficiary of these covenants to
the extent necessary to maintain compliance with the Stormwater
Management Permit
c These covenants are to run with the land and be binding on all persons
and parties claiming under them
d The covenants pertaining to stormwater may not be altered or rescinded
without the express written consent of the State of North Carolina, Division
of Water Quality
e Alteration of the drainage as shown on the approved plans may not take
place without the concurrence of the Division of Water Quality
f The maximum built -upon area per lot is 6,000 square feet This allotted
amount includes any built -upon area constructed within the lot property
boundaries, and that portion of the right-of-way between the front lot line
and the edge of the pavement Built upon area includes, but is not limited
to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and
parking areas, but does not include raised, open wood decking, or the
water surface of swimming pools
h All runoff on the lot must drain into the permitted system This may be
accomplished through providing roof drain gutters, which dram to the
street, grading the lot to dram toward the street, or grading perimeter
swales and directing them into the pond or street Lots that will naturally
drain into the system are not required to provide these measures
i Built -upon area in excess of the permitted amount will require a permit
modification
17 A copy of the recorded deed restrictions must be submitted to the Division within
30 days of the date of recording the plat, and prior to selling lots The recorded
copy must contain all of the statements above, the signature of the Permittee, the
deed book number and page, and the stamp/signature of the Register of Deeds
18 Prior to transfer of the permit, the stormwater facilities will be inspected by DWQ
personnel The facility must be in compliance with all permit conditions Any
items not in compliance must be repaired or replaced to design condition prior to
the transfer Records of maintenance activities performed to date will be
required

19 Decorative spray fountains will be allowed in the stormwater treatment system,
subject to the following criteria
a The fountain must draw its water from less than 2' below the permanent
pool surface
b Separated units, where the nozzle, pump and intake are connected by
tubing, may be used only if they draw water from the surface in the deepest
part of the pond
c The falling water from the fountain must be centered in the pond, away frorr
the shoreline
d The maximum horsepower for the fountain's pump is based on the
permanent pool volume The maximum pump power for a fountain in Pond
#12, 14, and 21 is 2 HP, 1 HP, and 1 HP, respectively
III GENERAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and
approval by the Director In the event there is either a desire for the facilities to
change ownership, or there is a name change of the Permittee, a completed
"Name/Ownership Change Form" must be submitted to the Division of Water
Quality, signed by the parties involved, along with the applicable documents as
listed on page 2 of the form The protect must be in good standing with DWQ
The approval of this request will be considered on its merits and may or may not
be approved
The permittee is responsible for compliance with all of the terms and conditions
of this permit until such time as the Director approves the transfer request
Failure to abide by the conditions and limitations contained in this permit may
subject the Permittee to enforcement action by the Division of Water Quality, in
accordance with North Carolina General Statute 143-215 6A to 143-215 6C
4 The issuance of this permit does not preclude the Permittee from complying with
any and all statutes, rules, regulations, or ordinances, which may be imposed by
other government agencies (local, state, and federal), which have jurisdiction
5 In the event that the facilities fail to perform satisfactorily, including the creation of
nuisance conditions, the Permittee shall take immediate corrective action,
including those as may be required by this Division, such as the construction of
additional or replacement stormwater management systems
6 The permit may be modified, revoked and reissued or terminated for cause The
filing of a request for a permit modification, revocation and re -issuance or
termination does not stay any permit condition
7 Permittee grants permission to staff of the DWQ to access the property for the
purposes of inspecting the stormwater facilities during normal business hours
8 The permittee shall notify the Division in writing of any name, ownership or
mailing address changes within 30 days
9 A copy of the approved plans and specifications shall be maintained on file by
the Permittee for a minimum of ten years from the date of the completion of
construction

A complete package includes all of the items listed below The complete application package should be
submitted to the appropriate DWQ Regional Office

restrictions and protective covenants are required for High Density Residential Subdivisions where
lots will be subdivided and sold and runoff will be treated in an engineered stormwater control facility

"built -upon" area consistent with the design criteria used to size the stormwater control facility

level spreaders (revised last winter per Bill hunt 5 recommendation5) were not designed
for the same purpose We are aware that the WRO has been requirmg level spreaders
designed in accordance with the old level spreader design at the outlets to wetlands
and riparian wetlands adjacent to streams, however pond # 12 outlets to a man made
pond that has no adjacent wetlands In this case, we are providmg a rip rap apron in
accordance with the Division of land Quality 5 requirements to prevent erosion, not
provide diffuse flow The other pond outlets are designed with rip rap energy d1551pater5
large enough to handle the flow from the orifice, outlet pipes and emergency overflow
weirs in a non -erosive manner Durmg the first Submittal meeting, we were told that this
was acceptable if calculations demonstrating non -erosive flow were provided We
provided calculations with our submittal This type of energy dissipater 15 needed due to
the in5tabihty of the channehzed stream bank along Jinny 5 Branch
10 Although the additional fee requested 15 provided we do not believe that another
$ 1 000 fee in addition to the $2000 fee that was charged with the last request for
information 15 reasonable We Submitted the original package with all required
documentation and no design changes have been required at this point, only minor edits
and preference requests

The Wilmington Regional Office received a State Stormwater Management Permit
Application for Ocean Isle Palms Phase I on October 11, 2007 with additional
information received on October 30, 2007 A secondary review of that information has
determined that the following information is needed to continue the stormwater review
1 In Section III 6 of the application the square feet of building BUA for the entire
project is inconsistent with the rest of this section
2 Verify the temporary pool volume for Pond #12 listed in the supplement and
calculations According to the table of elevations, areas, and volumes on first
page of the calculations for Pond # 12, the total volume stored at an elevation
of 38 is 204,215 ft3
3 According to the plans, Pond # 21 has two permanent pools with bottom
elevations at —5' and —7', however the updated version of the supplement
indicates that the bottom elevation(s) is at —7' Please verify
4 The invert elevations for two of the inlets draining to the East forebay in Pond
#12 are not labeled on sheet SW-1
5 Add a weir to the East forebay in Pond # 12 to prevent short-circuiting the
runoff from Storm System 'A'
6 On plan sheet SW-2, the invert elevations of equalization pipes for Pond #21
do not correspond with the invert elevations shown in the detail for Pond #21
on plan sheet SW-4
7 Raise the invert elevation of FES #34C near Lot 136 to 1 foot below grade
8 A trash rack is required for the 8" outlet pipes located in Pond #21
9 Provide level spreaders at all stormwater outlets that discharge to wetlands or
surface water per the 401 Wetland BMP

for Ocean Isle Palms, Phase I on October 11, 2007 A preliminary review of that information
has determined that the following information is needed to continue the stormwater review
1 Verify Section III 6 of the application The acre and square feet areas of both the
total project drainage area and Pond 14 drainage area are inconsistent The total
impervious areas for Pond 14 are inconsistent The impervious areas for each pond
drainage area do not add up to the total impervious area presented The on -site
buildings are not presented in square feet
2 Section III 6 of the application indicates that the drainage area to Pond 21 includes
only buildings, streets, and an amenity center However, the plans indicate that
alleyways are also planned for this area Verify whether or not the alleyways will be
located in this drainage area
3 Verify the temporary pool volume for Pond 12 The temporary pool volume is the
volume of water above the permanent pool elevation up to the next available outlet
It appears that the temporary pool volume listed on the supplements and in the
calculations is based on the required outlet elevation (36 46 ft) instead of the actual
outlet elevation (38 ft)
4 Verify the elevation listed in the permanent pool surface area calculation for Pond
12
5 Although the second outlet for Pond 12 is clarified on plan sheet SW-3, please add a
note to plan sheet SWA indicating that it is an emergency outlet
6 The temporary pool elevation for Pond 14 is inconsistent between the calculations
and the plans
7 The forebay volume for Pond 21 listed on the supplement is inconsistent with the
calculations
8 To prevent the equalization pipe in Pond 21 from clogging, the invert of this pipe
should be approximately equal to the sediment removal elevation

General:
Ocean Isle Palms is a proposed high density residential development located off Ocean Isle
Beach Road within Brunswick County, North Carolina The current proposal is for Phase 1
consisting of approximately 108 acres
The intent of this project is to develop streets, drainage improvements, residential lots, and
amenities This phase of the development will support 230 single family home sites The
impervious coverage has been kept to a minimum to promote infiltration as much as possible
Existing Site.
Phase I of the project is located within an existing golf course that will be redeveloped Site
topography in the area is relatively flat with slopes typically less than (4) percent The entire
project follows the natural drainage pattern of north to south into an Unnamed Tributary and
Jinny's Branch, class C,Sw Vegetation consists primarily of grasses, minor ground cover and
row pines Subsurface soils on the site are primarily Leon Sands with some silty sands and
organics The soils are extremely well drained with high infiltration rates
Proposed Improvements:
Improvements proposed include drainage devices, streets, and utilities Drainage for the most
part will sheet flow from the lots into the streets which will have curb and gutter to direct
drainage to low points in the roads Drainage from the low points will dram into 3 stormwater
detention ponds designed to treat the first I" of stormwater runoff from all impervious surfaces
and control the difference between the pre and post development runoff rate for the 1 year and 10
year 24 hour storm event
Drainage Calculation Considerations
Drainage on the site will sheet flow to curb inlets within roadway areas Roof drams or gutters
from buildings will be utilized where needed to direct the runoff from buildings into the street
From there, the drainage will be piped to treatment ponds in accordance with NCDENR
Stormwater regulations
Erosion Control Considerations:
The proposed wet detention pond will provide ample sediment storage for the disturbed area and
will be utilized as a temporary sediment basin during construction Inlet protection is to be
installed as the curb inlets of the drainage piping system are constructed to minimize the amount
of sediment entering the collection system and, ultimately, the temporary sediment basin
Erosion Control Measures and Sequence.
Temporary construction entrance

Energy dissipaters at the pipes into and out of the detention pond
Temporary inlet sediment protection at storm dram inlets
Temporary seeding should construction be halted for the specified time limit (refer to
specifications)
Remove all temporary erosion control measures once installation of utilities and paving
have been completed and a good vegetative ground cover has been established
Maintenance Considerations:
During construction, the Contractor shall be required to inspect and repair as needed all erosion
control devices after any significant ram event Any measure found not performing its intended
function should be repaired immediately Upon completion of construction and establishment of
permanent ground cover, the Owner shall be responsible for maintenance on the project site

The Wilmington Regional Office received a Stormwater Management Permit Application for
Ocean Isle Palms Phase 1A & 1B on August 31, 2007 A preliminary review of that information
has determined that the application is incomplete and will not be accepted Into the Express
Program The following information was required in order for the application to be accepted
1 The drainage area for each pond must be clearly delineated The offsite portion of
the drainage area for Pond 14 is not fully delineated The entire offsite drainage
area must be included on the plans Use a more obvious drainage area line and/or
highlight the different drainage areas
2 The existing contours must be labeled on the plans
3 The offsite areas must be defined with contour lines and labeled with the assigned
BUA
Without the entire drainage area delineated and labeled contour Imes, the application cannot
be reviewed Please pick up the application and check from the front desk by September 7,
2007
My earliest available submittal date is October 11, 2007 at 10 am Please let me know if this
date is acceptable for you Resubmit all of the required items, Including the application fee, at
the future submittal meeting

RFTS is pleased to provide testing services during the design of the stormwater ponds
located at the Ocean Isle Palms residential development off Ocean Isle Beach Road in
Brunswick County, North Carolina
DESCRIPTION OF ACTIVITIES AND FINDINGS
As requested, our staff visited the site on August 8 and 22, 2007 to estimate the seasonal
high watertable at four locations within the area of the proposed stormwater ponds The
purpose of ttus testing was to provide soil parameters for the stormwater pond design
Seasonal High Watertable Estimates
Hand auger borings were advanced to depths ranging approxmiately 4 to 10 feet below
the existing ground surface near the locations of the proposed ponds as identified by Cape
Fear Engineering personnel The encountered soils were logged and visually classified by
depth and a Munsell Soil Color Chart was used to determine the hue, value, and chroma
of the visually distinct soil layers Our sod logs are presented in Table 1
Soils encountered in our boring location for pond 14 consisted of interbedded relatively
clean sands (USCS Soil Groups `SP', `SP-SM') through the upper 101 inches above the
existing ground surface Clayey sand was encountered from 101 to the boring termination
depth of 120 inches Comparison of the soils to the Munsell Chart suggests the seasonal
high water table occurs at approximately 62 inches below the existing ground surface at
pond 14

Sods encountered in our boring location for pond 15 consisted of relatively clean sands
(USCS Soil Groups `SP', SP-SM') in the upper 61 inches below the existing ground
surface The sands were underlain by sands with clay and/or clayey sands (USCS Soil
Group `SC') from 61 to the boring termination depth of 102 inches below the ground
surface Comparison of the soils to the Munsell Chart suggests the seasonal high water
table occurs at approximately 38 inches below the existing ground surface at pond 15
Soils encountered in our boring location for pond 16 consisted of interbedded relatively
clean sands (USCS Soil Groups `SP', `SP-SM') through the upper 54 inches above the
existing ground surface and were underlain by clay with sand from 54 inches to the
boring termination depth of 65 inches below the existing ground surface Comparison of
the soils to the Munsell Chart suggests the seasonal lugh water table occurs at
approximately 22 inches below the existing ground surface at pond 16
Soils encountered in our boring location for pond 21 consisted of clayey sand (USCS Soil
Group `SC') in the upper 10 inches and was underlain by relatively clean sands from 10
inches to the boring termmation depth of 54 inches A measurement made 30 minutes
after augenng indicated a depth to standing water in the borehole of 44 inches below the
existing ground surface Comparison of the soils to the Munsell Chart suggests the
seasonal high water table occurs at approximately 23 inches below the existing ground
surface at pond 21
These seasonal lugh water estimates should be reviewed by appropriate regulatory
authorities before finalizing the details of any civil design
