Effective August 1, 2013 the State Stormwater program has been transferred from the Division of Water
Quality (DWQ) to the Division of Energy, Mineral and Land Resources (DEMLR). All previous
references to DWQ will remain in older stormwater permits issued prior to August 1, 2013 until they. are
modified. Please note that the attached, updated permit will now reference DEMLR as the Division
responsible for issuance of the permit.
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any development
approval issued by the Division of Energy, Mineral and Land Resources under Article 21 of Chapter
143 of the General Statutes, which is current and valid at any point between January 1, 2008, and
December 31, 2010. The law extends the effective period of any stormwater permit that was set to
expire during this time frame up to three (3) years from its current expiration date. On August 2, 2010,
the Governor signed Session Law 2010-177, which granted an extra year for an extension of up to four
(4) years.
On July 16, 2015, the Division of Energy, Mineral and Land Resources (DEMLR) received a
Name/Ownership Change Form for the subject project. A file review was performed on September 2,
2015 by DEMLR staff and as noted in the enclosed inspection report, the undeveloped site is currently
in compliance with the terms and conditions of the current state stormwater permit. As indicated on the
Name/Ownership Change form, Sunset Beach Holdings II, LLC is the current owner of the property as
evidenced by the warranty deed from Tidal Ventures, LLC to Sunset Beach Holdings, LLC recorded on
July 9, 2014 in DB 3544 at PG 0353 and by the warranty deed from Sunset Beach Holdings, LLC to
Sunset Beach Holdings ll, LLC recorded on December 17, 2014 in DB 3596 at PG 0419. You have also
acknowledged receipt of a copy of the permit, which includes the application and supplement forms, a
copy of the approved plans, a copy of the required Operation and Maintenance agreements and a copy
of the required deed restriction statements from the previous permittee.
By acknowledging receipt of the permit, and by signing the Name/Ownership Transfer form, you have
accepted the responsibility for complying with the terms and conditions outlined in this permit. The
Division is hereby notifying you that Permit No. SW8 040740 has been transferred on September 2,
2015 and to remind you that this permit is now in effect until May 16, 2021. For your records, please
find enclosed a copy of the updated permit, a copy of the inspection report, and a copy of the
Name/Ownership Change form. Please keep this cover letter, the updated permit and the approved
plans on file at all times.

This permit is subject to the terms, conditions and limitations as specified therein. Please pay
special attention to the conditions listed in this permit regarding the Operation and Maintenance
of the BMP(s), recordation of deed restrictions, procedures for changing ownership, transferring
the permit, and renewing the permit. Failure to establish an adequate system for operation and.
maintenance of the stormwater management system, to record deed restrictions, to transfer the
permit, or to renew the permit, will result in future compliance problems.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the
right to request an adjudicatory hearing by filing a written petition with the Office of
Administrative Hearings (OAH). The written petition must conform to Chapter 150B of the North
Carolina General Statutes, and must be filed with the OAH within thirty (30) days of receipt of
this permit. You should contact the OAH with all questions regarding the filing fee (if a filing fee
is required) and/or the details of the filing process at 6714 Mail Service Center, Raleigh, NC

Unless such demands are made this permit shall be final and binding.

In accordance with the provisions of Article 21 of Chapter 143, General Statutes of North
Carolina as amended, and other applicable Laws, Rules, and Regulations
PERMISSION IS HEREBY GRANTED TO

FOR THE
construction, operation and maintenance of five (5) underground infiltration trenches in
compliance with the provisions of 15A NCAC 2H .1000 (hereafter referred to as the "stormwater
rules') and the approved stormwater management plans and specifications and other
supporting data as attached and on file with and approved by the Division and considered a part
of this permit.
The permit shall be effective from the date of issuance until May 16, 2021, and shall be subject
to the following specified addendums, clarifications, conditions and limitations:
I. DESIGN STANDARDS
This permit is effective only with respect to the nature and volume of stormwater
described in the application and other supporting data.
2. This stormwater system has been approved for the management of stormwater runoff as
described in Section 1.7 of this permit. The subdivision is permitted for 68 lots, each
allowed a maximum of 2,250 square feet of built -upon area.
3. The five stormwater controls have been designed to handle the runoff from a total of
212,104 square feet of impervious area. Each infiltration trench must be operated with a
50' vegetated filter.
4. The tract and each drainage area will be limited to the amount of built -upon area
indicated in Design Standard Condition 1.7 of this permit, and per approved plans.
5. All stormwater collection and treatment systems must be located in public rights -of -way,
dedicated common areas or recorded easements. The final plats for the project will be
recorded showing all such required rights -of -way, common areas and easements, in
accordance with the approved plans.
6. The runoff from all built -upon area within the permitted drainage areas of this project
must be directed into the permitted stormwater control system.

" Trench #3 consists of 4 sections (3A-3D). Section 3A dimensions (LxWXH) are 139'x8'x1.33';
Section 3B dimensions are 85'x13'x1.33'; Section 3C dimensions are 153'x8'x1.33'; and Section
3D dimensions are 250'x13'x1.33'.
II. SCHEDULE OF COMPLIANCE
1. The stormwater management system shall be constructed in its entirety, vegetated and
operational for its intended use prior to the construction of any built -upon surface.
2. During construction, erosion shall be kept to a minimum and any eroded areas of the
system will be repaired immediately.
3. The facilities shall be constructed in accordance with the conditions of this permit, the
approved plans and specifications, and other supporting data.
4. If the stormwater system was used as an Erosion Control device, it must be restored to
design condition prior to operation as a. stormwater treatment device, and prior to
occupancy of the facility.
5. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and
prior to operation of this permitted facility, a certification must be received from an
appropriate designer for the system installed certifying that the permitted facility has
been installed in accordance with this permit, the approved plans and specifications, and
other supporting documentation. Any deviations from the approved plans and
specifications must be noted on the Certification. A modification may be required for
those deviations.

6. The permittee shall cause the following deed restriction statements to be recorded prior
to the sale of any lot such that all of the lots covered by this permit are made subject to
the permit requirements:
a. The following covenants are intended to ensure ongoing compliance with State
Stormwater Management Permit Number SW8 040740MOD, as issued by the
Division of Energy, Mineral and land Resources under NCAC 2H.1000.
b. The.State of North Carolina is made a beneficiary of these covenants to the extent
necessary to maintain compliance with the Stormwater Management Permit.
c. These covenants are to run with the land and be binding on all persons and parties
claiming under them.
d. The covenants pertaining to stormwater may not be altered or rescinded without the
express written consent of the Division.
e. Alteration of the drainage as shown on the approved plans may not take place
without the concurrence of the Division.
f. The maximum built -upon area per lot is 2,250 square feet. This allotted amount
includes any built -upon area constructed within the lot property boundaries, and that
portion of the right-of-way between the front lot line and the edge of the pavement.
Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel,
brick, stone, slate, coquina and parking areas, but does not include raised, open
wood decking, or the water surface of swimming pools.
g. Any lots within a CAMA-regulated Area of Environmental Concern must count the
roof overhang as built -upon area and/or may be subject to a reduction in their
allowable built -upon area due to CAMA regulations.
h. All runoff on the lot must drain into the permitted system. This may be accomplished
through providing roof drain gutters which drain to the.street, grading the lot to drain
toward the street, or grading perimeter swales and directing them into the pond or
street. Lots that will naturally drain into the system are not required to provide these
extra measures.
i. Built -upon area in excess of the permitted amount will require a permit modification.
7. A copy of the recorded deed restrictions must be submitted to the Division within 30
days of the date of recording the plat, and prior to selling lots. The recorded copy must
contain all of the statements above, the signature of the Permittee, the deed book
number and page, and the stamp/signature of the Register of Deeds.
8. The permittee shall at all times provide the operation and maintenance necessary to
assure the permitted stormwater system functions at optimum efficiency. The approved
Operation and Maintenance Plan must be followed in its entirety and maintenance must
occur at the scheduled intervals including, but not limited to:
a. Semiannual scheduled inspections (every 6 months).
b. Sediment removal.
c. Mowing and revegetation of slopes and the vegetated filter.
d. Immediate repair of eroded areas.
e. Maintenance of all slopes in accordance with approved plans and specifications.
f. Debris removal and unclogging of bypass structure, filter media, flow spreader, catch
basins, piping and vegetated filter.
g. Unencumbered and clear access to the bypass structure must be available at all
times.
9. Records of maintenance activities must be kept and made available upon request to
authorized personnel of DENR. The records will indicate the date, activity, name of
person performing the work and what actions were taken.
10. A copy of the approved plans and specifications shall be maintained on file by the
Permittee at all times.

11. The permittee shall submit to the Director and shall have received approval for revised
plans, specifications, and calculations prior to construction, for any modification to the
approved plans, including, but not limited to, those listed below:
a. Any revision to any item shown on the approved plans, including the stormwater
management measures, built -upon area, details, etc.
b. Redesign or addition to the approved amount of built -upon area or to the drainage
area.
c. Further subdivision, acquisition, lease or sale of all or part of the project area.
d. Filling in, altering, or piping of any vegetative conveyance shown on the approved
plan.
e. The construction of any future BUA specified on the application.
12. The Director may notify the permittee when the permitted site does not meet one or
more of the minimum requirements of the permit. Within the time frame specified in the
notice, the permittee shall submit a written time schedule to the Director for modifying
the site to meet minimum requirements. The permittee shall provide copies of revised
plans and certification in writing to the Director that the changes have been made.
III. GENERAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and approval
by the Director. The permittee shall submit a completed and signed Name/Ownership
Change Form, accompanied by the supporting documentation as listed on the form, to
the Division of Energy, Mineral and Land Resources at least 60 days prior to any one or
more of the following events:
a. An ownership change including the sale or conveyance of the project area in whole
or in part, except in the case of an individual lot sale that is made subject to the
recorded deed restrictions;
b. The sale or conveyance of the common areas to a Homeowner's or Property
Owner's Association, subject to the requirements of Session Law 2011-256;
c. Bankruptcy;
d. Foreclosure;
e. Dissolution of the partnership or corporate entity;
f. A name change of the current permittee;
g. A name change of the project;
h. A mailing address change of the permittee;
2. Any individual or entity found to be in noncompliance with the provisions of a stormwater
management permit or the stormwater rules is subject to enforcement action in
accordance with North Carolina General Statute 143, Article 21.
3. The issuance of this permit does not preclude the Permittee from complying with any
and all statutes, rules, regulations, or ordinances, which maybe imposed by other
government agencies (local, state,, and federal) having jurisdiction.
4. In the event that the facilities fail to perform satisfactorily the Permittee shall take
immediate corrective action, including those as may be required by this Division, such as
the construction of additional or replacement stormwater management systems.
5. The permittee grants DENR Staff permission to enter the property during normal
business hours for the purpose of inspecting all components of the permitted stormwater
management facility.
6. The permit may be modified, revoked and reissued or terminated for cause. The filing of
a request for a permit modification, revocation and reissuance or termination does not
stay any permit condition.
7. Unless specified elsewhere, permanent seeding requirements for the stormwater control
must follow the guidelines established in the North Carolina Erosion and Sediment
Control Planning and Design Manual.

8. Approved plans and specifications for this project are incorporated by reference and are
enforceable parts of the permit.
9. The permittee shall submit a permit renewal application and fee at least 180 days prior
to the expiration date of this permit.

A request to transfer a permit will not be approved by the Division of Water Quality (DWQ) unless.all
of the applicable required items listed below are included with the submittal. Failure to provide the
listed items may result in processing delays or denial of the transfer.

Good Afternoon All,
Tidal Ventures, LLC c/o Sammy Varnam received a CAMA major permit on March 31, 2005 that authorized "only the land
disturbing activities associated with the establishment of the Riverside Drive subdivision, to include the construction of an
access road and associated grading, bulkhead and utilities installation," and was due to expire on December 31, 2008.
Jan Harris of the Brunswick Environmental Action Team (BEAT) filed a petition for and was granted a contested case
hearing on May 20, 2005. BEAT alleged that the proposed development would likely close the adjacent waters to shell
fishing and would include the expenditure of public funds in the OH AEC. The case was heard by ALJ Beryl E. Wade and
ruled that the DCM decision to grant the permit was affirmed. The CRC then adopted the ALJs decision on April 3, 2006.
The permit was modified on June 27, 2007 to include the construction of a storm water infiltration system (SW8040740)
and a boardwalk. The permit was renewed and modified again on January 21, 2014, to include an additional boardwalk
and kayak access pier. The permit is now due to expire on December 31, 2016. The applicant obtained a sedimentation
and erosion control permit for the bulkhead construction and backfill (BRUNS 2005-160). The applicant had an
engineered analysis performed and an engineer certified (Dan Bowman) that the bulkhead and fill placement would not
lead to damaging flow diversion or wave ramping. The applicant also received a Conditional Letter of Map Revision
(CLOMR) from FEMA for Riverside Drive. A general permit for maintenance excavation of the Feeder canal authorized
the placement of spoil material on the Riverside Drive.
The placement of fill in a VE flood zone is NOT prohibited by FEMA. "NFIP regulations prohibit the use of fill for structural
support of buildings in V Zones. However, minor grading, and the placement of minor quantities of fill is allowed, but only
for landscaping, drainage under and around buildings, and support of parking slabs, pool decks, patios, walkways and
similar site elements. Fill must not prevent the free passage of floodwaters and waves beneath elevated buildings. Fill
must not divert floodwaters or deflect waves such that increased damage is sustained by adjacent or nearby buildings."
(FEMA tech. bulletin #5 page 21-22) Based on other FEMA regs and building code requirements, all structures within the
V Zone must be elevated and meet the community's base flood requirements (sunset Beach= BFE +1 foot of freeboard).
Elevated buildings would not require structural fill and would not present an obstruction to wave action.
The construction of a bulkhead and placement of fill on Riverside Drive has been certified by an engineer, stating that the
construction design would not prevent the passage of floodwaters and waves beneath the buildings and would not lead to
damaging flow diversion or wave ramping.
Construction on the bulkhead began in 2005, was on hold during judicial proceedings and was completed in 2008.

Hello Council Members and Town Administrator:
Sandy Wood, Building Code Director, met with Jan Harris (Brunswick County Environmental Action
Team (BEAT) on March 14 and Holly Snider, Field Representative, for Sunset Beach from the
Wilmington office of the N.C. Division of Coastal Management (DCM) on Friday, March 14`h.
The purpose of the meeting was to review the permits for fill on Riverside Drive on the island of
Sunset Beach. Riverside Drive is the long peninsula on the north side of the long man-made canal
on the island — otherwise known as the Jinks Creek Feeder Canal. This canal provides the only
ingress and egress to the 4 finger canals on the east end of Sunset Beach . This entire peninsula
known as Riverside Drive is in a FEMA VE Zone as well as the land on the south side of the long
canal containing the development on the finger canals and Old Campground.
Evidently in 2004, Tidal Ventures (the owners of the Riverside property) was granted a fill permit by
the Division of Coastal Management. Throughout the years other permits were granted by the town
or state Division of Coastal Management. The last permit in the file was granted in 2014 to place fill
on lots 70, 71, and 72 of the platted lots on Riverside Drive by Hollie Snider, a Field Representative
for the Division of Coastal Management in the Wilmington office.
The problem with all of these permits is that putting fill in a VE Zone is prohibited by FEMA
regulations.
It is the local government's responsibility working with the FEMA regional office in Raleigh to make
sure all of FEMA's regulations are met. It is not the state's responsibility to make sure local
governments meet their FEMA obligations (although the state employees should have known better
and so advised the town and should not have been issuing state permits contrary to FEMA
regulations.) If a local -government fails to meet its obligations under the FEMA regulations, our entire
town could lose the ability to participate in the federally -subsidized flood insurance program.
2. To assist local governments in administering FEMA requirements for building in flood zones, FEMA
has developed a number of publications — user friendly and well written. They have offered
workshops to those who will be responsible for administering the FEMA requirements and each state
has a FEMA representative - ours is:

3. One of the most useful publications by FEMA to provide the layman with a general understanding of
the FEMA requirements is the FEMA publication: Unit 5: The NFIP Floodplain Mana eq ment
Requirements. The additional requirements for development in a VE Zone are on pages 5-51
through 5-59. This publication is readily available online by googling the title.
To the point, here are the prohibitions on fill in a VE Zone (Page 5-52). Buildings must be on pilings
"Other methods of elevating buildings — on fill, solid walls or crawlspaces- and floodproofing are
prohibited because these techniques present obstructions to wave action. The force of a breaking
wave is so great that these types of foundations would be severely damaged, resulting in collapse of
the building.
While fill is not allowed for structural support for buildings within V Zones because of the severe
erosion potential of such locations, limited fill is allowed for landscaping, local drainage needs, and to
smooth out a site..."
By allowing a bulkhead and massive amounts of fill dirt to be placed on Riverside Drive, the town has
effectively and illegally created a dam (See pages 5-18-through 5-22). During a hurricane or other
storm, water will pile up in the finger canals and long canal with the only egress through the long and
narrow canal. Instead of spreading out over the tidal marsh to the Intracoastal Waterway, the
confined water will back up into the finger canal properties and the Old Campground properties.
Allowing fill and bulkheading on the north side of the long canal has put all of these properties at a
higher risk for flood damage.
The town has also damaged Tidal Ventures, which has spent lots of money putting in fill dirt and a
bulkhead, because they can't build on this fill. They might have been able to find enough high ground
to put a couple of houses on Riverside Drive prior to filling, but now they have nothing.
All of this could have been so easily avoided if someone in the town had been tending to town
business. All of the information needed has been put out in simple language by the federal
government, and our FEMA contact in Raleigh stands ready to give us assistance with whatever we
need.
I trust the issues raised above can be addressed and resolved to the satisfaction of all affected
parties.

Dear Linda:
Our office received a copy of your letter dated May 21, 2010, requesting a copy of
the recorded deed restrictions and designer's certification. To date, none of the
property has been sold by the developer, no portion of the stormwater treatment
system has been installed, and there is no built -upon area. The developer is aware
that prior to the sale of any lots, the restrictions will need to be recorded. The
developer is also aware that a designer's certification is required to be submitted
to your office after construction is complete.

On May 16, 2007, the Wilmington Regional Office issued a Stormwater Management
Permit to you for Riverside Drive. Per the requirements of the permit, deed restrictions
must be recorded prior to the sale of any lot, and a copy of the recorded deed
restrictions must be forwarded within 30 days of the date of recording. Additionally, the
as -built stormwater system must be certified by an appropriate design professional as
having been constructed in substantial compliance with the permit. A review of our files
indicates that, as of this date, neither the Designer's Certification nor a copy of the
recorded deed restrictions has been received in this Office.
Failure to submit the. Designer's Certification and/or failure to record the deed
restrictions prior to selling lots and/or failure to submit a copy of the recorded deed
restrictions are violations of your permit, and subject to enforcement action. Please
have the stormwater system certified by an appropriate design professional and forward
the completed Designer's Certification and a copy of the recorded deed restrictions to
this Office at the address below by June 21, 2010, or enforcement action may be
initiated and may include recommendations for civil penalties and revocation of the
permit.
If the project has not yet begun construction please provide a written response
regarding the status of construction. If you have any questions, please do not hesitate
