On May 27, 2008, the Wilmington Regional Office received a plan revision for Stormwater
Management Permit Number SW8 030704 The revisions include the addition of a speed
bump for the purpose of diverting runoff to the stormwater system It has been determined that
a formal permit modification is not required for the proposed changes We are forwarding you
an approved copy of the revised plans for your files Please replace the old approved plan
sheet with the new one
Please be aware that all terms and conditions of the permit issued on February 11, 2004,
remain in full force and effect Please also understand that the approval of this revision to
the approved plans for the subject State Stormwater Permit is done on a case -by -case
basis Any other changes to this project must be approved through this Office prior to
construction The issuance of this plan revision does not preclude the permittee from
complying with all other applicable statutes, rules, regulations or ordinances which may
have jurisdiction over the proposed activity, and obtaining a permit or approval prior to
construction

Enclosed for your review and approval is the revised storm water plan, one original and one copy, for Rick s Restaurant
and Sports Bar, Storm Water Project Number SW8 030704 Modifications to the site plan have been added and are
proposed to address your comments in Notice of Violation dated March 31, 2008 to Mr Rick Bumgardner, President,
Alhance US Properties, LLC, P O Box 1210, Sneads Ferry, North Carohna
The proposed modifications to the site plan include redirecting the eastern parking lot sheet flow to the existing curb on the
southern edge of pavement by constructing a speed bump directing it to the storm water pond and preventing it from
flowing off ne The existing curb and embankment on the eastern pavement edge are proposed to be raised to prevent
overtopping and the embankment sloped to direct the runoff to cascade over the curb to the existing Swale to flow to the
existing storm water pond These proposed improvements do not increase the impervious surface area from the ongmal
permit application calculations

Dear Mr Beck
In response to your correspondence dated March 31, 2008 to Mr Rick Bumgardner, President Alliance US Properties,
LLC, P O Box 1210, Sneads Ferry, North Carolina, regarding the Notice of Violation for Stormwater Pernat No
SW 8 030704, the following is offered to the like numbered comments as a "Plan of Action to resolve the violations found
at the subject site
The revised drawings will be provided to the State for approval by May I e, 2008 indicating the changes made to
the subject site plan The existing site drainage will be re -designed to divert the runoff from the south side of the
site to the stormwater pond
The potential for the stormwater runoff to lump the curb will be prevented by raising the height of the curb to 8-
inches high, supported with back&ll on the backside of the curb
Upon State approval of the revised plan and completion of the proposed improvements, the designer's
certification will be provided to the State
If you have any questions or concerns for this "Plan of Action" to resolve the violations found at the site, please advise

Dear Mr Bumgardner
On February 11, 2004, the Wilmington Regional Office of the Division of Water Quality issued
a stormwater management permit to you for the subject project, located at 510 Pete's Way (NC
210) in Sneads Ferry, Onslow County, North Carolina
The project has been found in violation of Stormwater Permit Number SW8 030704 , issued
pursuant to the requirements of 15A NCAC 2H 1000 The violations found are
Section II 9 — The permittee shall submit to the Director and shall have received
approval for revised plans, specifications, and calculations prior to construction,
for any modification to the approved plans, including, but not limited to, a any
revision to the any Item shown on the approved plans
The pavement along the south side of the restaurant is not sloped according to
the approved plans The approved plans indicate a graded swale in the middle of
the driveway is to be provided The last inspection revealed that the driveway has
a continuous slope all the way to the edge of the pavement, where a low wall has
been built in an attempt to contain the runoff and direct it to the pond No
modification has been received or permitted documenting this grading change
2 Section 15 — The runoff from all built -upon area within the permitted drainage
area of this project must be directed In the permitted stormwater control system
Due to the steep slope from the building to the south edge of the driveway
connecting the front and rear parking lots, it appears that the runoff may be
'jumping" the wall and bypassing the pond
3 Section II 7 — Upon completion of construction a certification must be
received certifying that the permitted facility has been installed In accordance
with the permit
The required Designer's Certification has not been submitted Please note that
the certification must also cover the grading of the site

To correct these violations you must
1 Provide a written "Plan of Action" which outlines the actions you will take
to correct the violations and a time frame for completion of those actions,
on or before April 30, 2008
2 Either regrade the access drive such that the permitted grading for the
access drive pavement is provided, or submit revised plans for approval
which show the as -built grading for the project, and how the runoff is now
being directed into the forebay of the detention pond Consideration
should be given to the steep pavement slope and the potential for
bypassing
3 Submit the required Designer's Certification
Failure to provide the "Plan of Action" by April 30, 2008, or to correct the violations by
the date designated in the "Plan of Action", are considered violations of 15A NCAC
2H 1000, and may result in the initiation of enforcement action which may include
recommendations for the assessment of civil penalties, pursuant to NCGS 143-215 6A

3 All the built -upon area associated with the project is graded such that the
runoff drains to the system
4 The outlet/bypass structure elevations are per the approved plan
5 The outlet structure is located per the approved plans
6 Trash rack is provided on the outlet/bypass structure
7 All slopes are grassed with permanent vegetation
8 Vegetated slopes are no steeper than 3 1
9 The inlets are located per the approved plans and do not cause short-
circuiting of the system
10 The permitted amounts of surface area and/or volume have been
provided
11 Required drawdown devices are correctly sized per the approved plans
12 All required design depths are provided
13 All required parts of the system are provided, such as a vegetated shelf,
