On October 8, 2014, the Wilmington Regional Office received a complete request to revise the
approved plans for Stormwater Management Permit Number SW8 010706. The revisions include
clarifying the lot area associated with this development, and approving the alteration in the stormwater
collection system required for the change in the lot layout associated with lots 14 and 16. It has been
determined that a formal permit modification is not required for the proposed changes. We are
forwarding you an approved copy of the revised plans for your files. Please add the attached plans to
the previously approved plan set.
Please be aware that all terms and conditions of the permit issued on December 14, 2007 and as
revised thereafter, remain in full force and effect. Please also understand that the approval of this
revision to the approved plans or to the permit for the subject State Stormwater project is done on a
case -by -case basis. Any other changes to this project must be approved through this Office prior to
construction. The issuance of this plan revision does not preclude the permittee from complying
with all other applicable statutes, rules, regulations or ordinances which may have jurisdiction over
the proposed activity, and obtaining a permit or approval prior to construction. -

Yes, it is a typo. I looked back at the table that was attached to the February 2014 permit, and the same typo was there
(attached for your reference). I have corrected the table and have also attached.

Elizabeth,
I'm looking at the master table for SW8 010706 that you submitted to resolve some of the rounding issues on the lot
area for this permit. However, it appears that the lot area for Lot 2 is too small at 1.06 acres while being allocated
62,000 square feet (or 1.42 acres). The plans revised and approved in February 2014 list the lot area as 1.83 acres. I
this just a typo in the table?

Thanks for the e-mail. I did see that a plan revision was issued in February. The offsite submittal for lot 16 also included
the revised map recorded on B0081 P0016 with Brunswick Co. for lots 14 and 16. It appears in the recorded map, that
the dimensions and area of those lots differ slightly from those that were submitted in February. For instance, in the
recorded plat, the southern edge of lot 16 has a dimension of 149.33' while measuring this same line on the plans
approved in February, it appears to be approximately 143'. The plan revision to SW8 010706 indicated the lot area for
Lot 16 is 44,378 sq ft while the offsite permittee has indicated it is 44,618 square feet.
Am I looking at the information correctly? Any insight would be appreciated.

On March 27, 2014, the Wilmington Regional Office received notification that Lots 14 and 16 were
slightly revised from the plans approved by the Division. Per Section 11.5 of the permit issued on
December 14, 2007 and as revised thereafter, the permittee shall submit to the Division and shall have
received approval for revised plans. Lots 14 and 16 were approved to have a lot area of 44,562 and
44,378 square feet, respectively. The Division has received and approved an offsite permit for Lot 16 in
which it was demonstrated by the revised plat recorded in Book 81, Page 16 on November 18, 2013,
that the lot area for Lot 16 is 44,618 square feet.
Therefore, please submit a Stormwater Plan Revision Package including 2 sets of plans, completed
Plan Revision application form, and supporting documentation, or a written response regarding the
status of this project and the expected submittal date. The plan revision package or the written
response must be received in this Office no later than April 18, 2014. Failure to respond to this request
may result in the initiation of enforcement action, and construction may experience a subsequent delay.

On February 4, 2014, the Wilmington Regional Office received a request to revise the approved plans for Stormwater
Management Permit Number SW8 010706., The project was inspected on February 25, 2014 and found to be in
compliance with the permit. This request has been approved, and a permit expiration date extension has also been
issued.
Plan Revision:
The revisions include revising the lot line between Lots 14 and 16 with impact on permitted impervious areas. It has
been determined that a formal permit modification is not required for the proposed changes. We are forwarding you
an approved copy of the revised plans for your files. Please replace the old approved plan sheet with the new one.
An updated Attachment A showing the impervious area approved for the subdivision is also attached. Please be
aware that all terms and conditions of the permit issued on December 14, 2007, remain in full force and effect.
Please also understand that the approval of this revision to the approved plans for the subject State Stormwater
Permit is done on a case -by -case basis. Any other changes to this project must be approved through this Office prior
to construction. The issuance of this plan revision does not preclude the permittee from complying with all other
applicable statutes, rules, regulations or ordinances which may have jurisdiction over the proposed activity, and
obtaining a permit or approval prior to constriction.
Permit Extension:
On August 5, 2009, the Governor signed Session Law 2009-406. This law impacts any development approval issued
by the Division of Energy, Mineral and Land Resources under Article 21 of Chapter 143 of the General Statutes,
which is current and valid at any point between January 1, 2008, and December 31, 2010. The law extends the
effective period of any stormwater permit that was set to expire during this time frame up to three (3) years from its
current expiration date. On August 2, 2010, the Governor signed Session Law 2010-177, which granted an extra
year for an extension of up to four (4) years. This permit's expiration date has been extended from December 14,
2017 to December 14, 2021.
