This letter is to inform you that the Division has reviewed your comments in reference special
conditions A.(5) and A.(6). These conditions were recommended based on the information presented at
the public meeting. The local citizens expressed sincere concern in reference to the noise and the odor
levels at the facility. In addition, several written comments were received from seasonal residents in
response to the same concerns.
All comments, both verbal and written, were reviewed by the hearing officer, Mr. Steve Mauney,
and a recommendation was made for the Director's signature. The Director has the authority to make
the final decision based on the report prepared by the hearing officer and the information documented in
the facility's permit file. Upon review of all pertinent information related to the facility, the Director
concurred with the hearing officer's recommendation to include the subject special conditions. Please be
advised that the decision was made based on the comments received from all individuals who attended
the public meeting or who sent in written comments, not just on the concerns expressed by Ms. Jane
Gorsline.
The Division understands that the facility does have a backup generator to operate the facility
during power failures, but that automatic switch over to standby power is currently not operational. The
Division would like to reiterate that it is a requirement of Title 15A of the North Carolina Administrative
Code, Subpart 2H.0219 (j) (3)(A) that dual source/dual feed or automatically activated standby power
capable of powering all essential treatment components under design conditions is required for all
treatment works. Therefore, the Division stands by its original recommendation to install an automatic
backup power system within 90 days of the permit issue date.

In response to noise reduction, the Division stands by its original recommendation requiring the
Permittee to prepare and submit a proposed design of an enclosed structure for the blowers or other noise
reduction equipment within three (3) months of the permit issue date and final installation within six (6)
months.
Please remember that plans for the addition of automatic standby power and for the addition of noise
reduction equipment must be submitted to the Asheville Regional office for approval prior to
commencement of construction activities.
The Division intends to enforce the conditions of this permit as issued. Please be advised that
you have the right to an adjudicatory hearing upon written request within thirty (30) days following
receipt of the issued permit. This request must be in the form of a written petition, conforming to
Chapter 150B of the North Carolina General Statutes, and filed with the Office of Administrative
Hearings, Post Office Drawer 27447, Raleigh, North Carolina 27611-7447. Unless such demand is
made, this decision shall be final and binding.

I am very concerned regarding the special conditions included
in this permit without benefit of being able to respond before hand.
Also, the timing of these special conditions, the cost associated
with them and the ability or inability to provide for them within
the next fiscal year which begins in 30 days.
In regards to standby power. There is a generator on site
which is wired to run the plant in case of power outage. Unfortu-
nately it has to be manually started. This in itself is not
really a problem because of the manning of the plant and if power
is out flow to the plant is also curtailed.
Plans for expansion of this plant are currently in Raleigh
awaiting permitting. Along with the expansion these plans include
the upgrading and installation of new automatic standby power.
Because our budget for the next fiscal year has already been
established and because standby power could better be handled
during expansion I am requesting this special condition be delayed
until plant expansion.
In regards to noise reduction. Again you are placing me in a
position where funds are not available due to the year end and the
budget established for next year. In addition this plant was in
place long before Ms Gorsline moved into her house. We have done
everything to accommadate Ms Gorsline absent extreme modifications
to the plant. Her goal, as stated by her, is for this plant to
relocate somewhere else. There were no complaints regarding this
plant until Ms Gorsline moved into the area during her summer stays.
In as much as there are no parameters that establish what the noise
level is now and what level it should be lowered to,wha,ts::o Eliminate

action to force me to do something else. Everyone from the Governor's
office, EPA and state did not feel the noise level at the plant
was offensive.
I don't feel it is fair to impose an expense on me that is not
budgeted and not available to attempt to placate one individual.
If in fact you are going to enforce this then at lease let me
accomplish it during expansion when everything can be designed
properly to accommodate existing and future blowers and motors.
Your understanding and corporation in this matter would
be greatly appreciated.
