Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: S&EC completed a wetland delineation and Neuse River Buffer determination for the entire property so that natural resources can be identified and impacts minimized to the maximum extent practicable. Impact 1 is proposed permanent and temporary wetland impacts for a roadway. This impact is necessary to access the northwestern lots of the proposed development. The impact is occurring at the top of the wetland drainage and is utilizing a retaining wall to minimize wetland impacts to the maximum extent practicable. Impact 2 proposed permanent and temporary stream impacts as well as permanent buffer impacts for a road crossing. This crossing is necessary to connect the southern and northern portions of the development. The crossing will occur at a perpendicular angle to the stream to minimize stream impacts. Retaining walls will be utilized as well as a riprap dissipator pad to minimize stream degradation downstream. Impact 3 is proposed permanent and temporary wetland impacts, temporary stream, and permanent buffer impacts for a utility crossing. The crossing is necessary to provide sanitary sewer for the development. This utility crossing is connecting to an existing sanitary sewer easement to the southeast. Compensatory mitigation at a 3:1 ratio has been proposed to offset Zone 1 buffer impacts. lb. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: There will be dewatering with a cofferdam used for the stream crossing, silt fencing and tree protection fence to protect the wetlands and stream areas, walls added to minimize impacts to wetlands, bucked grade on storm sewer to keep from building a second stormwater management pond, design to minimize velocity dissipator impact and location of SCM A to allow for outlet with no wetland or stream impact. 2. We have reviewed the information provided by you concerning the aquatic resources, and by copy of this e-mail, are confirming that the aquatic resources delineation has been verified by the Corps to be a sufficiently accurate and reliable representation of the location and extent of aquatic resources within the identified review area. The location and extent of these aquatic resources are shown on the delineation map entitled, "Wetland Sketch Map, Lake Glad Road" and dated 03/09/2022. Regulatory Guidance Letter (RGL) 16-01 https://usace.contentdm.ocic.org/utils/getfile/collection/p16021co119/id/1256 provides guidance for Jurisdictional Determinations (JD) and states, "The Corps generally does not issue a JD of any type where no JD has been requested." Currently, we are only verifying the delineation. This delineation may be relied upon for use in the permit evaluation process, including determining compensatory mitigation. This verification does not address nor include any consideration for geographic jurisdiction on aquatic resources and shall not be interpreted as such. This delineation verification is not an Approved Jurisdictional Determination (AJD) and is not an appealable action under the Regulatory Program Administrative Appeal Process (33 CFR Part 331). For future projects, please visit the Raleigh Field Office's project planning website at https://www.fws.gov/raleigh/pp.html. If you are only searching for a list of species that may be present in the project's Action Area, then you may use the Service's Information, Planning, and Consultation System (IPaC) website to determine if any listed, proposed, or candidate species may be present in the Action Area and generate a species list. The IPaC website may be viewed at https://ecos.fws.gov/ipac/. The IPaC web site contains a complete and frequently updated list of all endangered threatened species protected by the provisions of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531 et seq.)(Act), a list of federal species of concerns that are known to occur in each county in North Carolina, and other resources. Section 7 of the Act requires that all federal agencies (or their designated non-federal representative), in consultation with the Service, insure that any action federally authorized, funded, or carried out by such agencies is not likely to jeopardize the continued existence of any federally -listed endangered or threatened species. A biological assessment or evaluation may be prepared to fulfill that requirement and in determining whether additional consultation with the Service is necessary. In addition to the federally -protected species list, information on the species' life histories and habitats and information on completing a biological assessment or 1 The term "federal species of concern" refers to those species which the Service believes might be in need of concentrated conservation actions. Federal species of concern receive no legal protection and their designation does not necessarily imply that the species will eventually be proposed for listing as a federally endangered or threatened species. However, we recommend that all practicable measures be taken to avoid or minimize adverse impacts to federal species of concern. evaluation and can be found on our web page at http://www.fws.gov/raleigh. Please check the web site often for updated information or changes. If your project contains suitable habitat for any of the federally -listed species known to be present within the county where your project occurs, the proposed action has the potential to adversely affect those species. As such, we recommend that surveys be conducted to determine the species' presence or absence within the project area. The use of North Carolina Natural Heritage program data should not be substituted for actual field surveys. If you determine that the proposed action may affect (i.e., likely to adversely affect or not likely to adversely affect) a federally -protected species, you should notify this office with your determination, the results of your surveys, survey methodologies, and an analysis of the effects of the action on listed species, including consideration of direct, indirect, and cumulative effects, before conducting any activities that might affect the species. If you determine that the proposed action will have no effect (i.e., no beneficial or adverse, direct or indirect effect) on federally listed species, then you are not required to contact our office for concurrence (unless an Environmental Impact Statement is prepared). However, you should maintain a complete record of the assessment, including steps leading to your determination of effect, the qualified personnel conducting the assessment, habitat conditions, site photographs, and any other related articles. With regard to the above -referenced project, we offer the following remarks. Our comments are submitted pursuant to, and in accordance with, provisions of the Endangered Species Act. Based on the information provided and other information available, it appears that the proposed action is not likely to adversely affect any federally -listed endangered or threatened species, their formally designated critical habitat, or species currently proposed for listing under the Act at these sites. We believe that the requirements of section 7(a)(2) of the Act have been satisfied for your project. Please remember that obligations under section 7 consultation must be reconsidered if: (1) new information reveals impacts of this identified action that may affect listed species or critical habitat in a manner not previously considered; (2) this action is subsequently modified in a manner that was not considered in this review; or, (3) a new species is listed or critical habitat determined that may be affected by the identified action. However, the Service is concerned about the potential impacts the proposed action might have on aquatic species. Aquatic resources are highly susceptible to sedimentation. Therefore, we recommend that all practicable measures be taken to avoid adverse impacts to aquatic species, including implementing directional boring methods and stringent sediment and erosion control measures. An erosion and sedimentation control plan should be submitted to and approved by the North Carolina Division of Land Resources, Land Quality Section prior to construction. Erosion and sedimentation controls should be installed and maintained between the construction site and any nearby down -gradient surface waters. In addition, we recommend maintaining natural, vegetated buffers on all streams and creeks adjacent to the project site. The North Carolina Wildlife Resources Commission has developed a Guidance Memorandum (a copy can be found on our web site at (http://www.fws.gov/raleigh) to address and mitigate secondary and cumulative impacts to aquatic and terrestrial wildlife resources and water quality. We recommend that you consider this document in the development of your projects and in completing an initiation package for consultation (if necessary). We hope you find our web page useful and informative and that following the process described above will reduce the time required, and eliminate the need, for general correspondence for species' lists. If you have any questions or comments, please contact John Ellis of this office at (919) 856-4520 ext. 26. Sincerely, Pete Benja(i\f min Field Supervisor LiGd 100 WithersRavenel / Our People. April 30, 2021 Ms. Brandee Melcher Taylor Morrison of Carolinas, Inc. 15501 Weston Parkway Suite 100 Cary, NC 27513 Re: Lake Glad Wendell, Wake County, NC Threatened & Endangered Species Assessment Report WR Project #02210189.00 Ms. Melcher, On April 1, 2021, WithersRavenel (WR) conducted a site review of the Lake Glad project area (Review Area) for the purpose of evaluating the presence of federally listed threatened and endangered species and/or potential habitat within the review area. The review area is ±40.27 acres located on one parcel (Wake County PIN: 1783569875,) located on Lake Glad Road in Wendell, Wake County (Lat: 35.771108°N; Long:-78.375501°W) as depicted in the attached exhibits. The review area is in the Neuse River Basin (HUC 03020201) and onsite waters drain to Buffalo Creek. The water Quality Classification for Buffalo Creek is C; NSW and the Stream Index Number is 27-57- 16-(3). WR surveyed the review area for the presence of federally listed threatened and endangered species, or their potential habitat, protected under the Endangered Species Act (ESA). This report summarizes the findings of the survey. Proposed Activities The project proposes to construct a residential subdivision and associated infrastructure within the review area. Site Conditions The review area consists of undeveloped land which contains forests, access trails, a stream, and a small pond. The vegetative communities within the review area consist of early successional forest, mixed hardwood/pine forest, and kudzu as depicted in the Vegetative Communities Exhibit. The adjoining areas are mostly residential or commercial development around the review area. The early successional area comprises most of the review area and was recently clearcut for harvesting of the timber. The review of historic aerial photography determine that this area was harvested between October 2017 to February 2018. The average height of this vegetation is approximately five to six feet tall. Early successional trees include red maple (Acer rubrum), sweetgum (Liquidambar styraciflua), loblolly pine (Pinus taeda), Bradford pear (Pyrus calleryana), Chinese privet (Ligustrum sinense), and black cherry (Prunus serotina) saplings. Herbaceous plants include dog fennel (Eupatorium capillifolium), honeysuckle (Lonicera japonica), rabbit tobacco (Pseudognaphalium obtusifolium), goldenrod (Solidago sp.) and greenbrier (Smilax rotundifolia). The mixed hardwood/pine forest is found along the riparian buffer of the perennial stream. This area had very limited harvesting of trees. This area consists of a dense canopy of red maple, tulip poplar 115 MacKenan Drive, Cary, NC 27511 t: 910.256.9277 I f: 910.256.2584 I www.withersravenel.com I License No. C-0832 Asheville I Cary I Greensboro I Pittsboro I Raleigh I Wilmington ■0 WithersRavenel IN Our People. The understory is vegetated with saplings of the same species as well as eastern redcedar (Juniperus virginiana), thorny olive (Elaeagnus pungens), and Chinese privet. There is a significant herbaceous layer present consisting of a mixture of giant cane (Arundinaria gigantea), Japaneses (Microstegium vimineum), and American black elderberry (Sambucus canadensis). The kudzu is in the southern portion of the review area. Based on the review of historic aerial photography, the kudzu is located where there was a historic farm field that is no longer farmed. The vegetation in this area consists predominately of kudzu (Pueraria montana), along with Japanese stiltgrass and a variety of grasses. The pond is small (< 0.5 acres) and drains into to the perennial stream and has similar vegetation as the mixed hardwood/pine forest surrounding the edges of the pond. Threatened & Endangered Species Review Methodology WR reviewed the US Fish and Wildlife Service's online threatened and endangered species database, located at: http://www.fws.gov/raleigh/species/cntylist/nc counties.html and the NC Wildlife Resource Commission's "State and Federally Listed Endangered Wildlife Species of North Carolina" publication, located at www.ncwildlife.org, to identify federally listed threatened and endangered species known to occur in Wake County, North Carolina. Based on the review of the US Fish and Wildlife Service's (USFWS) online database, last updated on 07/17/2020, there are seven federally listed endangered or threatened species (bald eagle, Cape Fear shiner, red -cockaded woodpecker, dwarf wedgemussel, Tar River spinymussel, yellow lance, and Michaux's sumac) and three federally listed proposed threatened species (Atlantic pigtoe, Carolina madtom, and Neuse River waterdog) known to occur within Wake County. The USFWS list of threatened and endangered species known to occur in Wake County has been provided as an Appendix. WR submitted a project review request to the NCNHP through their Data Explorer webpage, located at: https://ncnhde.natureserve.org/, to identify known occurrences of federally listed threatened or endangered species within 1.0 mile of the review area. The NCNHP project review did not identify any known occurrences of federally listed species within the review area or within 1.0 mile of the review area, as documented in the attached letter from NCNHP dated 04/09/2021. Additionally, WR reviewed the NCNHP GIS data and there are no known occurrences of federally listed species within 2.0 miles of the review area. On 04/01/2021, WR conducted a pedestrian survey to assess vegetative communities and identify potential habitat for, or occurrences of federally listed species within or immediately adjacent to the review area. The review area contains four vegetative communities which consists of early successional area, mixed hardwood/pine forest, and kudzu in the Site Conditions section of this report. Species Synopsis and Pedestrian Survey Results The U.S. Fish and Wildlife Service (USFWS) maintains lists of species that receive Federal protection under the Endangered Species Act. Endangered (E) status refers to "any species which is in danger of extinction throughout all or a significant part of its range," and Threatened (T) status refers to any species which is "likely to become endangered within the foreseeable future throughout all or a significant portion of its range" (Endangered Species Act, Section 3). Plants and animals classified as Page 2 of 9 110 WithersRavenel IN Our People. Your Success. Lake Glad - Wake County Proposed (P) are currently proposed for official designation of a protected species under the Endangered Species Act. Plants and animals classified as Endangered (E) or Threatened (T) by the USFWS are protected under the provisions of Section 7 and Section 9 of the Endangered Species Act of 1973, as amended. The following table presents federally listed species by the USFWS for Wake County, North Carolina as last updated on 07/17/2020. Large dominant trees are utilized for nesting sites, typically within 1.0 mile of open water. WR reviewed the NC Natural Heritage Program GIS data to determine the location of the known bald eagle nest sites and their distance from the review area. Based on the NC Natural Heritage Program GIS data, there are no known occurrences of bald eagle nesting/roosting sites within 1.0 mile of the review area. The US Fish and Wildlife Services' "National Bald Eagle Management Guidelines" (May 2007) specifies that activities taking place more than 660' from a bald eagle nest will have no effect on the nesting activities. During the pedestrian surveys, no bald eagles or their nests were observed within or adjacent to the review area. Additionally, no bald eagles were observed in flight. The project area did not contain large dominant trees with unobstructed access that could be used for nesting sites. Additionally, there is no potential foraging habitat within 2.0 miles. Page 3 of 9 ■0 WithersRavenel IN Our People. Your Success. Lake Glad - Wake County Based on a lack of suitable nesting habitat, and lack of nearby records, WR concludes that the project will have No Effect on bald eagles. Biological Determination - No Effect Cape Fear Shiner (E) The Cape Fear shiner is a small (approximately 2" long), yellowish minnow with a black band along the sides of its body. The Cape Fear shiner is generally associated with gravel, cobble and boulder substrates and is endemic to the upper Cape Fear River Basin in the Central Piedmont of North Carolina. The project area is in the Neuse River Basin and the Cape Fear shiner is not endemic to this river basin. Therefore, WR concludes that the project will have No Effect on the Cape Fear shiner. Biological Determination - No Effect Red -Cockaded Woodpecker (E) The red -cockaded woodpecker (RCW) occurs in extensive tracts of open stands of mature pines, particularly longleaf pine (Pinus palustris), for foraging and nesting/roosting habitat, typically 70 to 100 acres or more. The red -cockaded woodpecker is rarely found in deciduous or mixed pine -hardwoods. The RCW excavates cavities for nesting and roosting in living pine trees, aged 60 years or older, which are contiguous with pine stands at least 30 years of age to provide foraging habitat. Optimal habitat is characterized as a broad savanna with a scattered overstory of large pines and a dense groundcover containing a diversity of grass, forbs, and shrub species. Midstory vegetation is sparse or absent. Frequent fires maintain the quality of the RCW's habitat. The foraging range of the RCW is normally no more than 0.5 mile. Based on the review of the NCNHP GIS data, there are no known occurrences within 2.0 miles of the review area. There is no potential habitat for RCW observed within the review area. The project area comprises mostly of early successional and mixed hardwood forests which is not suitable habitat for RCW. A review of aerial photography determined that there are no large areas of mature pine forest within 0.5 mile of the review area sufficient to be considered suitable RCW nesting habitat. Therefore, the review area was not considered potential RCW foraging habitat. Based on a lack of potential habitat, and lack of nearby records, WR concludes that the proposed project will have No Effect on RCW. Biological Determination - No Effect Dwarf Wedgemussel (E) In North Carolina, the dwarf wedgemussel is known from the Neuse and Tar River drainages. The mussel inhabits creek and river areas with a slow to moderate current and sand, gravel, or firm silt bottoms. Water in these areas must be well oxygenated. Stream banks are generally stable with extensive root systems holding soils in place. Based on the review of the NCNHP GIS data, there are no known occurrences within 2.0 miles of the review area. The proposed project is in the USFWS know habitat range for the dwarf wedgemussel. The perennial stream that bisects the review area is small (less than 6 feet wide) and is shallow (less than one six inches deep) with slow flow. The stream banks are not generally stable as there was evidence of stream bank erosion consisting of several large treefalls along the stream bank, bank sloughing and Page 4 of 9 ■0 WithersRavenel Our People. Your Success. Lake Glad - Wake County sediment deposits in the stream channel (see Photo Documentation). Therefore, the stream was not considered potential habitat. The pond was not considered potential habitat as the dwarf wedgemussel is not known to inhabit ponds. Targeted surveys were not conducted to determine the presence/absence of a population. Based on a lack of potential habitat, and lack of nearby records, WR concludes that the proposed project will have No Effect on dwarf wedgemussel. Biological Determination - No Effect Tar River Spinymussel (E) The Tar River spinymussel is endemic only to the Tar River and Neuse River systems in North Carolina. The brownish shell is rhomboid -shaped, up to 2.4 inches (6 cm) long, with 0-6 spines on each valve. The shell is rather smooth and shiny, with concentric rings, and ends in a blunt point. Younger individuals are orange -brown with greenish rays streaking outward from the hinge area. Adults are darker with less distinct rays. The Tar River spinymussel lives in relatively silt -free uncompacted gravel and/or coarse sand in fast -flowing, well oxygenated stream reaches. It is found in association with other mussels, but it is never very numerous. It feeds by syphoning and filtering small food particles that are suspended in the water. Based on the review of the NCNHP GIS data, there are no known occurrences within 2.0 miles of the review area. The proposed project is in the USFWS known habitat range for the Tar River Spinymussel. The perennial stream in the project is small (less than 6 feet wide), shallow (less than one six inches deep), and low flow. The stream banks are not generally stable with evidence of stream bank erosion consisting of several large treefalls along the stream bank, bank sloughing and sediment deposits in the stream channel (see Photo Documentation). Therefore, the stream was not considered potential habitat. The pond was not considered potential habitat as the Tar River Spinymussel is not known to inhabit ponds. Targeted surveys were not conducted to determine the presence/absence of a population. Based on the lack of potential habitat, and lack of nearby records, WR concludes that the proposed project will have No Effect on Tar River Spinymussel. Biological Determination - No Effect Michaux's Sumac (E) Michaux's sumac a rhizomatous, densely hairy shrub, with erect stems from 1 - 3 feet (ft) (30.5 - 91 centimeters, cm) in height. The compound leaves contain evenly serrated, oblong to lanceolate, acuminate leaflets. The flowers are small, borne in a terminal, erect, dense cluster, and colored greenish yellow to white. Flowering usually occurs from June to July; while the fruit, a red drupe, is produced through the months of August to October. Michaux's sumac is typically found in the inner Coastal Plain and lower Piedmont and grows in sandy or rocky, open, upland woodlands on acidic or circumneutral, well drained sands or sandy loam soils. This species is also found around maintained railroad, roadside, power line and utility rights -of -way, areas where forest canopies have been opened by blow downs and/or storm damage; small wildlife food plots, abandoned building sites, under moderately dense pine or pine/hardwood canopies; and in and along edges of other artificially maintained clearings undergoing natural succession. In the central Piedmont, it occurs on clayey soils derived from mafic rocks. Michaux's sumac is shade intolerant and, therefore, grows best where Page 5 of 9 ■0 WithersRavenel IN Our People. Your Success. Lake Glad - Wake County disturbance (i.e., mowing, clearing, grazing, periodic fire) maintains its open habitat. Based on the review of the NCNHP GIS data, there are no known occurrences within 2.0 miles of the review area. The mixed hardwood/pine forest along the stream has a tree canopy and significant herbaceous layer. These areas create shade that Michaux's sumac is intolerant and cannot survive. These areas were not considered suitable habitat for Michaux's sumac (see Photo Documentation). The project area is mostly densely vegetative early successional with vegetation heights of 5-6 ft. Due to density of vegetative we believe that a population of Michaux's sumac is not in these areas. However, based on recent coordination with USFWS on similar conditions USFWS has considered early successional areas in cutovers to be potential habitat. The kudzu area was not considered potential habitat. While the kudzu was dominant during the pedestrian survey, there were no woody species in this area. This indicates that the growth rate of the kudzu during the growing season is sufficient to out compete and prevent the growth of native woody species, including Michaux's sumac. Additionally, potential habitat was identified along the edges of the mixed hardwood/pine forest where there are tree blow downs and disturbances, along the edges of trails, and the edges of the kudzu, as the vegetation has not grown to a tall enough height to shade out Michaux's sumac. A pedestrian survey was conducted along these edges which did not identify any occurrences of Michaux's sumac. Based on the lack of nearby records and limited potential habitat in the review area, WR concludes that the proposed project is not anticipated to adversely affect Michaux's sumac. However, the survey was conducted outside of the USFWS optimal survey window and we cannot conclusively determine that Michaux's sumac is not present, although it is our opinion that it is unlikely that Michaux's sumac exists within the review area. WR recommends that additional surveys along these areas should be conducted within the USFWS optimal survey window (May -October) to confirm the absence of Michaux's sumac. Biological Determination - May Affect, Not Likely to Adversely Affect - Additional Surveys Needed Yellow Lance (T) The yellow lance is a freshwater mussel found in the Chowan, Tar and Neuse River basins in North Carolina. The yellow lance is a bright yellow elongate mussel with a shell over twice as long as tall, usually not more the 86mm (3.4 inches) in length. The yellow lance is a sand -loving species often found buried deep in clean, coarse to medium sand and sometimes migrating with shifting sands, although it has been found in gravel substrates. The species is dependent on clean moderate flowing water with high dissolved oxygen content in riverine or larger creek environments. Based on the review of the NCNHP GIS data, there are no known occurrences within 2.0 miles of the review area. The proposed project is in the USFWS known habitat range for the yellow lance. The perennial stream in the project area has mostly a sand substrate with some cobble and gravel. However, the stream is small (less than 6 feet wide), and shallow (less than one six inches deep) (See Photo Documentation). Therefore, the stream was not considered potential habitat. The pond was not considered potential habitat as the yellow lance is not known to inhabit ponds. Targeted surveys were not conducted to determine the presence/absence of a population. Based on the lack of potential habitat, and lack of nearby records, WR concludes that the proposed project will have No Effect on yellow lance. Biological Determination - No Effect Page 6 of 9 ■0 WithersRavenel IN Our People. Your Success. Lake Glad - Wake County Proposed Listed Species Atlantic Pigtoe (PT) The Atlantic pigtoe is a freshwater mussel with a chunky, rhombus shape, like that of a pig's hoof/toe. The outer shell is yellow to dark brown and parchment -like, while the inner layer is iridescent blue to salmon, white or orange. The Atlantic pigtoe rarely exceeds 2-inches in length. The preferred habitat for the Atlantic pigtoe is coarse sand and gravel in small creeks and large rivers with excellent water quality, where flows are sufficient to maintain clean, silt free substrates. In NC, Atlantic pigtoe is found in the James, Chowan, Roanoke, Tar, Neuse, Cape Fear, and Pee Dee River basins. Based on the review of the NCNHP GIS data, there are no known occurrences within 2.0 miles of the review area. The proposed project is located within the USFWS know habitat range for the Atlantic pigtoe. The pond was not considered potential habitat as the Atlantic pigtoe is not known to inhabit ponds. Targeted surveys were not conducted to determine the presence/absence of a population. Based on the lack of potential habitat, and lack of nearby records, WR concludes that the proposed project will have No Effect on Atlantic pigtoe. Biological Determination - No Effect Carolina Madtom (PE) The Carolina madtom is a small fish, growing to only 5 inches at their largest, and have a short, tan body with three wide dark saddles across the back and a black lateral stripe and dark blotch on their adipose fin. Carolina madtom is endemic to the Neuse and Tar River basins and prefer free -flowing small to medium freshwater rivers with clean sand or gravel bottoms. They are typically found in very shallow water with little or no current. During the summer, they can be found hiding under mussel shells, logs, pieces of bark and other cover. Based on the review of the NCNHP GIS data, there are no known occurrences within 2.0 miles of the review area. The perennial stream in the project is small (less than 6 feet wide), and shallow (less than one six inches deep) and therefore was not considered potential habitat based on habitat requirements. The pond was not considered potential habitat as the Carolina madtom is not known to inhabit ponds. Targeted surveys were not conducted to determine the presence/absence of a population. Based on the lack of potential habitat, and lack of nearby records WR concludes that the proposed project will have No Effect on Carolina madtom. Biological Determination - No Effect Neuse River waterdog (PT) The Neuse River waterdog is a permanently aquatic salamander that can grow up to 11 inches long. It has a reddish -brown body with an irregular pattern of large blue or black spots, and the belly is typically dull brown or gray color with spots similar to those seen elsewhere on the body. Adults have elongated heads with squared -off noses, cylindrical trunks and tails that are laterally compressed and ridged. Three dark -red, bushy gills project from either side of the head and a dark line runs through Page 7 of 9 110 WithersRavenel IN Our People. Your Success. Lake Glad - Wake County the eye. The limbs are rather small, and the front and hind feet have four toes. The Neuse River waterdog is endemic to the Neuse River basin and have specific habitat characteristics of low to moderate gradient streams and low current velocity and are typically found in streams wider than 15 meters. The Neuse River waterdog required relatively high oxygen levels and water quality and is found in large accumulations of submerged leaved in eddies, or backwaters of streams. Based on the review of the NCNHP GIS data, there are no known occurrences within 2.0 miles of the review area. The perennial stream in the project is small (less than 6 feet wide), and shallow (less than six inches deep) and therefore was not considered potential habitat based on habitat requirements (see Photo Documentation). Therefore, the stream was not considered potential habitat. The pond was not considered potential habitat as the Neuse River waterdog is not known to inhabit ponds. Targeted surveys were not conducted to determine the presence/absence of a population. Based on the lack of potential habitat, and lack of nearby records WR concludes that the proposed project will have No Effect on Neuse River waterdog. Biological Determination - No Effect Summary The review area does not contain occurrences of, or potential habitat for the bald eagle, Cape Fear shiner, red -cockaded woodpecker, dwarf wedgemussel, Tar River spinymussel, yellow lance, Atlantic pigtoe, Carolina madtom, and Neuse River waterdog and will have no effect on these species. The review area has marginal potential habitat for Michaux's sumac, none was observed. However, the survey was conducted outside of the USFWS optimal survey window and therefore we cannot conclusively determine that Michaux's sumac is not present, although it is our opinion that it is unlikely that Michaux's sumac exists within the review area. WR concludes that additional surveys within the identified potential should be conducted within the USFWS optimal survey window (May -October) to confirm the absence of Michaux's sumac. Bald and Golden Eagle Protection Act (BGPA): In the July 9, 2007 Federal Register( 72:37346-37372), the bald eagle was declared recovered, and removed (de -listed) from the Federal List of Threatened and Endangered wildlife. This delisting took effect August 8,2007. After delisting, the Bald and Golden Eagle Protection Act (Eagle Act) (16 U.S.C. 668-668d) becomes the primary law protecting bald eagles. The Eagle Act prohibits take of bald and golden eagles and provides a statutory definition of "take" that includes "disturb". The USFWS has developed National Bald Eagle Management Guidelines to provide guidance to land managers, landowners, and others as to how to avoid disturbing bald eagles. For mor information, visit http://www.fws.gov/migratorybirds/baldeagle.htm Threatened due to similarity of appearance(T(S/A)): In the November 4, 1997 Federal Register (55822-55825), the northern population of the bog turtle (from New York south to Maryland) was listed as T (threatened), and the southern population (from Virginia south to Georgia) was listed as T(S/A) (threatened due to similarity of appearance). The T(S/A) designation bans the collection and interstate and international commercial trade of bog turtles from the southern population. The T(S/A) designation has no effect on land management activities by private landowners in North Carolina, part of the southern population of the species. In addition to its official status as T(S/A), the U.S. Fish and Wildlife Service considers the southern population of the bog turtle as a Federal species of concern due to habitat loss. Reid Wilson, Secretary Walter Clark ❑irector, Division of Land and Water Stewardship N CN H D E-14425 The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide information about natural heritage resources for the project referenced above. A query of the NCNHP database indicates that there are records for rare species, important natural communities, natural areas, and/or conservation/managed areas within the proposed project boundary. These results are presented in the attached `Documented Occurrences' tables and map. The attached `Potential Occurrences' table summarizes rare species and natural communities that have been documented within a one -mile radius of the property boundary. The proximity of these records suggests that these natural heritage elements may potentially be present in the project area if suitable habitat exists. Tables of natural areas and conservation/managed areas within a one -mile radius of the project area, if any, are also included in this report. If a Federally -listed species is documented within the project area or indicated within a one -mile radius of the project area, the NCNHP recommends contacting the US Fish and Wildlife Service (USFWS) for guidance. Contact information for USFWS offices in North Carolina is found here: https://www.fws.gov/offices/Di rectory/ListOffices.cfm?statecode=37. Please note that natural heritage element data are maintained for the purposes of conservation planning, project review, and scientific research, and are not intended for use as the primary criteria for regulatory decisions. Information provided by the NCNHP database may not be published without prior written notification to the NCNHP, and the NCNHP must be credited as an information source in these publications. Maps of NCNHP data may not be redistributed without permission. Also please note that the NC Natural Heritage Program may follow this letter with additional correspondence if a Dedicated Nature Preserve, Registered Heritage Area, Land and Water Fund easement, or an occurrence of a Federally -listed species is documented near the project area.
