Attached is a letter which fulfills and concludes your requirements to re-initiate formal Section
7 consultation. It essentially agrees with you that there will not be any additional incidental
take of RCWs resulting from the new information regarding borrow pits.
Separate from your Section 7 requirements, I would like to use this opportunity to advocate for
NCDOT to transfer the Jamestown Pender property to the NC Wildlife Resources Commission
for inclusion into the Holly Shelter Game Land. Currently, the RCW cluster PVT 1 is not
being counted towards the recovery goals of the Coastal North Carolina Primary Core
Population, which requires 350 potential breeding groups (PBGs) to be considered recovered.
As of 2020, the number of PBGs currently counted towards the goal is 227 - far short of the
350 needed. If the Jamestown Pender property was transferred to the NCWRC and the RCWs
managed appropriately, then PVT 1 could add an additional PBG to the overall tally towards
the goal.
The transfer of the land has been informally discussed for some time now. I have recently
contacted Brent Wilson, the Coastal EcoRegion Supervisor for game lands. He seemed
receptive to the idea of receiving the property. Although I understand that construction will be
ongoing for some time, I recommend that NCDOT begin internal discussions regarding the
future disposition of the land. Ultimately, adding an additional PBG to the Primary Core
Population would improve the baseline condition of the species and move the species closer to
recovery. Also, inclusion of the property into the game land adds additional buffer from
management activities such as prescribed burning.
