Re: 42 East Development Main Entrance Road and Sections I & J
Stormwater Management Statement and Plan
Dear Mr. Lynch:
We have reviewed the revised Stormwater Management Plans and Calculations submitted for the
proposed 42 East Development Main Entrance Road and Sections I & J. Based upon the
information submitted, the stormwater management plan has been approved with the following
stipulations:
Please. address the following with respect to the Total Nitrogen calculations:
a. The calculations indicate a 25% nitrogen reduction for Bioretention Area/Pond
#5. However, the NC DWQ BMP Manual allows a 35% credit for bioretention
nitrogen reduction. Please revise the nitrogen export calculations as appropriate.
b. Please provide an offset payment in an amount to be determined to the "North
Carolina Ecosystem Enhancement Fund" (formerly known as the Wetland
Restoration Fund) to buy down Nitrogen export. The payment and a copy of the
final stormwater management plan approval letter should be sent to the attention
of Kelly Williams at the following address:

Please address the following comments with respect to the attenuation analysis (Pond #1,
Pond #2, Pond #3, Pond #4, and Pond #5):
a. Please provide pre-development calculations for the 1, 10, 25, and 100 year
storm events, as the design drainage area has been modified from the previously
submitted calculations.
b. Provide a detailed profile sheet with elevations for Pond # 1 and Pond #2.
c. Provide the proposed landscaping plans.
d. Provide label the level spreader at the outlet for Pond #3.
e. Please provide recorded drainage and access easements to and around each pond.
f. Please provide recorded Inspection and Maintenance Agreements for each
device. Draft copies of the Inspection and Maintenance Agreements should be
provided prior to recordation.
Please provide a 5' drainage easement on all interior lot lines as part of the final plat to
address any future cross lot run-off .

4. Please be advised that the proposed storm sewer system located within the future
NCDOT ROW has not been reviewed. It is the responsibility of the design engineer and
the developer to verify that the system has been designed adequately.
5. The 30.56 acres proposed for land dedication must be recorded in a permanent
conservation easement in order to comply with Johnston County's Land Dedication
requirement.
6. Future sections of the development must comply with the fill areas shown in the 20% fill
calculations for the onsite floodplain areas as currently submitted. Any changes to the
areas of fill in the future development will require the overall development readdress the
floodplain fill calculations.
7. Please provide copies of all 401/404 permits required for the proposed development once
received.
8. Please provide a copy of the recorded restrictive covenants (for each section, as
applicable) and a note on each Final Plat limiting the impervious area on each of the 177
lots in Section I to 2,681 square feet and the each of the 106 Lots in Section J to 2,810
square feet.
9. Please provide a copy of the recorded restrictive covenants noting who will be
responsible for maintenance of all drainage facilities located outside of the proposed
NCDOT right of way.
10. Please provide a note on the Final Plat indicating that all lots located within the 100-year
Fooodplain must adhere to the Johnston County Flood Damage Prevention Ordinance.
11. Prior to recordation of the Final Plat, please provide a stormwater certification stating that
all stormwater facilities were constructed in accordance with the approved stormwater
management plan.
12. Please indicate all drainage easements, riparian buffers, jurisdictional wetlands, and flood
hazard areas on the Final Plat.
Please be reminded that a detailed stormwater management plan must be approved for
each subsequent phase of the proposed development, including the proposed commercial
areas site plans. This approval is valid for the Main Entrance Road, Section I, and Section
J only.
A copy of this letter will be forwarded to the Planning Office for their files. If you have any
