This correspondence is in reference to expansion of your Forrest Creek Mitigation Bank,
known as the UT2 addendum. The Forrest Creek UT2 addendum site is located adjacent to the
existing Forrest Creek Mitigation Bank, which is approximately seven miles northeast of
Hillsborough and six miles northeast of Durham in northeastern Orange County, North Carolina.
The purpose of this letter is to confirm the Year 3 release of credits from the UT2 addendum
expansion area as allowed under the 2008 Mitigation Rule, Part 332.8(g)(2), "Streamlined
Review Process ".
Pursuant to the Mitigation Banking Instrument (MBI) entitled, "Forrest Creek Mitigation
Bank ", dated February 2007, and the Mitigation Bank Addendum dated September 1, 2011, ten
percent (10 %) of the Bank's total enhancement credits from the expansion shall be available for
sale after Year 3, upon documentation of meeting success criteria. The Monitoring Year 3 Report
dated September 25, 2013, was received on October 11, 2013, and details a successful third year
for this portion of the bank. This monitoring report triggers an additional ten percent (10 %)
release of credit, or 93.0 credits. Therefore, the total credits released today are 93.0 stream
credits.
By this correspondence, we confirm that you have satisfied the above requirements and
93.0 additional credits are now available for sale from the complete total of 930 Stream
Mitigation Units. This will result in a cumulative total
portion of Forrest Creek Mitigation Bank.
