References: Section 404 Individual Permit signed August 10, 2017 (SAW-2007-1386) for U- 4751 & R-3300 Section 401 Water Quality Certification issued June 5, 2017 (20161268) for U- 4751 & R-3300 DCM Federal Consistency CD17-018 The purpose of this letter is to request modification of the Clean Water Act (CWA) Section 404 Individual Permit (IP) and Section 401 Water Quality Certification for R-3300B to authorize impacts to facilitate construction of temporary diversion channels at three permit site locations shown in the project Erosion Control Culvert Construction Phasing plans. The temporary diversion channels are required to build proposed culverts. The additional impacts summarized below were inadvertently excluded in the impact summary tables provided in the permit drawings during the 2020 permit modification request for R-3300B. Alternatives to avoid and minimize these additional impacts associated with the culvert phasing plans have been considered and are outlined below. Impacts to Jurisdictional Resources Impacts to jurisdictional wetlands and surface waters for R-3300B are summarized below in Tables 1 - 3. Additional impacts compared to the 2020 permit modification request are shown in red. No additional permanent impacts are proposed and there are no changes in utility impacts. Proposed permanent impacts for R-3300B include fill, excavation, and mechanized clearing in wetlands. This includes impacts to 16.743 acres of riparian wetlands and 53.569 acres of non- riparian wetlands. Proposed permanent impacts to streams are 6,170 linear feet. Temporary Impacts: There is 0.758 acre of temporary impacts to riparian wetlands for R-3300B. Proposed temporary impacts to surface waters are 503 linear feet. Hand Clearing: The hand clearing totals due to the project construction are 0.318 acres. Table 2. NCDOT employs many strategies to avoid and minimize impacts to jurisdictional areas in all its designs. Many of these strategies have been incorporated into BMP documents that have been reviewed and approved by the resource agencies and which will be followed throughout construction. All wetland areas not affected by the project will be protected from unnecessary encroachment. Individual avoidance and minimization items are as follows: Permit Site 3 Culvert C08 Î Sta. 19+49 -Y30RPD- Upstream end of temporary diversion channel was moved approximately 10Ó closer to Culvert C08 to minimize additional impacts. Approximately 260Ó of downstream diversion channel was relocated outside of wetlands to avoid additional impacts. Additional Impacts: Temp. Excavation 0.005 acres (currently permitted as HC) Culvert C09 Î Sta. 612+13 -L1- Downstream diversion channel was relocated to minimize additional impacts. Additional Impacts: Temp. Excavation 0.009 acres (currently permitted as HC) Culvert C10 Î Sta. 16+22 -Y30RPA- In an effort to minimize impacts, relocating the diversion channel to the opposite side of the culvert was considered. However, this change would limit contractor access to the site and require excessive temporary channel excavation due to topographic constraints. Due to these factors, it was determined to retain the diversion channel in its original proposed location. Additional Impacts: Temp. Excavation 0.025 acres Hand Clearing 0.020 acres Temp. SW 0.004 acres (14 linear feet) Permit Site 7 Culvert C11 Î Sta. 660+85 -L1- Upstream end of temporary diversion channel was moved approximately 32Ó closer to Culvert C11 to avoid additional impacts. No modifications to downstream end of temporary diversion channel were possible due to proximity of proposed culvert wingwall. Additional Impacts: Temp. Excavation 0.011 acres (0.001 acres in currently permitted HC) Hand Clearing 0.006 acres Permit Site 13 Culvert C13 Î Sta. 712+62 -L1- Upstream end of temporary diversion channel was moved approximately 72Ó closer to Culvert C13, and downstream end of temporary diversion channel was moved approximately 28Ó closer to Culvert C13 to minimize additional impacts. SW 0.004 acres (14 linear feet) Regulatory Approvals Section 404: We are, therefore, requesting the modification of the USACE Individual 404 Permit signed August 10, 2017 (SAW-2007-1386), for the above-described activities. Section 401: We are hereby requesting a modification to the 401 Water Quality Certification from the NCDWQ issued June 5, 2017 (20161268). In compliance with Section 143-215.3D(e) of the NCAC, we will provide $570.00 to act as payment for processing the Section 401 permit modification.
