CHRONIC TOXICITY PASS/FAIL PERMIT LIMIT (QRTRLY)
The effluent discharge shall at no time exhibit chronic toxicity using test procedures outlined in:
1.) The North Carolina Ceriodaphnia chronic effluent bioassay procedure (North Carolina Chronic Bioassay
Procedure - Revised *September 1989) or subsequent versions.
The effluent concentration at which there may be no observable inhibition of reproduction or significant mortality
is _11 % (defined as treatment two in the North Carolina procedure document). The permit holder shall
perform quarterly monitoring using this procedure to establish compliance with the permit condition. The first
test will be performed after thirty days from the effective date of this permit during the months of_
MAR JUN SEP DEC_. Effluent sampling for this testing shall be performed at the NPDES permitted final
effluent discharge below all treatment processes.
All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge
Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B.

Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in
association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity
sample must be measured and reported if chlorine is employed for disinfection of the waste stream.
Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will
begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will
revert to quarterly in the months specified above.
Should any test data from this monitoring requirement or tests performed by the North Carolina Division of
Environmental Management indicate potential impacts to the receiving stream, this permit may be re -opened and
modified to include alternate monitoring requirements or limits.
NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism
survival and appropriate environmental controls, shall constitute an invalid test and will require immediate
retesting(within 30 days of initial monitoring event). Failure to submit suitable test results will constitute
noncompliance with monitoring requirements.

As you requested in your October 6, 1992 letter, I have examined the possibility of a
future flow increase at the Lincolnton WWTP. DEM is presently developing a basinwide
management plan for the Catawba River basin which is due to be completed by April of
1995. Any new permit limits for the existing or modified Lincolnton WWTP will depend
upon results of ongoing water quality studies and the management plan developed for the
South Fork Catawba River. Therefore, I can not provide you will specific estimates of
likely permit limits at this time. However, below I have listed several factors that will
affect DEM's management plan for the South Fork Catawba River.
Water Quality problems have been documented on the South Fork Catawba River. DEM
plans to list the South Fork as an impaired waterbody (i.e., one that does not support its
potential uses) on the State's 303(d) list. This will require DEM to develop a strategy that
manages both point and non -point sources to restore the potential uses of the river.
Parameters of concern for the South Fork include biochemical oxygen demand (BOD),
dissolved oxygen (DO), toxicants, color, sediment, and nutrients. The possible influence
of the Lincolnton WWTP on water quality will be evaluated in light of these issues as part
of the basinwide planning process.
Because of water quality concerns in the South Fork, it is unlikely that total pollutant
loading would be increased with expanded flow. For example, the current permit limit for
BOD5 is 30 mg/l. If the facility were expanded from 6 to 12 MGD a permit limits of 15
mg/1 would result in the same total loading to the receiving waters. This simple analysis
can be used to estimate the minimum level of treatment expected for the expanded facility.

More stringent permit limits may be required if indicated by ongoing studies. In addition,
data collected for the pretreatment program indicate that monitoring and/or limits for
toxicants may be required. Any toxicant limits established for the 6 MGD facility would
be reduced proportionally with additional flow, (as with phenol).
Nutrient and color removal may also required for the Lincolnton WWTP upon
modification. Again, these issues will be addressed as part of the basinwide plan.
In summary, it is likely that the Lincolnton WWTP will be required to meet more
advanced treatment levels, especially upon expansion. As you plan for expansion of the
Lincolnton WWTP, please consider that those facilities that have already implemented
high levels of treatment technology are least likely to be effected by future management
requirements. I commend you for coordinating with us at this early date and encourage
you to continue to work with DEM Water Quality staff as you plan for future wastewater

MGD.
Please provide any information you can regarding the feasibility of permitting this
flow increase and any preliminary limits which might be expected. Also indicate the
likely future limits if the plant remains at 6.0 MGD.

SUBJECT: Reopening permit for the City of Lincolnton
NPDES Permit No. NC0025496
Lincoln County
At the request of Mike Parker and Keith Haynes of the Mooresville Regional
Office, the Technical Support Branch reviewed the last wasteload allocation for
the subject facility. There was some concern about whether effluent monitoring
was needed for metals or other parameters because of the 70% industrial consti-
tuency of Lincolnton's wastewater. (The WLA submitted in 1988 had'indicated that
Lincolnton's wastewater was 65% domestic and only 35% industrial.)
An evaluation of the most recently submitted pretreatment headworks informa-
tion has been completed. This information on these 307(a) priority pollutants
was either not available when Lincolnton's NPDES permit was last renewed or the
POTW's effluent composition has changed substantially since permit issuance.
After review of this data, it has been determined that the NPDES permit should
be reopened, pursuant to Part III Condition E of the subject permit, for the
addition of effluent limits and/or monitoring requirements for the parameters
indicated on the attached approval form. The whole effluent toxicity testing
requirement will remain a condition of the NPDES permit. Existing permit limits
and/or monitoring requirements not detailed in the attached approval form should
remain unchanged.
