This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency dated May 9, 1994, or as subsequently amended. The NPDES Unit staff considered existing guidelines and recently adopted rules related to the Neuse River Nutftent-Sensitive Waters Management Strategy prior to incorporating the following revisions into this permit: 1. The Division has provisionally waived instream monitoring contingent on your membership in the Lower Neuse River Basin Association (LNBA). If you should terminate your membership for any reason, the instream requirements outlined in the permit shall be immediately reinstated. 2. The Division has revised your effluent -monitoring requirements for nitrogen and phosphorous, in accordance with the recently adopted Neuse River Nutrient -Sensitive Waters Management Strategy. 3. Lastly, this permit includes Special Conditions requiring the Permittee to provide a Wastewater Management Plan and subsequent Annual I,1 f Tow and Infiltration (1/1) Upgrade Progress Report. All streams within this basin have been designated nutrient sensitii•e waters (NSW) as a result of environmental problems including algal -blooms in the estuary. The North Carolina Environmental Management Commission recently adopted rules establishing the Neuse River Basin Nutrient -Sensitive Waters Management Strategy to reduce phosphorus and nitrogen inputs. The related point source rule (15A NCAC 2B.0234) intends to reduce, by 30%, total nitrogen (TN) discharges by the year 2003. Because of this, revised nutrient limits have been imposed on dischargers. It is important to note that, beginning with the calendar year 2003, nitrogen removal under this permit will most likely require upgraded biological processes. Effluent nitrogen levels reported in your 1999 DMRs suggest an Annual Mass Loading of 15,220 pounds per year (conservatively assuming nitrogen @ 10 mg/L and flow @ 0.500 MGD). This is roughly 1.8 times your LNBA allocation of 8,447 pounds per year, and will certainly require additional biological treatment to reduce nitrogen. Therefore, the Division encourages you have appropriate system upgrades in place before the year 2003. If any parts, measurement frequencies, or sampling requirements contained in this permit are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina General Statutes, and filed with the office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699- 6714). Unless such a demand is made, this permit shall be final and binding. Please notice that this permit is not transferable except after notifying the Division of Water Quality. The Division of Water Quality may require modification, or revocation and re -issuance of this permit. Annual Mass Loading limit for total nitrogen shall become effective beginning on January 1, 2003 unless it is provisionally waived (See Special Condition A.(3), Annual Limits for Total Nitrogen.) 8. The quarterly average for total phosphorus shall be the average of composite samples collected weekly during the calendar quarter (January -March, April -June, July -September, October -December). 9. Monitoring upstream (U) and downstream (DI and D2) are provisionally waived, based on membership in the Lower Neuse River Basin Association (LNBA). If at any time during the term of this permit, membership in the LNBA is terminated, the Permittee shall notify the Division immediately, and immediately conduct instream monitoring as stipulated in this permit. 10. Variable Frequency — collect instream samples three times per week (3/week) during the months of June through September and once per week (1/week) during the months of October through May. • Effluent shall contain no floating solids or foam visible in other than trace amounts. (2.) TOTAL NITROGEN MONITORING The Permittee shall calculate the annual mass loading of total nitrogen as the sum of monthly loadings, according to the following equations: (a) Monthly Mass Loading (lbs/month) = TN x Q x 8.34 where: TN = the average total nitrogen concentration (mg/L) of the grab samples collected during the month Q = the total wastewater flow discharged during the month (MG/month) 8.34 = conversion factor, from (mg/L x MG) to pounds (b) Annual Mass Loading (lbs/year) = E (Monthly Mass Loadings) for the calendar year The Permittee shall report the total nitrogen concentration for each sample and the monthly mass loading in the appropriate self -monitoring report and the annual mass loading of total nitrogen in the December self -monitoring report for the year. A. (3.) ANNUAL LIMITS FOR TOTAL NITROGEN (a) The Neuse Nutrient Management Strategy rule for point sources (1) provides that annual mass limits for total nitrogen shall be included in the permits for all dischargers with permitted flows (as defined in the Strategy) greater than or equal to 0.5 MGD, and that those nitrogen limits (including the limits in this permit), shall become effective with the calendar year beginning on January 1, 2003. (b) The Neuse rule also provides that members of a group compliance association shall not be subject to individual annual mass limits for total nitrogen. At the time of permit issuance, the Permittee had expressed interest in joining such an association. Accordingly, (I) the total nitrogen limit in Condition A(1) of this permit is deemed waived provided that the following conditions are met: NPDES Permit No. NC0021644 (i) a formal agreement between the association and Environmental Management Commission, as outlined in 15A NCAC 2B. 0234, is established and is in effect; and (ii) the Permittee is a party to said agreement; and (iii) the association and the Permittee substantially conform with the agreement. (2) So long as the total nitrogen limit in Condition A(1) is waived, the group nitrogen allocation established pursuant to the agreement referenced above and any subsequent amendments is hereby incorporated as an enforceable part of this permit. (c) If the Division determines, at any time during the term of this permit, that these conditions are not being met, it shall notify the Permittee in writing of this determination and of its basis. The consequence .of such a determination shall be that the Permittee's annual mass limit for total nitrogen and its effective date shall be reinstated immediately. The Division shall accept and consider written responses received from the Permittee and/or the association within thirty (30) days of the original notice before making a final decision and will provide that decision in writing. (d) The Permittee shall notify the Division in writing within five (5) working days if, at any time during the term of this permit, the Permittee elects not to join the association, or if it withdraws or otherwise loses its membership in the association. Describe deficiencies and operational difficulties in the existing collection system or treatment facility, which affect performance or permit compliance, and identify potential improvements to correct those. At a minimum, evaluate the following considerations: • inflow and infiltration, and • diversion of wasteloads during peak flows. Optimization Plan. Develop a strategy to optimize, rehabilitate, expand and/or replace the collection system to achieve optimum performance. Identify specific measures and key tasks, including those in the above facilities assessment, and provide an estimated schedule for completion of each. DONE Summary and Recommendations Neuse River Basin Public Hearings May 4, 2000 Town of La Grange Waste Water Treatment Plant NC0021644 Facility Description This facility discharges 0.750 MGD of treated, 100%-domestic wastewater into an unnamed tributary of Moseley Creek. The treatment facility consists of two former sludge disposal lagoons, currently used as equalization basins with lift pumps to the oxidation ditch; lift pump to aeration basin; secondary biological treatment (activated sludge) in two parallel, mechanically -aerated oxidation ditches; two parallel secondary clarifiers with scum removal and gravity sludge return; three parallel low -rate sand filters for tertiary treatment; chlorine contact chamber with flow -paced chlorine feed (gas); and post aeration (fixed mechanical aerator). The public hearing focused on flow management and compliance issues. Permit Summary Limits at this facility are 5 mg/L (summertime BODS) and 2 mg/L (summertime NH3). Total phosphorus is limited, as is total residual chlorine. This facility's average influent volume of 0.649 MGD (1998) represents 86% of permitted flow capacity at 0.750 MGD. In the event of storm flow (highest recorded 1.764 MGD), primary waste is diverted into two unlined equalization basins (former sludge -disposal lagoons), then returned to the oxidation ditches for treatment. Oxidation ditches are to be upgraded for better nitrogen removal by adding additional submersible velocity mixers (ATC approved Nov. 10, 1999). Public Comments Neuse River Foundation: • System is operating @ over 86% annual capacity. Past moratorium on sewer connection lifted. • Treatment severely impacted by I/I problems, otherwise well operated. Violations for excessive flow. • Grant monies allocated for I/I and system improvements, but not yet implemented. • State not regularly informed of I/I improvement implementation progress. DWQ Response and Discussion • La Grange WWTP has been severely impacted by I/I problems, i.e., high -inflow during and after storm events requires storage of primary wastes; otherwise plant is well operated. • Various grant monies have been allocated for I/I corrections and system improvements, but not yet implemented. State not regularly informed of I/I improvement implementation progress. • Moratorium lifted in 1998 after grant money allocated; more flow was added to a projected 0.600 MGD (80% capacity). Designs for treatment system upgrade are therefore due. Funding is an issue. • Permit application to land apply sludge was returned to permittee in December 1999. Recommended Action(s) • Permittee should be required to proviFegular progress reports describing I/I improvements. As stated in the draft permit, th/ermittee is to provide a viable Sludge Management Plan to the Division. The following special condition should be included in the final permit: (_.) The Division received the appropriate documentation to renew on August 3, 1998 but placed it on hold pending the Division's nutrient -management strategy for the Neuse River. Influent / Infiltration (I/I) Problems. The Division issued a moratorium (April 22, 1999) on sewer line permits for the Town of La Grange per I SA NCAC 2H. 0223. The Division rescinded this moratorium on August 18, 1999, upon entering into an agreement with La Grange, stipulating that La Grange would, 1) take steps to reduce inflow/infiltration problems; and 2) provide an engineering report detailing these steps when completed. As of this recording, the Division has not received this report. The Division requested La Grange to make consistent progress toward infrastructure improvements and to provide for continued adequate treatment of wastewater noting that La Grange had been awarded grant money to fund proposed wastewater infrastructure improvements. Finally, the letter stated that if steps were not initiated, the Division would reinstate the sewer line moratorium. Correspondence. The Washington Regional Office (WaRO) conducted site visits and prepared Staff Reports (July 14, 1999 and March 24, 2000) noting that the facility was well maintained and operated except for problems with high inflow/infiltration (I/I) and related flow management. During storm periods influent is diverted to unlined lagoons prior to treatment (Kristin Jarmin, April 6, 2000). More recently, the Division's Non -discharge Permitting Unit reported that the facility submitted a permit modification request (Residuals Land Application Permit WQ0010488) in December 1999, but was returned on March 31, 2000 because of inadequate land available to receive solids. Lastly, the in-house laboratory was de -certified for BODS and has been contracting an outside NC -certified lab since July 1999. The Town is orientating a new lab operator and expects to be re -certified by June 2000 (Mike Taylor, Town Manager, April 7, 2000). The WaRO recommended renewing the NPDES permit noting that the Permittee should submit a revised Sludge Management Plan for Division approval. Instream Monitoring and Verification of Existing Conditions. The unnamed tributary of Moseley Creek, located within sub -basin 03-04-05, is classified C-SW-NSW, and is not 303 (d) listed as an impaired stream (as of March 31, 2000). Because this facility is a member of the LNBA, instream monitoring is conducted by others. DMR Data Review. The Division reviewed two years of Discharge Monitoring Reports (DMRs) and Notices of Violation (NOVs). During summer months not encumbered by heavy rainfall, flows average about 0.550 MGD, a flow representing 73% of design capacity. However, yearly average flows for 1999 (0.591 MGD) and 1998 (0.648 MGD) represent plant operation at 79% and 86% of design capacity. Daily influent volumes for these years (although technically not in violation of permit limits) exceeded the monthly flow limit for 95 of the first 150 days in 1998 (118% of Fart Sheet NPDES NC:0021644 Renewal Page design capacity), and 51 of the first 90 days in 1999 (122% of design capacity). Finally, peak daily flows (to a maximum of 1.763 MGD) suggest that rainfall -related events can more than triple (3.4 times) the plant's influent volume. These data clearly illustrate that this facility is overdue for I/I and facility upgrades. PERMITTING STRATIGY Waste Load Allocation (WLA). The Division prepared the last WLA in 1994. Previous and current effluent limits were based on guidelines for a zero -flow stream. As a member of the LNBA instream monitoring is provisionally waived. Ammonia toxicity was not recalculated since the facility already has an ammonia limit of 2.0 mg/L. The permit cover letter will include a request for a revised Sludge Management Plan to include adequate land to apply sludge, or other viable option. It is recommended that the permit be renewed with current parameter limits and those appropriate to the Neuse River Nutrient -Sensitive Waters Management Strategy. Regarding Nitrogen Removal. Reported nitrogen levels in the facility's effluent suggests an Annual Mass Loading of 15,220 pounds per year (conservatively assuming nitrogen @ 10 mg/L and flow @ 0.500 MGD). This is roughly 1.8 times their LNBA allocation of 8,447 pounds per year, and will certainly require a future upgrade for biological treatment to reduce nitrogen. Upgrades will reclassify this facility to Class IV. Appropriate comments have been added to the permit cover letter. SUMMARY OF PROPOSED CHANGES In keeping with Division policies and rules including the recently adopted Neuse River Nutrient -Sensitive Waters Management Strategy, the following changes will be incorporated into the permit: • Total TN and TP monitoring and reporting. • In -stream Monitoring and Reporting have been provisionally waived contingent on regular and continuous LNBA membership • Conductivity monitoring will no longer be required, regardless of LNBA association. If expansion is not proposed or is proposed for a later date, a detailed justification must be made and approved by the Director, which should include past growth records and future growth projections and discuss specific measures to achieve flow reductions. Monitoring data submitted by the Town showed the subject wastewater treatment plant operated at 86.43% of its treatment capacity during 1998. I have reviewed the Town of La Grange's letter of May 17, 1999 requesting to have the sewer line moratorium lifted. The letter stated that the Town has taken preliminary steps to reduce inflow/infiltration problems in its collection system and a engineering report detailing such steps has been completed. I am aware that the Town has been awarded a grant to fund the proposed wastewater infrastructure improvements. In light of these findings and upon the recommendation of our Washington Regional Office staff, I hereby remove the moratorium on the issuance of sewer line permits placed on the Town of La Grange. The Division applauds and encourages your commitment to environmental protection through improvements in your wastewater infrastructure.
