Klimek, P.E., Director Division of Water Quality November 13, 2003 Subject: Modification of NPDES Permit NC0025461 Bakersville WWTP Mitchell County The Division renewed the subject permit on July 25, 2002. Based on the installation of UV disinfection at your facility [completed August 2003], the NC DENR Asheville Regional Office has recommended removal of the limit and monitoring for total residual chlorine. Accordingly, this modification includes the following change: • The Supplement to Permit Cover Page has been updated to show that UV disinfection has been installed. • The limit and monitoring requirements for Total Residual Chlorine now apply only if chlorine is added to the treatment system. Please find enclosed the revised pages, which should be inserted into your permit. The old pages may then be discarded. All other terms and conditions contained in the original permit remain unchanged and in full effect. This permit modification is issued under the requirements of North Carolina General Statutes 143-215.1 and the Memorandum of Agreement between North Carolina and the U.S. Environmental Protection Agency. If any parts, measurement frequencies or sampling requirements contained in this permit modification are unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) clays following receipt of this letter. This request must be a written petition conforming to Chapter 150B of the North Carolina General Statutes, filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding. Continue to operate an existing 0.075 MGD wastewater treatment facility located at the intersection of NC Highway 226 and NCSR 1278 west of Bakersville in Mitchell County, discharging through outfall 001 and consisting of the following wastewater treatment components: • Influent pump station • Bar screen • Flow splitter • Flow equalization basin • Three 0.025 MGD extended aeration package plants, each with clarifier and sludge return, two with sludge holding tanks • Ultraviolet disinfection • Post aeration • Flow measuring 2. After receiving an Authorization to Construct from the Division of Water Quality, construct and operate wastewater treatment facilities with an ultimate capacity of 0.20 MGD. These subsequent facilities shall be permitted to discharge 0.156 MGD initially. Following additional approval from the Division, the facility may discharge up to 0.20 MGD. 3. Discharge from said treatment works into Cane Creek, a Class C- Trout water in the French Broad River Basin, at the location specified on the attached map. Permit NC0025461 A. (1.) EFFLUENT LIMITATIONS AND MONITORING REQUIREMENTS (0.075 MGD) Beginning on the effective date of this permit and lasting until expiration or expansion above 0.075 MGD, the Permittee is authorized to discharge treated wastewater from Outfall 001. FLOW EXPANSION REQUEST Prior to the average annual flow exceeding 0.156 MGD, the facility shall submit to the Division a flow justification to obtain an Authorization to Operate the treatment facilities at the increased flow of 0.20 MGD. The wastewater flows should be determined and justified based on accurate wastewater flow records, agency guidance on flow estimates (15A NCAC 2H .0219), good engineering practices and realistic projections of future projected flow additions. After reviewing their NPDES Permit (issued July 25, 2002) it was found that the permit (copy attached) contained a limit and monitoring requirements for Total Residual Chlorine. On August 2, 2002, an Authorization to Construct (copy attached) was issued to the Town of Bakersville for construction of a UV Disinfection Unit. On August 6, 2003 the new UV unit was placed in operation at the Bakersville WWTP. They are no longer monitoring for Total Residual Chlorine. It is requested that NPDES Permit No. NC0025461 issued to the Town of Bakersville be modified to remove the monitoring requirements for Total Residual Chlorine unless chlorine is used for disinfection.
