Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: * The Boone Village Trail project (Project) is situated on approximately 125.24 acres north of SR 1238 (Spring Hill Church Road) and south of SR 1237 (Griffin Road), within Lillington, Harnett County (the Site). The Site is located within agricultural and rural residential development land uses and is bounded by several residential units to the north; forested areas to the east; a forested area, an agricultural field, and two ponds to the south; and residential units, agricultural fields, and an elementary school (Boone Trail Elementary School) to the west. The Site is largely comprised of agricultural fields and mixed pine -hardwood forests. Approximately 13.66 acres of wetlands (of which 5.33 acres are open waters), and 2,565 linear feet of streams are present within the Site. A delineation was completed by Wetland Solutions, LLC in late 2021. 4b. Explain the purpose of the proposed project: * The purpose of the proposed Project is to construct a single-family residential development in Harnett County with community cohesion and necessary amenities. 4i. Describe the overall project in detail, including indirect impacts and the type of equipment to be used:* The proposed Project is a single-family residential development located north of Spring Hill Church Road and south of Griffin Road in Lillington, Harnett County, North Carolina. The proposed Project will include associated amenities, stormwater control measures, utility improvements, and road construction. The proposed development would be completed in two phases (Phase 1 and Phase 2) that will include the construction of 59 single-family residences in Phase 1 in the northern portion of the Site and 52 single-family residences in Phase 2 in the southern portion of the Site, totaling 111 single-family residences for the Project. Each lot will be served by individual septic systems. The proposed residential streets will be constructed as a two-lane paved road with each lane at 10 feet wide. The residential development will connect to Griffin Road at the northern end and Spring Hill Church Road at the southern end of the development. There are two proposed mail kiosk and associated parking areas at the northern and southern end of the development. There will be several areas dedicated as open spaces that contain wetlands and/or streams in the development. In the northern portion of the Site, there is a proposed road crossing of a stream and adjacent riparian wetland that has been aligned perpendicular to the jurisdictional features to reduce impacts. A 30" and 36" reinforced concrete pipe (RCP) will be installed in the existing stream for a length of 62-ft at the road crossing. A dissipation pad will be installed at the downstream end of the culverts that will be keyed into the stream bottom to provide streambed and bank protection. Impacts to the wetland include placement of road fill material, grading, and the dissipation pad. Temporary impacts that will result from the construction of the road. Sideslopes of the proposed roadway will be graded at 3:1 slopes to ensure safety of the crossing while reducing impacts to jurisdictional features. In addition, there will be a road crossing of a wetland in the southern portion of the Site. The proposed crossing would include placement of road fill material and grading at the upper -most portion of the wetland with sideslopes of 3:1 to reduce impacts to the wetland area . All work will be conducted in accordance with local, state, and federal regulations. Traditional equipment will be used consisting of front-end loaders, bulldozers, paving equipment, graders, and earth movers. SCMs are required and will be used. 5. Jurisdictional Determinations 5a. Comments: Proposed Impacts 1 and 4 are associated with the with construction of road crossings within the proposed subdivision. Impacts 1 and 4 are necessary to construct a road crossing that allows for safe access in and out of the subdivision from the northern and southern portion of the proposed development. Proposed road crossings at these locations have been designed to avoid indirect loss of jurisdictional features upstream of the impact locations. Road crossings designed to occur in the least impactful locations possible under the restraints of road construction requirements. Although an existing earthen path exists south of Impact 1, the road could not be shifted due to limitations on road curvature. Lots have been reduced as much as practicable to avoid impacts while maintaining project viability. Proposed Impact 3 is associated with fill due to the installation of a keyed in rip rap dissipation pad at the outlet of the culverts that will be installed at the northern road crossing. The dissipation pad will be required at the outlet of the culverts to provide protection to the stream channel and adjacent wetland from erosion to further reduce impacts to jurisdictional features while allowing for safe aquatic life passage. A 10' construction buffer is proposed around wetland areas for grading/fill material at Impacts 1 and 4 to account for any unintended impacts incurred from work in these areas; any temporary wetland impacts in these buffer areas will be restored following completion of the work. In total, wetland Impacts 1, 3, and 4 will result in 0.388 ac. of permanent wetland impacts associated with road fill and a riprap dissipation pad, and 0.135 ac. of temporary wetland impacts associated with a 10' construction buffer. 3. Comments: Impact 2 is associated with a road crossing over an unnamed tributary of Walkers Creek and is necessary to provide two points of safe ingress/egress from the northern portion of the proposed development, as well as safe access between the northern and southern portions of the Site. The proposed crossing will consist of one 30" and one 36" RCP placed at 1.62% slopes. Culverts will be countersunk to allow for aquatic life movement and downstream connectivity. Impact 2 will result in 63 I.f. (0.006 ac.) of permanent stream impacts and 23 I.f. (0.002 ac.) of temporary stream impacts. The temporary stream impacts included for Impact 2 are for a temporary construction buffer that will be required to construct the road crossing. Dewatering and a temporary pump around are proposed for use at stream Impact 2 for the crossing installation (Sheet CWI-3.0). Additionally, 8-ft of permanent — no loss impact is proposed for installation of a keyed in rip rap dissipation pad at Impact 3. The dissipation pad is proposed at the downstream end of the culverts to provide streambed and bank protection to further reduce impacts to jurisdictional features while allowing for safe aquatic life passage. The riprap will be keyed into the streambed and therefore will not result in a permanent stream loss. Temporary impacts that may result from the installation for the dissipation pad are included in the temporary construction buffer Impact 2. E. Impact Justification and Mitigation 1. Avoidance and Minimization la. Specifically describe measures taken to avoid or minimize the proposed impacts in designing the project: Impacts to jurisdictional features have been avoided and minimized to the maximum extent practicable by incorporating resourceful site planning, including utilization of the wetland/stream delineation to adjust the layout of the Site design to avoid and minimize impacts, allowing for impacts to be limited to only road crossings necessary for safe access. The remaining impacts proposed are necessary for the Project's goals to be realized. Impacts to jurisdictional features onsite were minimized by utilizing 3:1 slopes at all impact locations and crossing streams and wetlands as close to 90- degrees as possible. The proposed subdivision includes 29.47 acres of open spaces that will avoid directly impacting wetlands and streams in these areas and avoid/minimize indirect water quality impacts that may result from the proposed development. At Impact 3, a dissipation pad at the downstream end of the culverts is being proposed within the stream channel to protect the streambed and bank and adjacent wetland from erosion to further reduce impacts to jurisdictional features while allowing for safe aquatic life passage. The riprap will be keyed into the streambed where possible which will not result in a permanent loss of the stream. No impacts to jurisdictional features are proposed for lot development or utilities. All jurisdictional feature overlap onto residential lots will be noted on the deed as jurisdictional areas requiring permitting for impacts. lb. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques: Proper sedimentation and erosion control methods will be utilized during all phases of construction and installation as described in accordance with the requirements of the North Carolina Department of Environment and Natural Resources: Erosion Control Planning and Design Manual (May 2013) and local codes. All work will take place during dry conditions and can be facilitated from high, non -jurisdictional, stable ground. The contractor shall install silt fence, inlet protection, sediment traps, division ditches, temporary coffer dams, tree protection, and clearing only as necessary to install devices. All erosion and sediment control measures will be checked for stability and operation following every runoff producing rainfall, but in no case less than once every week. Any needed repairs will be made immediately to maintain all measures designed. An erosion control inspections report is required and will be kept by the owner's representative. Temporary seeding and permanent seeding plans are included to restore impacted areas. The Project will meet all relative requirements of Best Management Practices and Engineered Stormwater Control Structures as outlined through State and Local Stormwater Rules. Measures will be taken to prevent oil, tar, trash, debris, and other pollutants from entering adjacent jurisdictional features. Any excess excavated materials not utilized as back fill will be placed and contained within upland areas and permanently stabilized to prevent erosion into adjacent jurisdictional features. Therefore, stockpiling of excavated material within jurisdictional waters of the U.S. will be strictly prohibited as part of the construction of this Project. All project construction activities initiated within jurisdictional waters of the U.S. will be carried to completion in an expeditious manner to minimize the period of disturbance within jurisdictional waters. 2. The proposed Boone Trail Village project is a single and complete project with appropriate land use control measures in place for specific areas which require them. What data sources did you use to determine whether your site would impact Endangered Species or Designated Critical Habitat? A search of the USFWS IPaC database on June 27, 2022, revealed four federally protected species as potentially occurring within the project area, including the red -cockaded woodpecker (RCW), American alligator, Cape Fear shiner, and rough -leaved loosestrife. The monarch butterfly is also listed for the project area; however, it is a candidate species and not yet listed or proposed for listing. Consultation with U.S. Fish and Wildlife Service under section 7 of the Endangered Species Act is not required for the monarch butterfly. The North Carolina Natural Heritage Program (NC NHP) Database Report did not identify occurrences of the RCW, American alligator, Cape Fear shiner, monarch butterfly, rough -leaved loosestrife, bald eagle nests, or critical habitats within the project limits or a 1-mile radius. The red -cockaded woodpecker requires mature pine forested, preferably longleaf stands, that are typically greater than 30 years old that are 10 to 60 acres in size. Territory size for clusters of RCW groups ranges from 125 to 200 acres in size. The project area largely consists of maintained agricultural fields with mixed pine -hardwood forests at the northern and southern portions of the Site that are comprised of mostly wetlands. Further, the project area is bordered by agricultural fields and residential and commercial developments with little forested area along the eastern boundary. Therefore, suitable nesting and foraging area was not observed within or in the vicinity of the project area. The NC NHP report did not list any occurrences of the RCW within the project area or a 1-mile radius. Utilizing the SLOPES guidelines, the project is not located within the RCW consultation area. Therefore, the proposed project will have "no effect" on the red cockaded woodpecker. The American alligator prefers slow -moving freshwater rivers, swamps, marshes, and lakes, and can inhabit both freshwater and brackish water systems. The project area contains two freshwater manmade ponds, one located in the northern portion of the project area and one in the southern portion of the project area. While the project site contains potentially suitable habitat for the American alligator, no impacts will occur to the existing freshwater ponds or in wetland areas immediately adjacent to the ponds. The NC NHP report did not list any occurrences of the American alligator within the project area or a 1-mile radius. Therefore, it is the opinion of Timmons Group that the proposed project will have "no effect" on the American alligator. The Cape Fear Shiner is most often found in pools and runs with clean gravel, cobble, and boulder substrates adjacent to riffles in wide, shallow segments of gravelly rivers with forested banks and abundant water willow (Justicia), riverweed (Podostemum), stream mosses (Fontinalis), and filamentous green algae. In winter months, the species may migrate into smaller tributary streams. The NC NHP report did not list any occurrences of the Cape Fear shiner within the project area or a 1-mile radius. Further, the earthen dam associated with the downstream manmade pond would impede the species from traveling to anticipated impact locations. Therefore, it is the opinion of Timmons Group that the proposed project will have "no effect" on the Cape Fear shiner. The monarch butterfly prefers areas with milkweed for breeding habitat and requires other Flowering plants for foraging habitats. Suitable foraging and breeding habitat for the monarch butterfly is potentially present within onsite within areas that contain early successional vegetation and within open green space that is not regularly maintained within the vicinity of the project area. However, the species was not observed during site investigations. Further, the monarch butterfly's habitat is ubiquitous throughout the State and any disturbance to potentially suitable habitat would not be detrimental to potentially displaced individuals. Therefore, it is the opinion of Timmons Group that the proposed project will have "no effect" on the monarch butterfly. Rough -leaved loosestrife is dense shrub that can exhibit vine -like growth and occurs on ecotones between longleaf pine uplands and pond pine pocosins with open areas. The species can typically be found on wet, peaty, poorly drained soils in fire -maintained areas or areas with regular anthropogenic maintenance. The Site consists of regularly maintained agriculture fields, open water farm ponds, upland mixed pine -hardwood forests, palustrine forested wetlands, and palustrine emergent wetlands adjacent to northern farm pond. The farm ponds, maintained agriculture fields, and forested areas would not provide potential suitable habitat for the species. The palustrine emergent wetlands surrounding the northern farm pond may be considered potential suitable habitat; however, this area will not be impacted by the Project. Further, the NC NHP report does not document any sightings within the project area or a 1-mile radius. Therefore, it is the opinion of Timmons Group that the proposed project will have "no effect" on rough - leaved loosestrife. 6. Essential Fish Habitat (Corps Requirement) 6a. How do I know if a bird is breeding, wintering, migrating or present year-round in my project area? To see what part of a particular bird's range your project area falls within (i.e. breeding, wintering, migrating or year-round), you may refer to the following resources: The Cornell Lab of Ornithology All About Birds Bird Guide, or (if you are unsuccessful in locating the bird of interest there), the Cornell Lab of Ornithology Neotropical Birds guide. If a bird on your migratory bird species list has a breeding season associated with it, if that bird does occur in your project area, there may be nests present at some point within the timeframe specified. If "Breeds elsewhere" is indicated, then the bird likely does not breed in your project area. What are the levels of concern for migratory birds? Migratory birds delivered through IPaC fall into the following distinct categories of concern: 1. "BCC Rangewide" birds are Birds of Conservation Concern (BCC) that are of concern throughout their range anywhere within the USA (including Hawaii, the Pacific Islands, Puerto Rico, and the Virgin Islands); 2. "BCC - BCR" birds are BCCs that are of concern only in particular Bird Conservation Regions (BCRs) in the continental USA; and 3. "Non -BCC - Vulnerable" birds are not BCC species in your project area, but appear on your list either because of the Eagle Act requirements (for eagles) or (for non -eagles) potential susceptibilities in offshore areas from certain types of development or activities (e.g. offshore energy development or longline fishing). Although it is important to try to avoid and minimize impacts to all birds, efforts should be made, in particular, to avoid and minimize impacts to the birds on this list, especially eagles and BCC species of rangewide concern. Details about birds that are potentially affected by offshore projects For additional details about the relative occurrence and abundance of both individual bird species and groups of bird species within your project area off the Atlantic Coast, please visit the Northeast Ocean Data Portal. If your project has the potential to disturb or kill eagles, you may need to obtain a permit to avoid violating the Eagle Act should such impacts occur. Proper Interpretation and Use of Your Migratory Bird Report The migratory bird list generated is not a list of all birds in your project area, only a subset of birds of priority concern. To learn more about how your list is generated, and see options for identifying what other birds may be in your project area, please see the FAQ "What does IPaC use to generate the migratory birds potentially occurring in my specified location". Please be aware this report provides the "probability of presence" of birds within the 10 km grid cell(s) that overlap your project; not your exact project footprint. On the graphs provided, please also look carefully at the survey effort (indicated by the black vertical bar) and for the existence of the "no data" indicator (a red horizontal bar). A high survey effort is the key component. If the survey effort is high, then the probability of presence score can be viewed as more dependable. In contrast, a low survey effort bar or no data bar means a lack of data and, therefore, a lack of certainty about presence of the species. This list is not perfect; it is simply a starting point for identifying what birds of concern have the potential to be in your project area, when they might be there, and if they might be breeding (which means nests might be present). The list helps you know what to look for to confirm presence, and helps guide you in knowing when to implement conservation measures to avoid or minimize potential impacts from your project activities, should presence be confirmed.
