I'm guessing that there is no way to avoid the impact. Since it triggers written authorization, it will be an Individual Certification and will require a 30 day pre - filing notice and a 30 day public notice. Your email today can be considered the pre -filing notice to start that clock. Just attach you email and today's date to the application when you submit it through the ePCN portal. Make sure that you wait 30 days from today before submitting. It will then go on public notice for 30 days before I can issue. $240 is the fee. I hate that there will be such a delay for such a small impact, but DWR has to comply with the Federal rule. If I have a project in Pinehurst that is applying for a NWP29 for around 0.018ac of wetland impact for the access drive, but, it is in an HQW area I need to copy/submit that application to your office as well if I am not mistaken?
