PROJECT SUMMARY: The applicant proposes to add a 146' site, to the 13 permitted Oyster Sanctuaries authorized by Major CAMA Permit,No. 140 -09, in the Pamlico Sound, off Old House Channel,in,Dare County. Daniel III, Director Dare County Major Modiflicati1on off, LAMA Major Permit; No., 140-09 Project setting The North Carolina Division of Marine Fisheries (NC DMF) Oyster Sanctuary Program has 13 existing, Sanctuaries in the Pamlico Sound complex authorized, under Major CAMA Permit No. 140-09 originally issued 3 November 2009 and modified by Major Modification on 23 November 2011 as well as 30 November 2012. The permit has also be modified through 5 letters of-refinement issued on 11 August 2011, 10 April 2012, 14 December 2012, 14 June 2013, and 24 February 2014. The Sanctuaries are generally constructed with Class 'B granite riprap or crushed concrete `in 45 -60' circular mounds, on 75' centers,in a grid pattern or with,precast concrete reef'structuresin clusters. Water depth at the sites is 8' or,greater, and the majority of the - mounds maintain 6' of water depth over the,riprap for navigation. The 13 existing Sanctuaries range in tsize from 4:6 to 58.2 acres. All 13 existing Sanctuaries are located in waters classified SA -HQW by the Environmental Management Commission. Deep, Bay (#4) and Middle Bay ( #7) are both designated as Secondary Nursery Areas,, by the NC Division of Marine Fisheries. The areas surrounding the Sanctuaries are open to shellfishing. The proposed site is also classified SA -HQW and is open to shellfishing. Project description The NC DMF proposes to create anew Sanctuary in Dare County, located 3.5,miles SSE.of Old House, Channel in the Pamlico Sound off Pea Island National Wildlife Refuge, in an,area with an average water depth of 14' (NHW). The site will be divided into 36 —150' by 150' grids. The grids will be surrounded by a 100' wide buffer. NC DMF- proposes to place material, within 24 of the proposed 36 grids leaving 12 grids available for future development. The boundaries of the proposed Sanctuary will be 1,175' by 1,175'(31.7 aces) as depicted,in Figures 2 and 3. NC DMF proposes to place material on site as described below; a) Sic grids will contain a cluster of 60 pre - fabricated concrete Ultra Ball reef structures. The maximum height of the structures will be 4.3' and the maximum width 5'. Each-cluster will consist of a.55' diameter area with the 60�reef structures,,placed,vAthin concentric circles. A total of 360 units will be deployed at this site with a physical footprint, of 0.7851 acres (34,199ft2) or 0.025% of `the proposed reef area. Figures 3, 5 and 8 depict the location and material description of the concrete reef structures., b) Twelve grids will contain recycled (crushed) concrete, 4" to 12" diameter material, within a 30' diameter area. A total of 150 tons of recycled concrete will be placed in each rnound,fora total of 1,800 tons. Thebeight-of 'the recycledconcrete,mounds will average T. This will result,in a physical footprint of 0.7785 acres (33,911.5 -ft2) or 0.025% of the proposed reef area. Figures 3, 6 and 9 depict the location and material description of the recycled concrete mounds: c) Six grids will contain reinforced concrete pipe and boxes of assorted sizes w ithin'a 25' diameterarea. A,total of 150 tons of concrete pipe and boxes will be placed in,each mound for a total of 900 tons. The height of the concrete pipe and boxes will be 7'. This will-result in a physical footprint of 0:30 acres (13,068 ft2) or 0.01 % of this area. The total impact for'this proposed sanctuary will be a physical footprint of 1.86 acres (81,178:5 ft2) or0:06% of ,the 34.7 acre site. The comers of the new site will be marked with 3 -pile dolphin,clusters including signage as shown on Figure 4. The existing Sanctuaries have a structural footprint of 189.3 acres and encompass 262.8 acres of open water. The boundaries of the Sanctuaries with the inclusion of'the proposed Pea Island site,will have a total structural footprint of 1,91.2 acres and encompass 294.5, acres of open water. Anticipated impacts The project as-proposed will result in the filling ±81,178.5 ft2 (1.86 acres) of Sound bottom associated with the,oyster- reef construction. The project as proposed wiff result in localized turbidity 'as,a result of the oyster reef installation. If successful, the,project should'result in addRional shellfish and habitat in the Pamlico Sound complex. David W. Dear Mr. Moye, John E. Skvarla, III Secretary As requested by your division jointly with the U.S. Army Corps of Engineers please find attached a CAMA Major Permit application for the establishment of a new sanctuary by the North Carolina Division of Marine Fisheries (DMF) Oyster Sanctuary Program. The Oyster Sanctuary Program was formed from recommendations by the 1995 Blue Ribbon Advisory Council on Oysters (BRACO) to rehabilitate the oyster population in North Carolina. The purpose of this program is to provide suitable substrate for oyster recruitment, survival, and growth which will be protected from the harvest of shellfish. Sites are selected by biologists on the basis of salinity, bottom type, tidal flow, exposure to wave action, historical oyster data, prevailing winds, location of natural oyster rocks, and input from the public. The proposed construction material for this oyster sanctuary includes precast concrete structures; recycled precast concrete products (pipe and utility vaults); and processed recycled concrete (4 " -12 ") containing no metal, asphalt, or other hazardous materials (asbestos, lead, etc.); however this list is not exhaustive. Material will be deployed in a water depth of 13 feet at MLW (mean low water) onto unconsolidated soft bottom substrate, using barges and heavy equipment (cranes, excavators, loaders). Sites are selected to reduce the impacts to North Carolina public trust resources such as natural oyster rocks and sea grass beds. Currently, DMF maintains 13 permitted oyster sanctuaries, which successfully serve as oyster broodstock reserves, providing larval subsidies to Pamlico Sound. These measures have proven effective'in supporting high oyster population density and broodstock, while encouraging, resistance to diseases and hosting a variety' of other services Pea Island Oyster Sanctuary is proposed to be approximately 32 acres in size and consists of 36 grids (150'x150'). 24 (12.4 acres) will be developed in this project with a total material impact foot print of 1.86 acres, leaving 12 grids empty, with void areas incorporated into the layout for material separation, and a 100' buffer around the entire site. Development of this project is estimated to take approximately one year The grids may contain one of three types of suitable oyster substrate material; 6 grids will be filled with 60 Ultra Balls each, 6 grids with assorted sizes of recycled concrete precast products (pipe and utility boxes), and 12 grids with processed, recycled concrete (4 " -12 "). Material will be. deployed, per DMF protocol, for.a water depth of 13 feet MLW to a maximum of 7 feet of relief'with a navigational clearance of a minimum of six feet. The proposed design for the site will be forwarded to the US ,Coast Guard for review of the requested navigational clearance. The site selection criteria for this new coastal reef included information on historic abundance of oyster habitat and resources in the area based on an 1889 survey by Lt. Francis Winslow, USN. The survey identified extensive oyster reef habitat ins Pamlico Sound The complex habitat created by the natural oyster reefs provided protection for many invertebrates and forage species that were important for healthy finfish stocks. The loss of function of these natural reefs due to the impacts of harvest and sedimentation can be mitigated in part by the construction of oyster sanctuaries: Additional criteria for site selection were as follows: 1 Hydrological studies (oyster larval transport research for the area) 2 Environmental suitability 3 Substrate suitability 4. North Carolina Coastal Federation Northern Working Group recommendations 5. Demonstrated success of the Crab Hole and Gibbs Shoal oyster sanctuaries for oyster recruitment, survival, and finfish utilization 6. Public input 7. Potential conflicts with other users (commercial and recreational fishing, navigation, etc ) The,building of this oyster reef /sanctuary is justified by Recommendation 3.1 in the NC Coastal Habitat Protection Plan as well as Amendment 1 in the Oyster Fisheries 'Management'Plan. Of these, the latter recommends that managers "greatly expand habitat restoration, including creation of subtidal oyster reef no -take sanctuaries." To date, DMF has created 12 oyster sanctuaries, ranging in size from 5.7 — 58.2 acres, to constitute a total footprint of 228.5 acres. Of the 228.5 acres of permitted sanctuary area, only 15.3 acres of suitable habitat remain undeveloped. Sanctuaries are continually maintained and monitored at yearly intervals. Maintenance consists of replacement and /or CAMA Major Permit for NCDMF Oyster Sanctuaries Page 3 of 3- repair of 'buoys or piles marking the corners of the sanctuaries. in accordance with USCG Aton Rules and Regulations.
