Division personnel have reviewed and approved your application for renewal of the subject permit. Accordingly,
we are forwarding the attached NPDES discharge permit. This permit is issued pursuant to the requirements of
North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the
U.S. Environmental Protection Agency dated October 15, 2007 (or as subsequently amended).
This final permit includes the following changes from the draft permit sent to you on February 11, 2015:
• The duckweed system is inactive and was removed from permit. Statement was added (page 2 #2)
that greenhouse was constructed on property and permit modification would be needed in future if
activated.
• Instream Monitoring frequency changed from 3/week to 1/week.
If any parts, measurement frequencies or sampling requirements contained in this permit are unacceptable to you,
you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this
letter. This request must be in the form of a written petition, conforming to Chapter 150B of the North Carolina
General Statutes, and filed with the Office of Administrative Hearings (6714 Mail Service Center, Raleigh, North
Carolina 27699-6714). Unless such demand is made, this decision shall be final and binding.
Please note that this permit is not transferable except after notice to the Division. The Division may require
modification or revocation and reissuance of the permit. This permit does not affect the legal requirements to
obtain any other Federal, State, or Local governmental permit that may be required. If you have any questions

This permit shall become effective June 1, 2015.
This permit and authorization to discharge shall expire at midnight on May 31, 2018.

SUPPLEMENT TO PERMIT COVER SHEET
All previous NPDES Permits issued to this facility, whether for operation or discharge are hereby
revoked. As of this permit issuance, any previously issued permit bearing this number is no longer
effective. Therefore, the exclusive authority to operate and discharge from this facility arises under the
permit conditions, requirements, terms, and provisions included herein.
The Town of Hookerton is hereby authorized to:
1. continue to operate an existing 0.060 MGD wastewater treatment plant consisting of:
• influent bar screen
• three cell lagoon with adjustable effluent baffles and a small
surface aerator in the third cell
The facility is located on Highway 123, North of Hookerton, Greene County and,
2. The greenhouse is constructed on the property, but is inactive. If needed to be active in the
future, then a permit modification would be needed and,
3. discharge from said treatment works through Outfall 001 at a specified location (see attached
map), into Contentnea Creek, a Class C-Swamp NSW waterbody within the Neuse River
Basin.

reported using North Carolina -certified field and lab test methods, even if these values fall below 50 µg/L.
5 For a given wastewater sample, TN = TKN + NO3-N + NO2-N, where TN is total nitrogen, TKN is total Kjeldahl
Nitrogen, and NO3-N and NO2-N are nitrate and nitrite nitrogen, respectively.
6 TN load is the mass quantity of total nitrogen discharged in a given time period. See condition A. (4) of this permit.
The Permittee shall discharge no floating solids or foam visible in other than trace amounts.

A. (3) CALCULATION OF TOTAL NITROGEN LOAD
[G.S. 143-215.1(b)]
a. The Permittee shall calculate monthly and annual TN Loads as follows:
i. Monthly TN Load (lb/mo) = TN x TMF x 8.34
where:
TN = the average Total Nitrogen concentration (mg/L) of the
composite samples collected during the month
TMF = the Total Monthly Flow of wastewater discharged during the
month (MG/mo)
8.34 = conversion factor, from (mg/L x MG) to pounds
ii. Annual TN Load (lb/yr) = Sum of the 12 Monthly TN Loads for the calendar year
b. The Permittee shall report monthly Total Nitrogen results (mg/L and lb/mo) in the discharge
monitoring report for that month and shall report each year's annual results (lb/yr) in the December
report for that year.
A.(4.) ANNUAL LIMITS FOR TOTAL NITROGEN
[G.S. 143-215.1(b)]
a. Total Nitrogen (TN) allocations and TN Load limits for NPDES dischargers in the Neuse River basin apply
on a calendar year basis.

b. For any given calendar year, the Permittee shall be in compliance with the annual TN Load limit in this
Permit if:
(i.) the Permittee's annual TN discharge is less than or equal to its TN Load limit, or
(ii.) the Permittee is a co-permittee member of a compliance association.
c. The TN Load limit in this Permit (if any) may be modified as the result of allowable changes in the
Permittee's TN allocation.
i. Allowable changes include those resulting from purchase of TN allocation from the Wetlands
Restoration Fund; purchase, sale, trade, or lease of allocation between the Permittee and other
dischargers; regionalization; and other transactions approved by the Division.
ii. The Permittee may request a modification of the TN Load limit in this Permit to reflect allowable
changes in its TN allocation. Upon receipt of timely and proper application, the Division will modify
the permit as appropriate and in accordance with state and federal program requirements.
iii. Changes in TN limits become effective on January 1 of the year following permit modification. The
Division must receive application no later than. August 31 for changes proposed for the following
calendar year.
iv. Application shall be sent to:

d. If the Permittee is a member and co-permittee of an approved compliance association, its TN discharge
during that year is governed by that association's group NPDES permit and the TN limits therein.
i. The Permittee shall be considered a Co-Permittee Member for any given calendar year in which it is
identified as such in Appendix A of the association's group NPDES permit.
ii. Association roster(s) and members' TN allocations will be updated annually and in accordance with
state and federal program requirements.
iii. If the Permittee intends to join or leave a compliance association, the Division must be notified of the
proposed action in accordance with the procedures defined in the association's NPDES permit.
(A) Upon receipt of timely and proper notification, the Division will modify the permit as appropriate
and in accordance with state and federal program requirements.
(B) Membership changes in a compliance association become effective on January 1 of the year
following modification of the association's permit.
e. The TN monitoring and reporting requirements in this Permit remain in effect until expiration of this Permit
and are not affected by the Permittee's membership in a compliance association.

a. The following table lists the Total Nitrogen (TN) allocation(s) assigned to, acquired by, or transferred to the
Permittee in accordance with the Neuse River nutrient management rule (T15A NCAC 02B .0234) and the
status of each as of permit issuance. For compliance purposes, this table does not supercede any TN limit(s)
established elsewhere in this permit or in the NPDES permit of a compliance association of which the
Permittee is a Co-Permittee Member.

Any addition, deletion, or modification of the listed allocation(s) (other than to correct typographical errors) or
any change to Active status of any of the listed allocations shall be considered a major modification of
this permit and shall be subject to the public review process afforded such modifications under state and
federal rules.
A. (6) ELECTRONIC REPORTING OF DISCHARGE MONITORING REPORTS
[G.S. 143-215.1(b)]
Proposed federal regulations require electronic submittal of all discharge monitoring reports (DMRs)
and specify that, if a state does not establish a system to receive such submittals, then permittees must
submit DMRs electronically to the Environmental Protection Agency (EPA). The Division anticipates
that these regulations will be adopted and is beginning implementation.

Beginning no later than 270 days from the effective date of this permit, the permittee shall begin
reporting discharge monitoring data electronically using the NC DWR's Electronic Discharge
Monitoring Report (eDMR) interne application.

Monitoring results obtained during the previous month(s) shall be summarized for each month and
submitted electronically using eDMR. The eDMR system allows permitted facilities to enter monitoring
data and submit DMRs electronically using the internet. Until such time that the state's eDMR
application is compliant with EPA's Cross -Media Electronic Reporting Regulation (CROMERR),
permittees will be required to submit all discharge monitoring data to the state electronically using
eDMR and will be required to complete the eDMR submission by printing, signing, and submitting one
signed original and a copy of the computer -printed eDMR to the following address:

If a permittee is unable to use the eDMR system due to a demonstrated hardship or due to the facility
being physically located in an area where less than 10 percent of the households have broadband access,
then a temporary waiver from the NPDES electronic reporting requirements may be granted and
discharge monitoring data may be submitted on paper DMR forms (MR 1, 1.1, 2, 3) or alternative forms
approved by the Director. Duplicate signed copies shall be submitted to the mailing address above.
Requests for temporary waivers from the NPDES electronic reporting requirements must be submitted
in writing to the Division for written approval at least sixty (60) days prior to the date the facility would
be required under this permit to begin using eDMR. Temporary waivers shall be valid for twelve (12)
months and shall thereupon expire. At such time, DMRs shall be submitted electronically to the
Division unless the permittee re -applies for and is granted a new temporary waiver by the Division.

Regardless of the submission method, the first DMR is due on the last day of the month following the
issuance of the permit or in the case of a new facility, on the last day of the month following the
commencement of discharge.
2. Signatory Requirements [Supplements Section B. (11.) (b) and supersedes Section B. (11.)
All eDMRs submitted to the permit issuing authority shall be signed by a person described in Part II,
Section B. (11.)(a) or by a duly authorized representative of that person as described in Part II, Section
B. (11.)(b). A.person, and not a position, must be delegated signatory authority for eDMR reporting
purposes.
For eDMR submissions, the person signing and submitting the DMR must obtain an eDMR user account
and login credentials to access the eDMR system. For more information on North Carolina's eDMR

Certification. Any person submitting an electronic DMR using the state's eDMR system shall make the
following certification [40 CFR 122.22]. NO OTHER STATEMENTS OF CERTIFICATION WILL
BE ACCEPTED:
"I certify, under penalty of law, that this document and all attachments were prepared under my
direction or supervision in accordance with a system designed to assure that qualified personnel properly
gather and evaluate the information submitted. Based on my inquiry of the person or persons who
manage the system, or those persons directly responsible for gathering the information, the information
submitted is, to the best of my knowledge and belief, true, accurate, and complete. I am aware that there
are significant penalties for submitting false information, including the possibility of fines and
imprisonment for knowing violations."
3. Records Retention [Supplements Section D. (6.)1
The permittee shall retain records of all Discharge Monitoring Reports, including eDMR submissions.
These records or copies shall be maintained for a period of at least 3 years from the date of the report.
This period may be extended by request of the Director at any time [40 CFR 122.41].

The Town of Hookerton received a draft NPDES permit dated February 11, 2015 for review and
comment. The Town would like to request the following changes to the permit:
A. The old permit contained nage A.2 Effluent Limitations and Monitoring Requirements
that contained limits and monitoring that would be effective upon the completion of a
Duckweed Treatment System. As was stated in the permit renewal application, this
system was constructed but failed prior to being operational. The duckweed system will
not ever be used and we request that section A.2 Effluent Limitations and Monitoring
Requirements of the draft permit be removed.
B. Section A.5 Annual Limits for Total Nitrogen and section A.6 Total Nitrogen Allocations
were added to the permit. These two sections imply that a permit limit for Total Nitrogen
is established. Part A. of section A.5 states that TN limits and allocation apply on a
calendar year basis and part B states that the Permittee is in compliance if the annual

Monitoring Requirements only includes the requirement for monitoring and reporting of
TN, we think that sections A. 5 & 6 can be interpreted as setting the annual discharge
limit for TN at 1,213 pounts. It is our understanding of the Neuse River Nutrient
Management rules that facilities with permitted flows of <0.5 mgd are not subject to TN
limits. We request that these sections be removed from the permit, as in earlier permits,
or that the language be modified to make clear that the TN allocation assigned is not in
fact an enforceable limit.

I enjoyed speaking with you about some of the options you and Dwight are exploring for Hookerton's treatment plant.
We've certainly had an interesting history with this plant and still hope the Town can find a workable solution to its
wastewater challenges.
Jeff Poupart asked me to get involved when the question of nutrient limits arose. I called Robert Tankard of the
Washington Regional Office this morning to catch up on issues at the plant; he and I worked together when the Town
proposed the duckweed system. The take -away from our call was that:
• We agree that modifying processes within the existing plant, at the current 0.060 MGD capacity, would not trigger
nutrient limits in the Town's NPDES permit.
• The possibility of nutrient limits *has* been raised, but Robert recalls that it came up in discussing the option of
relocating the plant entirely; because the new facility would be considered a 'new discharge' under the Neuse
nutrient rules, it would be subject to nutrient limits.
So nutrient limits will not be a factor in your evaluation of treatment improvements, within the range of options you
described. However, as we discussed, the Town would be well served if the selected option could accommodate future
nutrient removal, in case limits for small dischargers are adopted further down the road.

Hello all,
The Town of Hookerton in Greene County constructed a single lagoon back in the 1960's to serve its wastewater
treatment needs. A couple of other lagoons were added in the 1980s to provide increased levels of treatment. At the
I.
time of construction of the original lagoon, Contentnea Creek was well away from the lagoon. However, over time a
nearby oxbow has continued to advance and is now at the bank of the lagoon wall. The creek bank has actually
undermined its way underneath the perimeter fence installed at the foot of the bank wall. During storm events, the
velocity of the creek significantly increases and erosion quickens. At this point, it's likely not a matter of if, but when the
creek and lagoon will merge to become one, resulting in a significant spill of wastewater and/or sludge unless something
is done. The next big storm that produces prolonged high flows in the creek could potentially cause a breach.
Our office recently met with the Town of Hookerton, its consultant, and the US ACE to discuss options for the
WWTP. The consultant's focus was on stabilizing and hardening the creek bank at an estimated expense ranging from
' $600,000 to well over $1 million. Hookerton is still paying off a loan from another upgrade in the 1990s that never
worked and realistically doesn't have the funds to address the creek issue.
Other potential solutions may include connecting Hookerton to a nearby town, building a new WWTP somewhere else,
or taking the problem lagoon off-line and operating off of the remaining two lagoons (as a short term option). However,
there's no assurance that permit limits would be met operating off of just two lagoons.
At this point, there's no clear solution that can be practically funded with a fix performed in a short period of time. Our
office has conveyed to Hookerton that it would be prudent to start looking into the ability to operate the system utilizing
only the two other lagoons in the event the original lagoon truly needs to come off-line due to imminent hazards. Such
position was couched with the typical "use your best professional judgment" angle. If the first lagoon is by-passed, the
thought is to begin bleeding water from the original lagoon through the remaining two. Then there's 50 years worth of
sludge still remaining to deal with, which would cost several hundreds of thousands of dollars to dispose of.
In the mean time, Hookerton looks like a good case for an SOC. Would the Central Office have concern over allowing the
primary lagoon to be bypassed (which may result in the inability to meet permit limits on a continuous basis until the
most appropriate permanent solution is found) and covering such through allowances within an SOC? If not, we'll work
with Hookerton to start going down that path.
From talking with the Corps, they may be able to share in the cost of creek bank stabilization efforts, as long as the
lagoon is operational. However, if the lagoon is taken out of operation, it sounded like the Corps likelihood of being a
joint participant in the project would be minimal. So Hookerton will likely factor that into its decision making
process. Also, from talking with Water Infrastructure staff, we understand that there are limited "emergency funds" for
severe wastewater project needs, but that process hasn't been hashed out yet.
We'll also work with DEMLR / Land Quality to better assess current hazards/risks.
If the Central Office could let us know your thoughts on the SOC option, it would be appreciated. Likewise, if anyone
has any suggestions on how to address the situation as a whole (taking the economic feasibility of options into
consideration), feedback is welcome.

Greg Churchill of River & Associates called this morning to ask about the likelihood of Hookerton getting TN or TP limits
in the foreseeable future.
The Town's WWTP is located adjacent to and above a meandering section of Contentnea Creek. The creek has now
eroded to within a few feet of Lagoon #1 (of 3), and there is a growing threat of the lagoon breaching and spilling into
the creek. This could occur within a year or two, sooner if severe rains occur. There is currently approx. 2 ft. of vertical
separation between the toe of the lagoon and the water's edge. Since 1924, the creek has moved in the direction of the
lagoon at an average of 4 ft/yr.
Rivers & Associates has been brought in to find a fix for this problem. Mr. Churchill is looking at alternative measures
(e.g., reinforce the stream bank, take the lagoon offline and switch to a two -lagoon system, close all lagoons and
connect to another utility, etc.) as well as any factors that could affect their course of action (hence, the question about
coming limits). We talked about the lagoons' current performance and the probable performance of a two -cell
configuration (should be adequate, but it's hard to say precisely with lagoons).
Then turned to the nutrients questions. If nutrient limits are likely, that would be an argument for Hookerton to close
this plant, build a pump station and force main to another utility, and 'get out of the wastewater treatment business.'
I told him that Hookerton reported TN loads well below their allocation in 2011 and 2012 (they have no limits for TN or
TP) and so are far down the list of small dischargers whose TN loads concern the Division. I have no reason to believe
they will get TN (or TP) limits in the foreseeable future (at least the next 2-3 permit cycles), so long as they maintain
their current loadings. Still, no guarantees.
Other notes:
— Mr. Churchill plans to speak with the USCOE to see what assistance and resources they can offer.
— The duckweed system is abandoned, but some components may still be salvageable if needed.
— Town has some I/1 issues, but a bigger issue is direct precipitation on the lagoons; thus, a two -cell system might have
some advantage.

The wastewater treatment plant consists of a three -cell lagoon treatment system. The existing
permit contains permit limitations and monitoring for the lagoon system and another set of
permit limitations that would become effective upon the completion of the construction of a
Duckweed Treatment System. The duckweed system was constructed, but due to design and
construction flaws, was never put into service. As of this time, the duckweed system is
inoperative and will not go into service. The town has continued to monitor per Part A. (1)
Effluent Limitations and Monitoring Requirements of the permit.
The treatment plant has a history of non-compliance, which led to the requirement to upgrade the
plant. The majority of the non-compliance issues were due to the algae in the plant effluent. The
algae are a natural component of a lagoon treatment system. Starting in February 2012, the town
initiated a pilot program, with the consent of the Washington Regional Office, to help control the

algae growth in the final cell of the treatment system. The pilot program consists of broadcasting
calcium hypochlorite to the third cell. Since that time, the town has not had any effluent
limitation violations. The town is currently looking at other alternatives for algae control.
The permit currently has a permit limit and twice a week monitoring requirement for Total
Residual Chlorine. No chlorine is added for disinfection, but as noted above, the town is
currently doing chlorine addition to the third lagoon for algae control. The town would request
that the monitoring requirement for chlorine be reduced to once per week. Since the inception of
the pilot program, no measureable chlorine has been observed in the effluent. Approximately 15
pounds per day of chlorine is broadcast in the lagoon. The chlorine demand of the algae and
other components in the lagoon are such that no residual will remain. Also, the lagoon is aerated
with a surface aerator which helps volatize the chlorine. Additionally, the detention time and
volume of the lagoon in proportion to the amount of chlorine added assure that no residual will
remain. We feel that given the excess detention time in the lagoon, that once a week monitoring
is representative of the flow characteristics.
The permit also has a requirement for upstream/downstream monitoring as listed in Part A. (3)
Instream Monitoring Requirements. The measurement frequency is 3/week for June -September
and 1/week for October -May. The town is requesting that all upstream/downstream monitoring
be taken out of the permit. If monitoring must remain in the permit, we request that all
monitoring be 1/week. The discharge from the plant is so small compared to the flow in the
creek that no impact will occur. In fact, during the summer months, there are many times with
no flow or greatly reduced flows due to evaporation from the three cells. A review of the DMR
monitoring data over the past couple of years shows that there is little to no change between the
upstream and downstream data.

The berm at the Hookerton Waste Water Treatment Plant is under threat of undermining and failure
through severe erosion of the toe of the dike by Contentnea Creek, which feeds the Neuse River. Failure
would release large volumes of raw sewage into Contentnea Creek, as well as disrupt wastewater
services for the Town of Hookerton. From visual inspection it appears that berm failure is likely at some
point in the near future.

Feasibility Study Phase: 100% Federal (if kept under $100k)
Design & Implementation (DI) Phase (includes construction): 65% federal/ 35% non-federal
• Total DI Phase costs to be determined during course of feasibility study.
• NC Division of Water Resources has previously indicated that they could contribute to
half of the non-federal cost share of a Section 14 project.

Some Potential Discussion Points for Indentifving full non -fed Cost -Share
• What non-federal funds can be combined with the current budgeted DWR funds to
complete the non-federal cost share match?
• Could the Town of Hookerton be provided funding from a group or agency which could
in -turn be used by them (Hookerton) to match the Federal funds and DWR funds?
• If it is not possible to identify more than one source of non -fed funds, is it possible for
any one non-federal party to bring the full 35% non -fed match to the project?
What will the non-federal costs be?
• It will not be possible to know the costs of Design and Construction and associated cost -
share amounts until a recommended plan is selected through the feasibility study, and a
detailed cost estimate is developed.
