AFFIDAVIT OF CREDIT SALE
CAPE FEAR NUTRIENT BANK: CARL -LLOYD SITE
TO: NORTH CAROLINA DIVISION OF WATER RESOURCES (DWR) and NORTH
CAROLINA ECOSYSTEM ENHANCEMENT PROGRAM
The undersigned, EBX -EM, LLC, the Sponsor of the Cape Fear Riparian Buffer and Nutrient
Umbrella Bank (the `Bank "), Carl -Lloyd Site (DWQ Project #09- 0858v2) hereby certifies the
following:
North Carolina Ecosystem Enhancement Program (NC EEP) has deposited
monies with the Sponsor sufficient to acquire 80.43 lbs of Delivered Nitrogen
bank credits from the Carl -Lloyd Nutrient Bank Site for use as compensatory
mitigation for RFP #16- 006100, Contact #006173.
2. Contract #006173 requires a total of 80.43 lbs of Delivered Nitrogen Mitigation
Credits from the Cape Fear River Basin HUC 03030002 as part of its mitigation
requirements. Of this amount 80.43 lbs of Delivered Nitrogen are being provided
by the Carl -Lloyd Nutrient Bank Site.
3. The Sponsor has deducted 80.43 Delivered Nitrogen Mitigation lbs /Credits from
the Bank's credit ledger from the Carl -Lloyd Nutrient Bank Site.
A copy of the Carl -Lloyd Nutrient Mitigation Site credit ledger reflecting the above transaction
is attached to this Affidavit.
