Dear Mr. Stanaland:
The Wilmington Regional Office received the Stormwater Submittal for Ocean Harbor Estates on
December 7, 1993, with final information on February 7, 1994. Based on our review of the project plans
and specifications, including deed restrictions (copy attached) which limit the built -upon area to 5,305
square feet for each lot numbered 1 - 38, we have determined that the project complies with the
Stormwater Regulations set forth in Title 15A NCAC 211.1003(a)(2) (3).
Any modification of the plans submitted to this Office or further development of this contiguous
project will require an additional Stormwater Submittal/Modification and approval prior to initiation of
construction, regardless of the fact that such modification may be less than one acre. Modifications include
but are not limited to; project name changes, transfer of ownership, redesign of built -upon surfaces,
addition of built -upon surfaces, redesign or further subdivision of the project area as shown on the
approved plans.
This Certification shall be effective from the date of issuance until rescinded. The project shall be
constructed and maintained in accordance with the plans and specifications approved by the Wilmington
Regional Office. This Certification does not supersede any other permit or approval. The developer is
responsible for obtaining any and all permits and approvals necessary for the development of this project.
This could include the Division of. Coastal Management under CAMA requirements, the Division of
Environmental Management under Wetland 401 Water Quality Certification and/or a Dredge and Fill
Permit and/or a Sewer Extension/CQllection Permit, U.S. Army Corps of Engineers 404 Wetland Permit,
NPDES stormwater permit if disturbing five acres or more, local County or Town Agency permits under
their local ordinances, or others that may be required.

recorded deed restrictions, including deed book number and page, must be forwarded to this Office within
30 days of the date of the recording. Failure to record and/or submit the deed restrictions to this Office
is considered a violation of this Certification.
An Engineer/Designer/Owner Certification (copy attached) must be received at the time the
recorded Deed Restrictions are submitted. The Certification will verify to this Office that the stormwater
controls and the general layout of the project (amount of impervious area) are in substantial compliance
with the approved Stormwater Plan.

Item 1 Attached please find the completed stormwater
submittal.
Item 2, 3, & 4 The attached road plan has been revised to more
clearly show the project boundary. The Atlantic
Intracoastal Waterway has been labeled on this
plan to show its location adjacent to the pro-
ject's southeastern property line. Additionally
all of the lots have been numbered.
Tract #1 as shown on the original submittal is a
lease parcel for a golf course fairway operated
and maintained by Ocean Harbour Golf Course.

the subject project is not complete. The following information is needed to continue the stormwater
review:
1. A Stormwater Submittal filled out in it's entirety. The original is enclosed for your
convenience.
2. A map of the entire Ocean Harbour land parcel with clearly marked property lines for all
phases/tracts and highlighting the location of the Intracoastal Waterway relative to the
subject project.
3. Number all lots on the submitted plans.
4. What is the status and intended use of "Tract #1" for this or future projects as shown on
the submitted plans?
5. A breakdown of the calculations used to derive both the road and per lot built -upon areas.

On December 7, 1993, the Wilmington Regional Office received a Sedimentation and Erosion Control Plan
for Ocean Harbor Estates. As of this date, however, we have not received a Stormwater Submittal regarding
stormwater management for the subject project.
Please be aware that any site which requires either a Sedimentation and Erosion Control Plan permit and/or
a CAMA major permit will also require a Certification of Stormwater Exemption or Approval by the Division of
Environmental Management. Any construction on the subject site, prior to receipt of the required Certification,
will constitute a violation of 15A NCAC 2H.1003 and will result in appropriate enforcement action by this Office.
A Stormwater Submittal or information regarding the status of this project and expected submittal date must
be received by this Office no later than January 9, 1994, or the subject project file will be closed and construction
