On July 17, 1992, a Certification of Compliance with Stormwater Regulations, No. 910307 was
issued to Mr. Bobby Price for Ocean Dunes Forest Subdivision Phases I and H. The subdivision met
density through the use of grassed swales and deed restrictions for the lots. On March 19, 1993 Regional
Office Staff conducted a compliance inspection and found the grassed swales depicted on the approved
plans were not in place. The plans call for 12"-18" deep swales with permanent vegetative cover and 3:1
side slopes. The Certification specifies that permanent vegetative cover will be maintained for the life of
the project.
It has also come to our attention that the plans on file with the Kure Beach Building Inspections
Department are not the same as the plans approved by this Office. Mr. Bill Hanna's plans show a
proposed ditch and piping beneath all four cul-de-sacs that would direct runoff to an existing pipe
underneath Highway 421. The Department of Transportation issued a driveway permit for 4 connections,
only 1 of which had a pipe proposed, which is consistent with the plans approved by this Office.
Mr. Hanna's main concern is that the proposed swales do not have an outlet and pose a flood
threat to the homes being built there. From the contours shown on the plans, runoff from the cul-de-sacs
will collect and pond within the tract, because the middle of the cul-de-sac is the lowest point. This
Office cannot require a flood proof design, however we do question the ability of the swales as designed
to transport runoff away from the subdivision.

It is this Office's understanding that the Certificate of Completion will be withheld by Mr. Hanna
until the preceeding matters can be resolved in a satisfactory manner. The State will reinspect the project
swales on April 22, 1993. If the swales are not in place per the approved plans, a Notice of Violation
will be issued which will halt the issuance of building permits for the subdivision. The homeowners
should be made aware that the swales cannot be filled in.
