I have reviewed the above referenced project and have the following questions/comments that need to be addressed to
evaluate the project.
1) Cumulative permanent wetland impacts for this project exceeds the 0.1 acre threshold and per general
condition 23, the district engineer will consider the following factors when determining appropriate and
practicable mitigation necessary to ensure that the individual and cumulative adverse environmental effects are
no more than minimal. The mitigation plan included with the application only accounts for crossings that exceed

0.1 acre. While single and complete crossings can be viewed as separate for NWP authorization, mitigation is
viewed as cumulative and wetland loss for the entire project would require mitigation. Please provide a
compensatory mitigation plan that accounts for the cumulative impacts for the entire project.
2) Cumulative permanent stream impacts for this project exceeds the 0.02 acre threshold and per general
condition 6 any NWP that results in a loss of more than 0.02 acres of stream bed, the permittee shall provide a
mitigation proposal to compensate for more than minimal individual and cumulative adverse impacts to the
aquatic environment. The mitigation plan included with the application does not address stream loss. While
single and complete crossings can be viewed as separate for NWP authorization, mitigation is viewed as
cumulative and stream loss for the entire project would require mitigation. Please provide a compensatory
mitigation plan that accounts for the cumulative impacts for the entire project.
3) The proposed activities include permanent wetland loss for grading and paving for construction of the greenway
trail. The need for a greenway is not disputed; however, it is unclear if the project has demonstrated avoidance

The following includes responses to the additional information request received May 12, 2022,
from the U.S. Army Corps of Engineers:

Permanent wetland impacts have been further reduced for the project. Revised impact maps are
attached. In addition, compensatory wetland mitigation has been identified for the entirety of
the project. A 2:1 mitigation ratio was assumed for all impacts except the boardwalk removal. A
1:1 mitigation ratio has been assumed for impacts associated with the boardwalk removal.
Copies of the Statement of Availability Letters are provided in the attached.

The Town of Holly Springs Parks, Recreation and Greenway Master Plan's identified project
corridor for this project follows Middle Creek between Sunset Lake Road and Holly Springs Road.
Wetlands were mapped for the project and are almost continuous along the corridor. SEPI
approached this project as an iterative design, studying multiple alignments to minimize the
impacts to the maximum amount practicable.
Boardwalk crossings were generally not a viable solution through much of the project due to the
trail's location within the floodplain and Floodway. The structures create a blockage within the
FEMA flood model, and result in an increase depth of upstream flood waters.
The extensive wetlands also create limited access points and boardwalks can create large
sections of asphalt trail that would become isolated (located between two boardwalks). Trail
bridges and boardwalks are not designed to support loading associated with future grading and
paving activities. Future maintenance operations would have to construct temporary access
roads around the boardwalks, through the wetlands to access the isolated paved portions of
trail.
Specific examples are as follows:
• At the Sunset Lake Road connection (northern most part of the trail), the original trail
alignment would have removed the existing failing boardwalk and replaced it with an
asphalt trail on fill. To avoid this wetland impact, easements were acquired on private
property to move the trail out of the wetland. This trail relocation resulted in reducing
permanent wetland impacts by approximately 0.62 acres.
Near the middle of the trail between Bridge 1 and the largest wetland crossing (WI), the
original trail alignment more closely followed the sewer easement closer to Middle Creek,
with a spur trail to connect to the trail head. This alignment resulted in large parallel
impacts along the wetland. To avoid these impacts, the trail was moved upland, outside
of the wetland boundary, and crossed the wetland perpendicular at two locations. This
trail relocation resulted in reducing permanent wetland impacts by approximately 0.78
acres.

• Removed trail spur connecting to Aldenwood Place. This spur would have been
constructed entirely in the wetland. Removal of this spur section resulted in reducing
permanent wetland impacts by approximately 0.20 acres.
• Boardwalk 'A' is used to cross the southeast end of Wetland WJ. The use of boardwalk in
this location resulted in reducing permanent wetland impacts by approximately 0.07
acres.
• Boardwalk 'B' is used to cross stream SJ. The use of boardwalk in this location resulted
in reducing permanent stream impacts by approximately 20 linear feet.
• Boardwalk 'C' is used to cross stream SI. The use of boardwalk in this location resulted in
reducing permanent stream impacts by approximately 20 linear feet.
4) The proposed activities include the permanent discharge of fill material (loss of waters
and no loss of waters) within stream channels for culvert installation (loss) and rip rap
installation (no loss). The need for a greenway is not disputed; however, it is unclear if
the project has demonstrated avoidance and minimization to the maximum extent
practicable as required by NWP General Conditions 23(a) and (b). For example, based
on previous experience, past projects and some crossings on this project raised bridges
can be used to cross stream channels to avoid impacts to streams. Please redesign or
provide information to support installation of culverts and riprap within stream
channels.
We relocated the trail outside of wetlands where possible, and designed stream and wetland
crossings to be as perpendicular as possible. When pipes were needed, concrete endwalls were
used to further minimize the pipe length and the impacts to streams and wetlands.
In addition, as stated above:
• Boardwalk 'B' is used to cross stream SJ. The use of boardwalk in this location resulted in
reducing permanent stream impacts by approximately 20 linear feet.
• Boardwalk 'C' is used to cross stream SI. The use of boardwalk in this location resulted in
reducing permanent stream impacts by approximately 20 linear feet.

Re Project: Arbor Creek Greenway
This document confirms that Town of Holly Springs (Applicant) for the Arbor Creek Greenway
(Project) has expressed an interest to utilize 220 Stream Mitigation Credits from the EBX-Neuse
sponsored Neu -Con Wetland & Stream Umbrella Mitigation Bank, specifically 220 stream credits from
the Meadow Spring Site, in the Neuse HUC 03020201. As the official Bank Sponsor, EBX-Neuse I, LLC,
attests to the fact that mitigation is available for reservation at this time.
These mitigation credits are not considered secured, and consequently are eligible to be used for alternate
purposes by the Bank Sponsor, until payment in full is received from the Applicant resulting in the
issuance of a Mitigation Credit Transfer Certificate by the bank acknowledging that the Applicant has
fully secured credits from the bank and the Banker has accepted full responsibility for the mitigation
obligation requiring the credits/units.
The Banker will issue the Mitigation Credit Transfer Certificate within three (3) days of receipt of the
purchase price. Banker shall provide to Applicant a copy of the Mitigation Credit Transfer Certificate and
a documented copy of the debit of credits from the Bank Official Credit Ledger(s), indicating the permit
number and the resource type secured by the applicant. A copy of the Mitigation Credit Transfer
Certificate, with an updated Official Credit Ledger will also be sent to regulatory agencies showing the
proper documentation.
