DWR#20200474 V2 and USACE SAW-2020-00607 Colleen's Comments: 1) Please provide the Division with a copy of your response to the April 8, 2022, Request for Additional Information from the US Army Corps of Engineers. 2) This project received a NOV in October 2021 for the flexamat matting and concrete. The flexamat was removed in response to the NOV, but it is still shown on the plans included with the submittal. Please remove the flexamat from the plans. See attached for an updated copy. 3) The plans show the pipe as a 20 inch steel casing pipe, but only 1 linear foot (12 inches) of permanent impacts are requested. Please provide additional information on this impact. You are correct— I misread the plans. There will be 20 inches of impact, rounded up to two feet. 4) Additionally, plans still say "gradually slope creek bed over the top of the steel casing pipe" but my understanding is that the pipe was installed over the streambed. Is there room for the passage of aquatic life? What is the side -view of the pipe as -built? Please provide additional information on this impact. The plans had not been updated correctly. See attached for an updated copy. Lyle's Comments: 1. It appears that there was an issue with the submittal of the PCN. I have attached the file received. Some of the written sections of the PCN were shortened and I am unable to read the full response. C. 5a. Comments, D. 3j. comments, E. la, E. lb, G. 2b, G. 3b, G. 5j, Name, Signature and Date are some examples of the submittal issue. Please address these comments. See attached — written sections have been typed out and attached. 2. In order to verify compliance with NWP 18, please provide the cubic yards of the discharged fill material below the ordinary high water mark. Ten cubic yards. 3. The attached "50 Sanitary Plan and Profile" exhibit included with the application notes that "flexamat" or an approved equal be used on each site of the pipe. If this is the case please provide justification for this fill and updated the PCN and exhibits accordingly. Plans have been updated to exclude the flexmat. Please let me know if I missed anything or if you need anything else to process the permit! Proposed Impacts Inventory 3. Stream Impacts 3j: The sanitary sewer alignment was installed in 2021. The sanitary sewer is exposed due to the elevation of the project site and the existing sanitary sewer that it connects to. As a result, the project resulted in one foot of linear stream impacts consisting of the sanitary sewer line. G. Supplementary Information 2. Violations 2b: The original permits granted by the USACE and the NCDWR (attached) did not account for permanent impacts resulting to Big Branch from the sewer line crossing. At the time of the original permit submission, engineers anticipated that the sanitary sewer could be installed beneath the stream bed. However, due to the elevation of the site and the elevation of the existing sewer line the project's sanitary sewer line was tying into, the sanitary sewer needed to be installed above grade to meet the required gradients for the sewer line. This permit is intended to address the additional impacts not included by the original permit by the sanitary sewer. 3. Cumulative Impacts 3b: The sewer line has been installed to accommodate a previously permitted development. The sewer line will not be used to support additional development. 5. Endangered Species and Designated Critical Habitat 5j: The NC Natural Heritage Program online data explorer (https:www.ncnhp.org), US Fish and Wildlife Information for Planning and Consultation (IPaC) report. No critical habitat or element occurrences of protected species were identified within one mile of the project site.
