The North Carolina Ceriodaphnia chronic effluent bioassay procedure (North Carolina Chronic Bioassay Procedure - Revised *February 1987) or subsequent versions. The effluent concentration at which there may be no observable inhibition of reproduction or significant mortality is a23 % (defined as treatrnent two in the North Carolina procedure document). The permit holder shall perform quarterly monitoring using this procedure to establish compliance with the permit condition. The first test will be performed after thirty days from issuance of this permit during the months of Pile ANY ANG Nd V . Effluent sampling for this testing shall be performed at the NPDES permitted final effluent discharge below all treatment processes. All toxicity testing results required as part of this permit condition will be entered on the Effluent Discharge Monitoring Form (MR-1) for the month in which it was performed, using the parameter code TGP3B. Additionally, DEM Form AT-1 (original) is to be sent to the following address: Attention: Technical Services Branch North Carolina Division of Environmental Management P.O. Box 27687 Raleigh, N.C. 27611 Test data shall be complete and accurate and include all supporting chemical/physical measurements performed in association with the toxicity tests, as well as all dose/response data. Total residual chlorine of the effluent toxicity sample must be measured and reported if chlorine is employed for disinfection of the waste stream. Should any single quarterly monitoring indicate a failure to meet specified limits, then monthly monitoring will begin immediately until such time that a single test is passed. Upon passing, this monthly test requirement will revert to quarterly in the months specified above. Should any test data from this monitoring requirement or tests performed by the North Carolina Division of Environmental Management indicate potential impacts to the receiving stream, this permit may be re -opened and modified to include alternate monitoring requirements or limits. NOTE: Failure to achieve test conditions as specified in the cited document, such as minimum control organism survival and appropriate environmental controls, shall constitute an invalid test and will require immediate retesting(within 30 days of initial monitoring event). Due to changes in USGS stream flow estimates, the current limitations for the proposed expansion to 6.0 MGD are not accurate. This has resulted in very strict wasteload allocations for other projects in the subbasin due to predicted dissolved oxygen violation by modeling. The City of Hendersonville's permit needs to be revised in accordance with the attached memorandum dated December 12, 1988, from Jackie Nowell. It is requested that the attached documents be reviewed and the City of Hendersonville's NPDES Permit No. NC0025534 discharge limitations page for 6.0 MGD be modified accordingly. The limitations page for the existing 3.2 MGD facility did not change as result of the stream flow data revisions. Should there be any questions, please advise. On September 3, 1987, this Division issued NPDES Permit No. NC0025534 to the City of Hendersonville for the continued operation of the existing 3.2 MGD wastewater treatment facility on Mud Creek and the future expansion to 6.0 MGD. Discharge limitations developed at that time were established at secDndary treatment levels for both the existing plant and the future 6.0 MGD facility. Recent changes in the data used in the modeling procedures, specifically stream flows and slope calculations, indicate that the limitations established for the proposed 6.0 MGD facility are not accurate. Stream flow data provided by U.S. Geological Survey show a reduction in the 7 day 10 year low flow from 40 cfs to 31.8 cfs. Slope calculations for the receiving stream have been changed from 4.8 feet per mile to 3.5 feet per mile approximately 0.6 miles below the Hendersonville wastewater treatment plant discharge. This information has been discussed by the Division's Asheville Regional Office personnel with your staff and consultants. To date there has been no need to modify the existing permit since the City is not planning to expand the existing facility. However, other proposed projects in the subbasin applying for NPDES Permits are receiving very stringent treatment requirements due to Hendersonville's NPDES Permit for Pollution Prevention Pays P.O. By modifying Hendersonville's 6.0 MGD limitations to reflect current modeling data the NPDES Permits for other projects in the subbasin can be accurately developed and Hendersonville's permit will accurately reflect treatment requirements for a 6 MGD discharge. Therefore, in accordance with 40 CFR 122.62, N. C. General Statute 143.215.1(b)(3) and Title 15 North Carolina Administrative Code 2H .0114 the City of Hendersonville's NPDES Permit No. NC0025534 is hereby modified changing the effluent limitation requirements for the proposed 6.0 MGD facility. Enclosed is a modified effluent limitations page which should be inserted in the City's NPDES Permit No. NC0025534. This modification will be effective sixty days from receipt of this notice. All other terms and conditions of NPDES Permit No. NC0025534 not herein modified remain in full force and effect. If any part of this permit revision are unacceptable to you the City should make written request for modification to the Director identifying the specific issues to be contended. The City of Hendersonville has not indicated that the 6.0 MGD facility will never be built. In fact their consultant has provided proposed layouts showing the expanded facility. Even though there has not be established a completion date for the proposed facilities it is not recommended to remove the 6.0 MGD approval from the NPDES Permit. The wasteload should be revised upon next permit renewal to reflect any change in permit limits. The proposed wasteload has been discussed with the City's consultant. Should this wasteload be finalized then the City should be so notified. 2. The proposed wasteload for the Mud Creek South Plant to be built by the County has been reviewed and approved.
