Thank you, Stephanie! I am indeed doing well, and I hope you are too.
I realized after I had asked the question about the NWP expiration that NWP 58, under which this project now falls (since
NWP 12 was modified to only be used for petrochemical utilities), was issued in 2021 and will expire in 2026. If we can
make this project work under the 58 (no functional loss for stream impacts / riprap stabilization), we should be good.
Since the time of my last writing, the design team identified an additional area where impacts have been reduced, so now
there is a reduction of both wetland and stream impacts compared to the original permit submittal.
Colleen and Lyle, I have submitted the permit modification as of yesterday via the website at
https://edocs.deq.nc.gov/Forms/form/new/80, using the Modification/New Project with Existing ID option. Please let me
know if there is anything I need to do to follow that up. I assume another NCDWR review fee will be needed for this
project and have advised my client (Highfill Infrastructure Engineering, for the City of Raleigh) to anticipate an invoice in
the near future. Are those invoices still automatically generated and e-mailed to the permit requestor for payment, as they
were using the previous online PCN submittal form?

With the upcoming expiration of the NWP's in march and the work for the project has not started it seem to me that a
submittal of a revision of the PCN would be the most efficient way to go forward from here since there is a change in
impacts. With this being said, I am no longer the primary 401 and buffer authorization reviewer at RRO. Colleen Cohn is
now the primary reviewer and I have copied her on this email, so you can get her opinion as well.

We were issued a NWP 12 for this project in 2020. I know the NWPs changed to separate the 12 and 58 since then, and I
do not believe the project is yet under contract. Is the NWP 12 we were issued still valid for construction (or would it be if
the project had no design changes), or was it made null when the NWPs were revised?
I don't believe the project is yet under contract, but will go out to bid soon. In light of the timing of the request and the
upcoming expiration of the 2017 NWPs, do you think it would be wise to wait until the 2022 NWPs are reissued if we need
a new authorization under a 58? It's looking as if impacts will still be over 1/10th acre with the removal of the one stream
crossing impact, so notification would be required.

If notification is required and the applicant would like authorization from the Corps then a PCN would be necessary. The
Corps is now authorizing sewer and water projects under NWP 58. Take a look at the attached NWP 58 and see if the
revisions require notification. Note: some project that required notification under NWP 12 no longer require notification
under NWP 58.

Hi Stephanie and Lyle,
The Big Branch Sewer Improvement Project in Raleigh, NC (NCDWR #20-0597, USACE SAW-2019-01842) is undergoing
revision to impacts based on updates to the construction drawings. Stream impacts have been lessened, with the removal
of 1 stream crossing, and buffer impacts have generally increased. I am preparing a summary of the changes, including a
narrative, a full set of revised buffer permit drawings, and a revision to the surface water / wetland permit drawing sheet
showing the removal of the stream crossing impact.
My question to you both at this point is this: May I submit these updates to you directly, or will I need to initiate a new
PCN online form and submit via that portal?
