Sullins, Director Division of Water Quality September 14, 2007 DWQ Project # 07-1531 Buncombe County CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Shelton Harnash SJH Enterprises, LLC 11844 NW 69`" Place Parkland, FL 33076 Subject Property: Stoneridge At Hayes Mountain Ut to Pole Creek [040302, 6-76-6, C] REQUEST FOR MORE INFORMATION Dear Mr. Harnash: On September 10, 2007, the Division of Water Quality (DWQ) received your application dated August 3 1, 2007, to fill or otherwise impact 0.112 acres of 404/Wetland (0.030 acres of fill impact, 0.082 acres of flooding impacts) and 228 linear feet of perennial stream (88 linear feet of fill and 140 linear feet of flooding impacts), to construct the proposed residential development and amenity pond. The DWQ has determined that your application was incomplete and/or provided inaccurate ilnformation as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive five copies of the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. Please re-submit your site plans on full plan sheets at a scale of no smaller than 1"=50', clearly indicating contour lines and proposed impounded area (normal pond level elevation and depth) in plan and profile view. 2. Please provide cross section details showing the provisions for aquatic life passage. 3. Please locate all isolated or non-isolated wetlands, streams, and other Waters of the State as overlays on the site plan: 4. Please provide structural design drawings and details for the dam, including the plan and profile views illustrating the height, toe, materials, and spillway. 5. aPlease submit a minimum water release plan for the proposed dam. The plan must include a written explanation of the specific discharge rate and mechanism to provide for each required release. The plan shall also include monitoring that ensures compliance. The plan and any associated facilities, once approved, must be in place and implemented upon the completion of the dam. 6. Please provide monitoring data from similar projects in your county demonstrating that the proposed pond will not violate water quality standards in regards to temperature, dissolved oxygen and iron. Please submit this information within 30 calendar days of the date of this letter. If we do not receive this requested information within 30 calendar days of the date of this letter, your project will be withdrawn and you will need to reapply with a new application and a new fee. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Please be aware that any impacts requested within your application are not authorized (at this time) by the DWQ.
