Dear Ms. Higgins,
Please find attached the Riparian Buffer Authorization Form for the above referenced project.
The City of Durham is installing a new interconnection pipeline to allow the City of Durham to
create a new water pressure zone that will improve system pressure and fire protection. The
main will be installed close to the intersection between Page Road Extension and Glenwood
Avenue.
The most recent version of the published County NRCS Soil Survey Map shows several
streams in the project area. An Ephemeral /Intermittent/Perennial Determination was performed
by DWR and the features shown on the soil survey to be within the project area were
determined to be ephemeral streams. A copy of the Surface Water Determination Letter is
attached.
Minimal, temporary disturbance of the riparian buffer within the Neuse River basin will occur in
association with the proposed project. Temporary impact to 14 square feet of Zone 2 of the
riparian buffer, which is allowable per 15A NCAC 0213.0233, will occur during construction of
the proposed project. No temporary or permanent impacts to Zone 1 of the riparian buffer are
proposed. The maintained corridor associated with the transmission line, as required by the
North Carolina Department of Environment and Natural Resources, will not be located within
Zone 1 or Zone 2 of the riparian buffer.

The purpose of the project is to install a new interconnection pipeline to allow the City of Durham to create a
new water pressure zone, which will improve system pressure and fire protection.

The project will install new waterlines and an elevated storage tank to expand the current network and create a
new pressure zone The main will be installed close to the intersection between Page Road Extension and
Glenwood Avenue. Equipment anticipated to be used during installation of the waterlines are anticipated to
include backhoes, front -end loaders, bulldozers, dump trucks, compaction rollers, flatbed haul trucks, and a
jack and bore guided auger machine.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1 a Specifically describe measures taken to avoid or minimize the proposed impacts in designing project
Prior to and during design of the project, wetland and stream determinations were performed to assess the
presence of jurisdictional wetlands and streams within the proposed pipe corridor. As many components of the
project as is feasible have been sited away from jurisdictional areas. The pipe has been sited to avoid and
minimize impacts to streams and riparian areas.
Several options relative to access roads were assessed and the options chosen were those that provide
access to the site without impact or with minimal impact to jurisdictional resources.
1 b Specifically describe measures taken to avoid or minimize the proposed impacts through construction
techniques.
Construction of the transmission line will not require traversing the onsite stream. No jurisdictional wetlands are
present on the project site Impacts to the onsite stream during construction will be avoided and minimized to
the extent feasible. Best management practices, and sedimentation and erosion control methods will be used
during all construction activities. No equipment refueling or maintenance activities will occur adjacent to the
jurisdictional areas.

Explanation: The feature(s) listed above has or have been located on the Soil Survey of Durham County, North
Carolina or the most recent copy of the USGS Topographic map at a 1:24,000 scale. Each feature that is checked
"Not Subject" has been determined not to be a stream or is not present on the property Features that are checked
"Subject" have been located on the property and possess characteristics that qualify it to be a stream. There may be
other streams located on your property that do not show up on the maps referenced above but, still may be
considered jurisdictional according to the US Army Corps of Engineers and /or to the Division of Water Resources
(DWR).
This on -site determination shall expire five (5) years from the date of this letter. Landowners or affected parties that
dispute a determination made by the DWR or Delegated Local Authority may request a determination by the
Director. An appeal request must be made within sixty (60) days of date of this letter or from the date the affected
party (including downstream and /or adjacent owners) is notified of this letter. A request for a determination by the
Director shall be referred to the Director in writing c/o Karen Higgins, DWR WeBSCaPe Unit, 1650 Mail Service
Center, Raleigh, NC 27699.
This determination is final and binding unless, as detailed above, you ask for a hearing or appeal within sixty (60)
days.
The owner /future owners should notify the Division of Water Resources (including any other Local, State, and
Federal Agencies) of this decision concerning any future correspondences regarding the subject property (stated
above). This project may require a Section 404/401 Permit for the proposed activity. Any inquiries should be
