Description of any best management practices to be used to control impacts associated with the proposed activity (i.e., control of runoff from impervious surfaces to provide diffuse flow, re-planting vegetation or enhancement of existing vegetation, etc.): Grass Swale for initial .treatment and to direct runoff back outside of Zone 2' then runoff enters Level Spreader and is made diffuse_prior to the entire 50' Buffer (outside of Zones 1 and 2~. Please provide an explanation of the following: (1) The practical difficulties or hardships that would result from the strict application of this Rule. As described in Question #2_above~ the Lot would be virtually un-developable if ~_alf built-upon areas were restricted beyond Zone 2 of the Buffer. This would drastically, de-value if not completely condemn, the__p_roperty from the time the_Owner originally obtained it (prior to the adoation of the Neuse Buffer Rulesl. (2) How these difficulties or hardships result from conditions that are unique to the property involved. _The Lot is part of a subdivision that was developed and recorded prior to adoption of the Neuse River R~arian Buffer Rules. Therefore, t_he lot was not designed _~to account_far Riparian Buffers. It was oniy~the enartment of the Buffer Rules that caused the stated hardshio. ----- - __ _ - ----- (3) If economic hardship is the major consideration, then include a specific explanation of the economic hardships and the proportion of the hardship to the entire value of the project. _ The lets in the neighborhood are selling fo~80.00_0 each. This lot ispotentially worthless ___ now due to t_he_1997 adoption of the Neuse Buffer Rules. If Zone 2 is waivered the lot can ~~ossibly be sold for 65,000 because_a homesite must be built close to the front with a buildable width that is more narrow that a standard lat. _ Part 3: Deed Restrictions By your signature in Part 5 of this application, you certify that all structural stormwater best management practices required by this variance shall be located in recorded stormwater easements, that the easements will run with the land, that the easements cannot be changed or deleted without concurrence from the State, and that the easements will be recorded prior to the sale of any lot.
