Please be aware that in accordance with Article 108-7 of the Standard Specifications the
Department has suspended grading operations on R-3421B due to failure on the part of Vecellio
& Grogan to perform the necessary measures to control erosion and siltation as outlined in
Article 107-12; specifically the items outlined on the Notice of Violation dated 7-20-2022 and
the failure to perform the required corrective actions listed in recent NPDES inspection reports in
a timely manner and within the required completion timeframes (Urgent - 24 hrs/Routine - 5
days). The suspension of work shall be effective immediately and will apply to any land
disturbing activity on R-3421B including grading and pipe installation operations. Work may
again commence once Vecellio & Grogan completes all corrective actions listed in the most
recent NPDES inspection report and complete all necessary work listed in the NOV dated 7-20-
2022. The Department will determine when these required corrective actions are properly
completed.
In the future it is imperative Vecellio & Grogan take corrective action within the proper
timeframes as required by the NPDES permit and provide adequate forces and equipment for
such.
In accordance with Article 108-7 of the Standard Specifications, no extension of the
contract completion date will be allowed for this suspension.
