Please find attached Mitigation Credit Transfer Certificates for DENR Contracts 6125 and 6126. 1 know we already signed
a transfer form, but this is an affidavit we do for all nutrient and buffer sales (it's just named differently since it's in the
Upper Neuse). I've included copies of the ledgers again too. Let me know if you have any questions.

MITIGATION CREDIT TRANSFER CERTIFICATE

HATLEY BUFFER BANK SITE
TO: NORTH CAROLINA DIVISION OF WATER RESOURCES and NORTH
CAROLINA ECOSYSTEM ENHANCEMENT PROGRAM
The undersigned, EBX -Neuse I, LLC, the Sponsor of the Hatley Nutrient Bank (the `Bank")
(DWQ #2011- 0720v4) located in Person County, NC, hereby certifies the following:
State of North Carolina DENR has deposited monies with the Sponsor sufficient to
acquire 119,109.70 Buffer Credits (square feet) from the Bank for use on its DENR
Contract Number 6126 project.
2. The DENR Contract Number 6126 project requires a total of 119,109.70 Riparian Buffer
Mitigation Credits in HUC 03020201 as part of its mitigation. Of this amount 119,109.70
Buffer Credits are being provided by the Hatley Nutrient and Buffer Bank Site.
The Sponsor has deducted 119,109.70 Buffer Credits from the Bank's credit ledger from
the Hatley Buffer Bank Site.
A copy of the Hatley Buffer Mitigation Site credit ledger reflecting the above transaction is
attached to this Affidavit.
