Ferguson, PE – Mountain Region Engineer North Carolina Wildlife Resources Commission Division of Engineering & Land Management 171 Southern Cross Road Weaverville, NC 28787 Subject: Agent Authorization for Black Bear Access Area Installation of Public Fishing Pier on Lake James Catawba-Wateree Hydroelectric Project (FERC No. 2232) Dear Jeff, This letter is provided to serve as the “Agent Authorization Letter” and provide North Carolina Wildlife Resources Commission (NCWRC) signature authority for the owner/applicant, that being Duke Energy Carolinas, LLC, for upgrade work proposed at Black Bear Access Area. The work includes the installation of a new fishing pier in Day Use Area. This construction work is proposed to occur within 2022. The upgrades will improve fishing opportunities for the general public. It is understood this work will take place after all the permits are acquired. This authority is granted to assist the NCWRC in acquisition of necessary permits to satisfy Section 404 and/or Section 10 Nationwide, Regional and General Permits, Section 401 general Water Quality Certifications, and Riparian Buffer and Watershed Buffer Rules.
