Location/Description of Proposed Activity: The site is located along a 2.2 mile segment of Lovills Creek and the
Ararat River near the Newsome Street, State Highway 52 intersection in Mt. Airy, North Carolina.

M urisdictional wetlands associated with the construction of a 2.2 mile greenway trail along LovilIs Creek and
the Ararat River asfollows Crossing #1 ( Impact #W1, 36.4824, - 80.6075): Wetland WF -0.03 acre of
off manent fill for areenwav construction. Crossina #2 (1 moact #W2.36.4798. - 80.6006): Wetland WC -0.006
acre of permanent fill for greenway construction.

❑ Your application did not include a statement explaining how avoidance and minimization for losses of waters
of the U.S. were achieved on the project site. (see remarks)
❑ Your submitted project plans or maps were insufficient, too large, or not legible (see remarks).
❑ Your application did not include a delineation of affected special aquatic sites, including wetlands, vegetated
shallows, and riffle and pool complexes as required.
® You must submit a copy of your application to the NC Wildlife Resources Commission (WRC) since your
proposed work is in a designated trout water county (see remarks section below for the address of your WRC
representative)

REMARKS:
Please provide the following information:
1. Your plans indicate there are also two (2) stream crossings. Please indicate if these will be bridged and /or
if there will be any jurisdictional impacts, either permanent or temporary associated with the construction of
the crossings. If there will be jurisdictional impacts, you should indicate the amount on the PCN and provide
the appropriate plan view and cross section drawings. Even if there will be no jurisdictional impacts, you may
want to provide additional drawings indicating the method of crossing at these locations.
2. Please provide a copy of the application to the North Carolina Wildlife Commission (NCWRC). The

3. Currently, the only agencies with approved categorical exclusions that can be authorized by a Nationwide
Permit #23, are: 1)Bureau of Reclamation; 2) Federal Highway Administration and 3) The U.S. Coast Guard.
Please provide a copy of the Final Categorical Exclusion, completed by one of these agencies, for this project.
If you cannot provide a copy of the Categorical Exclusion or if it was not conducted by one of the agencies
listed above, we may still be able to approve this request using Nationwide Permit #14, for linear
transportation projects. This final determination will depend upon the final impacts to jurisdictional waters
(see number 1 above).
4. Based on the information provided in you Pre - Construction Notification (PCN), there are federally listed
threatened and endangered species that might be affected or in the vicinity of the project. Specifically, the
species you indicated that might be in the vicinity is Helianthus schweinitzii ( Schweinitz's Sunflower).
Condition #18 of the Nationwide Permits states that, No activity is authorized under any NWP which "may
affect" a listed species or critical habitat, unless Section 7 consultation addressing the effects of the proposed
activity has been completed. We have informally consulted with the U.S. Fish and Wildlife Service regarding
the site specific survey you indicated that you will be conducting for the Schweinitz's Sunflower, in
September /October of 2014. In order for us to make a determination regarding the potential effects, we will
need the completed survey. Please provide this survey as soon as possible.
