Re: BPDP and NOBI Approval

Dear Sir,

The Division of Water Resources (DWR) received a draft Bank Parcel Development Package
(BPDP) for the Pickle Creek Phase II Site (Site) in 2021, for review and approval under the terms
and conditions of the RES Pickle Creek Phase II Nutrient Offset Banking Instrument (NOBI). DWR
reviewed the BPDP and NOBI documents and provided comments and recommendations. DWR
received a revised BPDP and NOBI that addressed all comments and recommendations. Effective
August 12, 2022, the NOBI was officially made and entered into by Environmental Banc &
Exchange, LLC (EBX) acting as the Bank Sponsor, and the DWR. The table below summarizes the
timeline of the BPDP and NOBI:
