White moratorium condition

Work Moritoria — [15A NCAC 02H.0506(b)(2) and 15A NCAC 04B. 0125
The permittee will need to adhere to all appropriate inwaterwork moratoria (including the use
of pile driving or vibration techniques) prescribed by the National Marine Fisheries Service
and/or INC Division of Marine Fisheries for Primary Nursery Areas. No in -water work is
permitted between February 15 and September 30 of any year, without prior approval from the
INC Division of Water Resources and the National Marine Fisheries Service and/or INC Division of
Marine Fisheries. In -stream work and land disturbance within the 25-foot buffer zone are
prohibited during the troutspawningseason of October 15 through April 15 to protect the egg
and fry stages of trout.
