TATA GOVERNOR TARY' August 20, 2014 Mr. John Thomas " US Army Corps of Engineers 3331 Heritage Trade-Dr.' 2 Q 1A. 9 2$ Suite 105 Wake Forest, NC 27615 ' SUBJECT: Nationwide Permit #14 ''Access road for Gildan Yarns off of Heilig Driver WBS project no.: 46295 Rowan, NC h- Dear Mr. Thomas, The NCDOT is requesting a Nationwide 14 permit for the construction of a NCDOT owned access road for the'expansion of the Gildan Yarns Industrial facility off of Heilig Drive in Rowan County. NCDOT'will retain ownership of the road after construction. There is an existing Isolated Wetlands permit issued by NCDWR for the Gildan Yarns facility. There are no other impacts that the NCDOT is aware of for the construction °of the facility or -the utilities associated with the Gildan Yarns Industrial facility. Purpose and need The purpose of the project is to construct an access road for the Gildan Yarns industrial "facility. The access road is needed because of the high volume of truck traffic expected ;at the expanded facility. At full operation, the truck traffic for a new 650,000 square foot Yarn'Manufacturing facility of 200'to 220 trucks per week (45 per day on a 5 day schedule) it will be impossible to' handle the additional truck traffic for the new facility in addition to the truck and car traffic for the existing 400,000 square foot plant. All employee traffic for both facilities will come in and out of the existing entrance, which is estimated to be 200 cars at each shift change plus, additional 45 - 50 trucks per week (10 trucks per, day on a 5 day schedule) fo'r Plant 1's entrance. Due to 'the large truck volume for the second plant, it-will be difficult if not impossible to safely move-that many cars and tractor trailers trucks through one entrance at peak times during the day. Jurisdictional Determination On April 3, 2014, an on -site determination of jurisdictional streams and'wetlarids in the-project study area for the road. A jurisdictional determination was issued by John Thomas of the-. USACE on•May 13, 2014, and a stream call letter was issued by Sue Homewood with NCDWR on June '5, 2014. Copies of those are'available upon request. '' Avoidance and Minimization The road has been shifted to the east on the north end to avoid and minimize impacts to jurisdictional streams and wetlands. Specifically, impacts to wetlands WB and WC, and stream SB have either been greatly reduced or eliminated. Impacts Impacts at site I include 157' of stream impacts (54 temporary and 103 permanent) and 0.05 acres of temporary wetland impacts. A 64' X 103" culvert will be placed in Stream A. The culvert will be fabricated with a notched sill at the inlet and outlet with the high flow portion of the sill at 2'elevation and the low flow sill at 1'elevation, and floodplain benches will be constructed flush with. the high flow sill and tapered to match the existing stream .width at the inlet and outlet.' The culvert will be buried 1' below the stream bed. The culvert site will be dewatered during construction in accordance with NCDOT's Best Management Practices. There will also be impacts to WA for the removal of a fiber optics line. The impact area will be restored to preconstruction contours, and vegetated with a native riparian seed mix. Impacts at site 2 include 0.05 acres of permanent wetland impacts and 0.07 acres of temporary wetland impacts. An 88' X 48" culvert will be placed in Wetland C. The culvert will be laid at grade. The culvert site will be dewatered during construction in accordance with NCDOT's Best Management Practices. Stormwater Management Plan Post - construction stormwater treatment is required through NCDOT's Individual NPDES Permit (NCS000250). Stormwater treatment has been designed in accordance with NCDOT's Stormwater BMP toolbox. Stormwater will be treated to the maximum extent practicable. A copy of the stormwater management plan is attached. Endangered Species Review Schweinitz's Sunflower is the only federally endangered species currently listed for Rowan County. A site visit was conducted on April 9, 2104 with Jason Mays (USFWS). Suitable habitat was found along Heilig Drive and in utility corridors along the existing roadway. We found multiple. companion species, but did not find Schweinitz's sunflower. Therefore we believe the project will have "No Effect" on Schweinitz's sunflower. A copy of an email documenting the site visit with Jason Mays is attached. The bald eagle is protected under the Bald and Golden Eagle Protection Act. The site is not located near know populations of the bald eagle. During numerous visits to the site, no bald eagles or nests were identified. Therefore we believe the project will have "No Effect" on the bald eagle. SEPA Documentation A Minimum Criteria,Checklist was completed for the project. Through the preparation of the document, a cultural resource review, an Air Quality and Noise Analysis, and a community. impact Assessment were required. "No effect" calls were made on both Historic Architecture and Archeology. Air Quality studies determined that there will be no adverse effect on air quality. A noise analysis determined that there are no predicted traffic noise impacts. Community Impact Assessment concluded that there would be "no notable direct community impacts ". The Community Impact Assessment did recommend a Local Officials meeting which was held on June 13, 2014. The minimum criteria checklist and the results of the reviews are attached. Indirect and Cumulative Impacts The Indirect and Cumulative Effects Screening Matrix was completed for the project. The results indicated that the proposed project will not result in any notable indirect and cumulative effects. A copy of that analysis can be found in Appendix D of the attached Community Impact Assessment. By copy of this letter, we also request 401 review and approval from the NC Division of Water Resources with one copy of the application package provided to Amy Chapman, Transportation Permitting Unit Supervisor, and Sue Homewood, 401 Project Coordinator in the Winston Salem Regional Office. Please note the attached check for the permit application fee of $570. By copy of this letter, we also request Marla Chambers, NC Wildlife Resources Commission, and Jason Mays, USFWS, to comment directly to the Corps concerning the permit request. The road will be owned and maintained by NCDOT. Jurisdictional determinations, endangered species surveys, noise and air quality analyses, cultural resource reviews, and community impact studies have been conducted on the proj ect. Streams and wetlands have been delineated and verified by the US Army Corps of Engineers and NC Division of Water Resources. Copies of those verifications from the USACE and NCDWR are attached. There are impacts to an isolated wetland associated with the construction of the Gildan Yarns facility. Those impacts were permitted separately. NCDOT is of the understanding that there will be no additional impacts to jurisdictional features during the construction of the Gildan facility or utilities for the facility. There will also be no impacts to jurisdictional features for any of DOT's borrow waste site. There will be no effect on any federally protected species. The site was surveyed for the endangered plant, Schweinitz's sunflower. Habitat for the sunflower was present but no species were found during surveys with Jason Mays of the USEWS on April 9, 2014. Therefore the project will have "no effect" on Schweinitz's sunflower. See attached email to Jason Mays documenting the site visit, The Bald Eagle is protected under the Bald and Golden Eagle Protection Act. There are no populations within one mile of the project site, and no bald eagles present or nesting during numerous site visits. Noise and air quality studies were conducted by NCDOT Human Environment Section. Regarding the air quality studies, it was determined that there will be no adverse effects on air quality. See attached memo. Regarding the noise analysis, there are no predicted traffic noise impacts. See attached memo. Cultural resource reviews were completed by NCDOT Human Environment Sections. It was determined that there was no listed archeological sites present in the area of potential effects (APE). See attached "No archeological sites present or affected form ". It was also determined that there would be no survey required for historic 08/19/14 1 of architecture or landscape. If funding sources changes to federal funding or there is another federal action on the project, this will need to be reassessed. See attached "No survey required form ". A Community Impact Assessment (CIA) was completed by NCDOT Human Environment Section. An assessment of indirect and cumulative analysis was also conducted. No adverse community impacts are anticipated with the project. For more detailed information, please refer to the attached "Community Impact Assessment". ANTHONY J. TATA SECRETARY Attached is the final short form Community Impact Assessment for the proposed access road to the Gildan Yarns industrial facility in Rowan County. In general, the purpose of the CIA is to assess the potential direct impacts of the project alternative on community resources and concerns. In addition, the CIA could include recommendations to avoid, minimize or mitigate potential impacts. Note that the Direct Community Impact Area is located in an identified Ecosystem Enhancement Program (EEP) Targeted Local Watershed and contains prime farmland soils and soils of statewide importance. To comply with the Farmland Protection Policy Act, Part VI of the NRCS form CPA -106 was completed for screening purposes. This screening resulted in a point total of 22 points, which is below the 60 point threshold established by NRCS. Therefore, it is not required to be submitted to NRCS for further evaluation and will not constitute a notable impact to farmland. An Indirect and Cumulative Effects Screening Matrix was completed and is included in Appendix D of this report. Based on the information gathered from local land use and transportation plans, county and town planners, and mapping the screening tool resulted in a total score of 10 points, indicating that a Land Use Scenario Assessment is not likely. Based upon the analysis, it was determined that the proposed project will not result in any notable direct community impacts or indirect and cumulative effects. This CIA contains one recommendation that the Division 9 Environmental Officer coordinate with the NCDOT Public Involvement Group on setting up Local Official Informational Meetings to provide project information to Granite Quarry and Salisbury officials. The county produces agricultural goods and manufactured products including polyester fiber, trucks, textiles, yarn, furniture, and mobile homes. Heilig Road extends northwest from Faith Road (at the Granite Quarry town boundary) to Old Concord Road, then continues northwest as Julian Road past the 1 -85 interchange and into'Salisbury. 1 -85 connects Salisbury with Charlotte to the south and the Piedmont Triad to the north. NCDOT's functional classification for Heilig Road / Julian Road is Major Collector. The proposed access road traverses currently forested land currently owned by Rowan County. The only developed part of the Direct Community Impact Area (DCIA) is a manufacturing facility purchased by Gildan Yarns in January 2013, formerly owned by PGT Industries, which manufactured windows and doors at the plant. As viewed from Heilig Road, this industrial building is in front of (to the northeast) the proposed Gildan Yarns plant. In the vicinity of the DCIA, land uses along Heilig Road include single - family residences, an automobile repair shop, a vacant building that formerly housed MI Windows and Doors, and undeveloped forested land. The proposed site plan for the Gildan Yarns plant shows a proposed 619,273- square foot building on the west side of the access road. The project is expected to be completed by December 2015. NPDES Phase II Regulations The DCIA is within a designated Phase II Metropolitan Sphere of Influence (MSI) based upon Salisbury's Phase II community designation. In 1972, the National Pollutant Discharge Elimination System NPDES was established under the authority of the Clean Water Act. The Phase II program extends permit coverage to smaller (< 100,000) communities and public entities that own or operate a municipal separate storm sewer system (MS4) by requiring them to apply for and obtain a NPDES permit for stormwater discharge. Federal law requires communities and public entities that own or operate a MS4, and that meet either of the following two conditions, to obtain a NPDES Phase II stormwater permit: 1) The MS4 is located in an urbanized area as determined by the latest Decennial Census of the Bureau of the Census. If the MS4 is not located entirely within an urbanized area, only the portion that is within the urbanized area is regulated. 2) The community or public entity is designated by the NPDES permitting authority. In the state of North Carolina, the NPDES permitting authority is the Environmental Management Commission (EMC). Therefore development in those areas of the FLUSA is required to obtain Phase II NPDES permit coverage for their stormwater discharges. SUMMARY OF HISTORIC ARCHITECTURE AND LANDSCAPES REVIEW Description of review activities, results, and conclusions: HPOWeb reviewed on 20 March 2014 and yielded no NR, SL, LD, DE, or SS properties in the project area. Rowan County current GIs mapping, aerial photography, and tax information indicated an Area of Potential Effects (APE) of mixed residential, agricultural, and industrial use with post -1960s resources (viewed 20 March 2014). The planned new utilities west and north of the intersection of SR 1528 (Heilig Road) and SR 1006 (Faith Road) indicated in the review request abut several properties containing resources dating from circa - 1930 -1955, all of which are unexceptional and stand beyond likely project impact. Google Maps "Street View" confirmed the absence of critical historic structures and landscapes in and adjacent to the APE (viewed 20 March 2014). No architectural survey is required for the project as currently defined. Why the available information provides a reliable basis for reasonably predicting that there are no unidentified significant historic architectural or landscape resources in the proiect area: APE extends 150 feet from either end of the proposed 2900 -foot project length (NE -SW) and 150 feet to either side of the eventual centerline of the access road (SE -NW) to encompass proposed construction activities. The comprehensive county architectural survey (1977) and later investigations recorded no properties in the APE (oavyd Foard Hood, The Architecture of Rowan County (Salisbury, NC: Rowan County Historic Properties Commission, 1983)). County GIS /tax materials and other visuals clearly illustrate the absence of significant architectural resources. No National Register - listed properties are located within or adjacent to the APE. The alignment, parallel with utility easements, will require new ROW. The length of the currently proposed work is 2900 feet (about 0.55 miles). The Area of Potential Effects (APE) is the length of the project, for the width of the ROW, 100 ft. SUMMARY OF CULTURAL RESOURCES REVIEW Brief description of review activities, results of review, and conclusions: This is a state - funded project with an expected federal permit (NW14), so Section 106 of the NHPA applies regarding archaeological resources. A visit was arranged to the Office of State Archaeology in March 2014 to review archaeological site location maps and to reference site and report files. USGS maps were reviewed as well as high resolution aerial photography and property drawings. There has been an archaeological survey (ER 96 -E- 0000 -0540 Bib# 3885) that followed very closely to the APE, possibly with overlapping survey coverage, for an AT &T fiber optic cable line. That pedestrian suvey and subsurface testing by shovel test pits spaced at 30 meter intervals resulted in documentation of new sites close to the APE. Site 31Rwl49 was recorded as an isolated find, a lithic flake, near the Heilig Rd (SR 2528) intersection with the proposed new road. The low quantity and disturbed soil context suggested that the site was not eligible for the National Register of Historic Places (NRHP). Other nearby sites, for example 31Rw150 south along the same easement, contained scarce, low quantity lithic scatters and none were recommended as NRHP eligible. The coverage of a 30 meter grid is such that the survey probably included the current APE and duplication of that effort, based on APE, methodology and results, is unwarranted. Other than the single flake recovered from 31Rwl49, there are no known archaeological sites or cemeteries within or adjacent the APE. Further, in a letter dated January 16, 2014, HPO commented on an environmental review for Blue Ridge Environmental Consultants that an access road, sewer line and new building for Gildan Yarns would not affect any known historic resources and had no further comment (ER 13- 3044). Brief Explanation of why the available information provides a reliable basis for reasonably predicting that there are no unidentified historic properties in the APE: A previous archaeological review and survey for a fiber optic line was conducted in 1996 (Abbott 1996). The whole of the current paving project is immediately adjacent to that survey. As such, the current APE can be considered covered by that survey which employed a 30 meter subsurface spacing. There are no known archaeological sites or other resources identified as listed in or eligible for the National Register of Historic Places resources that would be affected by the project. As there are no known NRHP- eligible resources and the likelihood of affecting intact, significant sites is low, this project should be considered compliant with Section 106 and no further archaeological work is recommended. The proposed project is located in Rowan County, which is in attainment with the US Environmental Protection Agency's National Ambient Air Quality Standards. Rowan County is also located, within the Charlotte- Gastonia -Rock Hill nonattainment area for ozone (03) as defined by the EPA. The area was designated marginal nonattainment for 03 under the 2008 eight -hour ozone standard on July 20, 2012. Section 176(c) of the CAAA requires that transportation plans, programs, and projects conform to the intent of the state air quality implementation plan (SIP). The current SIP does not contain any transportation control measures for Rowan County. The Cabarrus Rowan Metropolitan Planning Organization 2040 Long Range Transportation Plan (LRTP) and the 2012 -2018 Transportation Improvement Program (TIP) conform to the intent of the SIP. The USDOT made a conformity determination on the LRTP on May 2, 2014 and the TIP on May 2, 2014. The current conformity determination is consistent with the final conformity rule found in 40 CFR Parts 51 and 93. There are no significant changes in the project's design concept or scope, as used in the conformity analyses. Based on the information provided, no additional work is needed to meet the requirements for transportation conformity. The project is not anticipated to create any adverse effects on the air quality of this attainment area. Therefore, no air quality studies are necessary. For highways in which more than one parallel TNM roadway element were modeled, the modeled roadway lane widths were set to ensure horizontal overlapping of adjacent modeled roadway elements. Overlapping TNM roadway elements is necessary to accurately represent the contiguous paved surface. TNM roadway elements of various widths were also modeled to represent the existing local roadways (refer to Figures 1 and 2). Terrain Lines (Elevation Contours): Elevations (vertical, "Z" coordinates) were input into TNM by hand (typing) the English coordinate values of vertices that define significant changes in grades and/or slopes throughout the study areas. Receivers (Receptors): TNM Receiver Elements were modeled by assigning a point location to the most sensitive likely `area of frequent human use' for each residence and noise - sensitive industrial land use within the Project limits. All receivers in the TNM models were assigned a height of 4.92 feet. Based on the information provided, there are 2 predicted traffic noise impacts due to this project. Consideration for noise abatement measures was given to both predicted impacted receptors. There is no control of access for roadways where impacted noise receptors are located. Sound barriers are typically not feasible along roadways with direct access for driveways because the openings render the barrier ineffective in reducing traffic noise. Consequently, no traffic noise abatement measures are recommended and no noise abatement measures are proposed for incorporation into the project plan. The commendation of this Traffic Noise Analysis is that further traffic noise analysis is not necessary unless modifications to the current design or changes to predicted traffic volumes occur. Indirect Effects Summary This project proposes to build a two -lane access road in Rowan County, within the extraterritorial jurisdiction of the Town of Granite Quarry. The project is located less than two miles northwest of Granite Quarry, two miles north - northwest of the Town of Faith, and three miles south of the City of Salisbury. The access road will connect the site of a proposed new Gildan Yarns manufacturing plant to Heilig Road, approximately 9000 feet southeast of the I- 85 /Julian Road interchange. Population in Rowan County is projected to grow by 0.16% per year between 2010 and 2030. Employment growth is anticipated to be 1.61 % per year between 2010 and 2020. The extent of undeveloped /unconstrained land is limited because of the limited size of the study area. Water and sewer from Salisbury-Rowan Utilities is either available or will be available in the FLUSA in concurrence with the completion of this project. The project area is located in an EEP Targeted Local Watershed, but otherwise does not contain any notable environmental features. While there are no current plans for additional development along the access road, the road and new water line may spur new development. The extent of development may be limited by the short length of the road and the available land. For these reasons, construction of the access road is expected to facilitate changes in land use in the project area, consistent with local desires. Phase II regulations in place will help to mitigate any potential effects to downstream water quality as a result of the construction of the access road and other private development actions. As a result of this screening, further analysis in the form of a Land Use Scenario Assessment is Not Likely. The Centralina Workforce Development Board (WDB), which includes Rowan County, projects an average growth of 1.61 % in employment per year between 2010 and 2020. This category was rated Moderate. Available Land. For the purposes of this analysis, the Future Land Use Study Area ( FLUSA) was delineated and mirrors the DCIA. The total area of the FLUSA is 203 acres, so therefore the amount of undeveloped /unconstrained land is less than 1,000 acres. This category was thus rated Low. Water /Sewer Availability. The Gildan Yarns project includes the extension of a 10 -inch water line 4,500 feet down Heilig Road from Muskedine Lane to the new road and down to the end of the new road. Sewer lines are already in place. Salisbury-Rowan Utilities provides water and sewer service for much of the county and all municipalities except the towns of Faith and Cleveland. The Salisbury-Rowan Utilities Water Plant has a total capacity of 24 million gallons per day (MGD) and treats 8.5 MGD on average, with peak usage up to 12 MGD, leaving an excess capacity between 12 and 15.5 MGD. Salisbury -Rowan Utilities has two sewage treatment plants with a total capacity of 12.5 MGD. They treat an average of 8.5 MGD, leaving an excess capacity of 3.9 MGD. Given the availability of services and the high excess capacities, this category was rated High. Market for Development. The new access road and water line increases the likelihood of development on adjacent land but, other than Gildan Yarns, there are no plans for development in the area at this time. This category was rated Moderately -Low. Public Policy. The DCIA is within the Town of Granite Quarry's extraterritorial jurisdiction (ETJ) and is therefore subject to the town's Unified Development Ordinance which stipulates general development guidelines such as: building design requirements, zoning, open space, signage, development review process guidelines and aesthetics. Granite Quarry's zoning map shows the area is zoned LI (Light Industrial), defined in the town's LIDO as: The Light Industrial District is established for certain non - offensive industrial, manufacturing, or processing plants. The type of industrial or manufacturing use would be light in nature and free from the undesirable aspects, which may be objectionable or offensive to residential areas. NPDES Phase II Regulations The DCIA is within a designated Phase II Metropolitan Sphere of Influence (MSI) based upon Salisbury's Phase II community designation. In 1972, the National Pollutant Discharge Elimination System NPDES was established under the authority of the Clean Water Act. The Phase II program extends permit coverage to smaller (< 100,000) communities and public entities that own or operate a municipal separate storm sewer system (MS4) by requiring them to apply for and obtain a NPDES permit for stormwater discharge. Federal law requires communities and public entities that own or operate a MS4, and that meet either of the following two conditions, to obtain a NPDES Phase II stormwater permit: 1) The MS4 is located in an urbanized area as determined by the latest Decennial Census of the Bureau of the Census. If the MS4 is not located entirely within an urbanized area, only the portion that is within the urbanized area is regulated. 2) The community or public entity is designated by the NPDES permitting authority. In the state of North Carolina, the NPDES permitting authority is the Environmental Management Commission (EMC). Therefore development in those areas of the FLUSA is required to obtain Phase II NPDES permit coverage for their stormwater discharges. In addition, NPDES Phase II requires the following post construction site stormwater controls: • Develop and implement strategies which include a combination of structural and /or nonstructural best management practices (BMPs) • Adopt an ordinance or other regulatory mechanism requiring the implementation of post- construction runoff controls to the extent allowable under State or local law • Ensure adequate long -term operation and maintenance of controls • Determine the appropriate BMPs and measurable goals to achieve this program control measure i.
