The project is located at the northeast quadrant of US I-440 and Six Forks Road in Raleigh, Wake County, North Carolina. The North Hills East development is a re- development project which proposes a mix of commercial buildings, parking, sidewalks, streets, utility improvements, and a greenway. The proposed activity consists of 7-foot wide asphalt pedestrian access trail with a wooden plank bridge spanning an unnamed tributary to Big Branch connecting the development to the Lakemont residential community (adjacent to the north). The purpose of the project is to reduce traffic congestion by connecting the residential community to the development. We are requesting review for our proposed impacts under the designation of "allowable" under the table of uses within the Neuse River Basin Protection and Maintenance of Existing Riparian Buffers (1 SA NCAC 02B .0233). PROJECT HISTORY: A Neuse River buffer determination was issued by Mr. Eric Kulz, Raleigh Regional Office of NCDWQ, on March 17, 2005 (DWQ # NBRRO OS-075) for the project site. A jurisdictional delineation was conducted by Soil and Environmental Consultants, PA. The jurisdictional R~Marok TrhnpN hrk, MC features have been surveyed and are depicted on the plat signed on June 12, Post orrice Box i4oo5 2006 by Mr. Monte Matthews of the USACE (Action Id. 200520695). A Research Triangle Park, Nationwide Permit (N WP) 39 (Action Id. 200520695) was issued on June 29, North CaroNna 27709 2006 by Mr. Thomas Brown of the USACE. A 401 Water Quality 2905 Meridian Parkway Certification (DWQ Permit # 06-0338• GC 3402) was issued on May 16, Durham, North Carolina 27713 ~ 800.733.5646 2006, and an approval of the storm water management plan was issued on Sts-36t-5ooo April 5, 2007 (DWQ Project # EXP 06-1707). McAdams Company conducted field investigations within the location of the proposed greenway alignment. It was determined the width of the unnamed tributary to Big Branch is incorrectly depicted on the surveyed plat signed on June 12, 2006 (USAGE Action Id. 200520695). During the on-site investigation, the stream channel width was determined to be approximately 4-feet, as shown in the attached pictures. As a result, the Neuse River Buffers were generated from the 4-foot wide top of bank (Stream Pictures, attached). PROPOSED NEUSE RIVER BUFFER IMAPCTS: The North Hills East development was designed to minimize impacts to aquatic resources by utilizing existing developments and remaining undeveloped areas outside aquatic resource boundaries. The proposed greenway crosses the Neuse River Buffer and spans the unnamed tributary to Big Branch. To minimize impacts, the pedestrian access trail has been aligned near perpendicularly as it crosses the buffer. In addition, a wooden plank bridge (comprised of pressure treated lumber) will span the unnamed tributary and not directly impact the stream. The activity does not require written 404/401 authorization since the unnamed tributary will be spanned. A 10-foot wide temporary construction corridor is required to construct the greenway (see attached "Stream Buffer Impact Map -Inset Sheet 1 "). There are a total of 1,260 square feet (0.03-acre) of stream buffer impacts associated with the proposed greenway. Permanent buffer impacts associated with the proposed greenway are S61 square feet (0.01-acre) within Zone 1 and 27S square feet (0.01-acre) within Zone 2. Temporary buffer impacts from a 10-foot construction corridor are 424 square feet (0.01-acre). The proposed pedestrian access trail is deemed allowable in the table of uses for the Neuse River Basin Protection and Maintenance of Existing Riparian Buffers. Erosion control practices will be implemented to help mitigate impacts to water quality. The North Hills East development has received storm water management plan approval from NCDWQ (Froject # EXP 46-1707; dated April S, 2007). The greenway was included within the footprint of the original impervious surface calculations for the entire North Hills East development, and represents a very small impervious portion to the overall development. ~~'_-~--= THE JOHN R.
