RK &K 1 1 I US Highway 13 Bypass Windsor, NC 27893 Subject: NOTICE OF DEFICIENCY NOD - 2014 -PC -0162 DWR Project No. 20140278 Bridge No. 12 Perquimans County Dear Sirs: On August 7, 2014, Mr. Garcy Ward with the Division of Water Resources conducted an inspection at the construction site for the replacement of Bridge No. 12 over Bethel Creek on SR 1341 (Burnt Mill Road) in Perquimans County. Also present on site were Mr. Clay Willis with NC DOT, the on -site inspector for RK &K, and the on -site supervisor for McLean Contracting. J While on site, it was observed that concrete was being poured for the cap on the interior bent. The bottom of the form for the cap was submerged several inches allowing water from the stream to come in contact with the uncured concrete. This water was being discharged back into the stream which caused elevated pH levels within the stream. Water samples were collected at several locations and tested for pH levels. The background pH level in the stream was 6.83. The pH of the water being discharged into the stream was 9.38 while the stream pH in the vicinity of the pour was 8.47. A review of the NCG 010000 inspection forms was also conducted. During the review, it was discovered that only the cover page of the form was being filled out. The subsequent pages listing the Stormwater Discharge Outfalls (SDO) and the Erosion and Sedimentation Control Devices were not present and had not been filled out. Accordingly, the following observations and violations or permit condition violations were noted during the Division of Water Resources inspection and subsequent file review: 1. The discharge of stream water that had come in contact with uncured concrete is a violation of Condition # 9 of Water Quality Certification No. 3883 that was issued to the Department of Transportation on March 21, 2014. Condition # 9 states that: "if concrete is used during the construction, then all necessary measures shall be taken to prevent direct contact between uncured or curing concrete and waters of the state. The-incomplete inspection forms do not meet the reporting requirements set forth in General Permit NCG 01000 II.B.3 (h) Thank you for your attention to this matter. This office requires that the violations as described above be properly resolved. Unresolved violations may lead to the issuance of a Notice of Violation and /or assessments of civil penalties.
