THIS DEED FOR TEMPORARY CONSTRUCTION OF ROADWAY EASEMENT
( "TCE "), made this 9th day of May 2014 by Kildaire Farms Homeowners Association II Inc.,
with a mailing address of 1900 Cameron Street, Raleigh, NC 27605 -1307, Grantors, to the
TOWN OF CARY, a municipal corporation of the State of North Carolina with a mailing
address of P.O. Box 8005, Cary NC 27512 -8005. The designation Grantors and Grantee as used
herein shall include said parties, their heirs, successors and assigns, and shall include the singular,
plural, masculine, feminine or neuter as required by context.
WITNESSETH:
WHEREAS, the Grantors are the owners of a lot or parcel of land with a street address of
1900 Cameron Street Raleigh, NC 27605 -1307 located in Wake County, North Carolina and
more particularly described in Deed Book 10494 at Page 261, Wake County Registry ( "Grantors
Property"); and
WHEREAS, Grantee is engaged in Southwest Cary Parkway (Project: ST- 1223 ),and
desires a temporary construction easement on the Grantors' Property,
NOW THEREFORE, for good and valuable consideration paid to Grantors, the receipt of which
is hereby acknowledged, Grantors do give, grant bargain, sell and convey unto the Grantee the
right, privilege and Temporary Construction Easement in, on, over, along, across, and through the
Grantors Property in the location generally shown for illustrative purposes on Exhibit A and more
particularly described as follows:

Begin at an existing iron pipe being located on the northern property line of James Marlowe et ux; said
existing iron pipe also being a southwestern property comer of the undersigned; thence N81 ° 08' 22" E
201.17ft; thence N 16° 00'47" W 80.29ft; thence S76° 43'37"W 28.06ft; thence S 76 °27 49 W 39.49ft;
thence S 77° 43'07" W 5.63ft to the POB; thence S 37"32'38" W 13.72ft; thence S 70° 25' 28 "W 6.16ft;
thence S 77° 01' 10" W 7.18ft; thence N 32° 17' 17" W 10.35ft; thence N 77° 43' 07" E 27.31ft to the
point of beginning and containing approximately 190 s.f. more or less as shown on a TCE Maps for the
Property of Kildaire Farms HOA, Kildaire Farms HOA It for the Town of Cary, Project: ST 1223, Sheet 1
of 1; dated 03/25/2014.
This TCE is a temporary construction easement for roadway and sidewalk construction purposes
including, but not being limited to, the grading, filling or cutting (removing) of soil, dirt and other
like material for purposes of providing slope and/or stable shoulders necessary for roadway
and/or sidewalk construction, the storing of materials and the movement of vehicles and
equipment, incidental to the Project.
Following construction of the Project, this TCE Area will be graded and restored, using
conventional engineering practices, and this temporary easement shall terminate.
Subject to the following exceptions. easements and rights -of -way of record.
TO HAVE AND TO HOLD the aforesaid TCE and all privileges and appurtenances
thereunto belonging to the said Grantee for the time period stated above and the same Grantors do
warrant and covenant that they are seized of said Grantors property in fee and have the right to
convey the same, that, except as set forth above, the same are free from encumbrances and that
Grantors will warrant and defend the said title to the same against claims of all persons
whosoever.
IN WITNESS WHEREOF, the Grantors have hereunto set their hand and seal, or if
corporate, have caused this instrument to be signed in its corporate name by its duly authorized
officers and its seal to be hereunto affixed by authority of the Board of Directors, the day and
