1.0 Introduction
1.1 Project Location and Description
EBX-EM, LLC (an entity of Resource Environmental Solutions, LLC) acting as the Bank Sponsor, is
pleased to provide this Monitoring Report for the Maple View Nutrient Offset Mitigation Bank ("Bank").
This Bank is designed to provide nutrient offset mitigation credits for unavoidable impacts due to
development within the Upper New Hope Arm of the B. Everett Jordan Lake watershed in the Cape Fear
River Basin. This project is in accordance with 15A NCAC 02B.0240 and the Cape Fear Riparian Buffer
& Nutrient Mitigation Banking Instrument (UMBI) made and entered into by EBX-EM, LLC acting as the
Bank Sponsor (Sponsor), and the North Carolina Department of Environmental Quality (NCDEQ) on
October 9, 2009 and modified on February 17, 2014. Supporting figures can be found in Appendix A.
The Maple View Parcel is located in Orange County in Hillsborough, NC (Figure 1). Within the Parcel, a
section of Morgan Creek and two unnamed tributaries traverse the site and exhibit diminished habitat value
as a result of past and on -going agricultural activities and impervious watershed conditions. The Parcel is
located within the Upper New Hope Arm of the B. Everett Jordan Lake watershed USGS 14-digit HUC
03030002060070 and North Carolina Division of Water Resources (NC DWR) Sub -basin Number 03-06-
06.
The site is located near the intersection of Green Rise Road and Dairyland Road (SR 1177). The site is on
the south side of Dairyland Road with the main drainage feature flowing west to east. The coordinates of
the site are 35.973056°N and-79.147778°W.
The conservation easement on the Maple View Parcel totals approximately 7.63 acres and includes two
unnamed tributaries. Stormwater runoff from adjacent land flows directly to Morgan Creek. The Parcel is
located in an area dominated by agriculture, livestock, and residential land use. There is a dairy operation
on the north side of Dairyland Road, but a majority of the Parcel is utilized for row -crop production. Land
use in the project area is hay field, row crops, and existing riparian forest. No livestock are on the Bank
Parcel, therefore livestock access is not a concern.
The Maple View Nutrient Offset Mitigation Bank provides water quality benefits through elimination of
nutrient intensive agricultural practices and re -forestation of riparian areas that extend out to 200 feet from
the stream channels. The riparian restoration activities within the Parcel results in improved water quality
within the downstream watershed. Unnamed Tributary "A" is a perennial channel which flows in an easterly
direction along the southern project boundary. Unnamed Tributary `B" is a perennial channel which flows
in a southerly direction to its confluence with unnamed tributary "A". Unnamed Tributary "C" is a
perennial channel flowing in a southerly direction to its confluence with UT -A. Stream Determinations
were verified by DWR staff onsite on July 7, 2015 and in correspondence dated July 16, 2015. Site
viability for buffer mitigation and nutrient offset was determined onsite on July 7, 2015 and in
correspondence dated August 5, 2015.
The Maple View Parcel provides off -site mitigation for development (both existing and proposed)
requiring nutrient offset credits. The nutrient offset credits generated on this Bank are being
submitted under the terms and conditions of the Cape Fear UMBI modified and signed on February
2, 2014 between EBX-EM, LLC and the Department of Environmental Quality.

1.2 Project Goals and Objectives
The primary goals associated with the nutrient offset restoration plan include improving water quality,
enhancing flood attenuation, and restoring wildlife habitat through the creation/restoration of forested
riparian areas adjacent to stream channels within the Parcel. The restoration of natural plant communities
within the Parcel will not only provide stabilization and improve water quality within the easement limits,
but also provide ecological benefits to the entire watershed.

2.0 Project Area — Pre -Construction Condition Summary
The Final BPDP (November 2016) describes the pre -construction conditions on the Maple View site. The
site was planted in April 2016 and post -construction conditions are also described in the Final BPDP.
Additional construction activities since the BPDP approval include supplemental re -planting of 0.23 acres
along the easement boundary, installation of easement signage, and amending the conservation easement
to address DWR comments. The easement edge portion of Maple View that was lacking planted stems was
planted with 150 one -gallon trees. This is an approximate density of 650 trees per acre over the 0.23 acre
area. Additionally, a 0.10-acre area on the eastern portion of the site was replanted with 50 one -gallon trees
and the 0.23-acre replant area was also remarked. Information regarding this can be found in the MY1
Remedial Action Memo in Appendix E.
3.0 Bank Site Conditions
3.1 Restoration Plan
The majority of the site was maintained as a cleared agricultural field for hay and corn production. As such,
these areas required little site preparation other than select herbicide treatment and soil preparation (i.e.
ripped and scarified). The riparian areas were planted with native bare root tree seedlings at a minimum of
8 by 8 foot spacing to achieve an initial density of 680 trees per acre. The buffered channels will provide
water quality and habitat functions within the sensitive Jordan Lake watershed. Some areas adjacent to the
forested areas may require maintenance due to the rapid regeneration of some species.
Riparian restoration began at the outer limits of the existing tree lines and extend out to 200 feet from the
top of bank from reaches A, B and C (Figure 2.3). Approximately 3 acres of mature forest will be protected
within the conservation easement, but no buffer or nutrient offset credits will be generated.
DWR staff (Katie Merritt) performed a site inspection on April 10, 2017. At that site visit an area
approximately 0.23 acres along the easement boundary was found to be lacking planted stems and
additional easement marking, and signage was requested. RES performed these remedial actions in May
2017. At the end of 2017, RES performed more remedial actions by remarking this area and replanting 50
one -gallon trees in a 0.10-acre encroachment area on the eastern portion of the site. The MY1 Remedial
Action Memo is in Appendix E.

3.2 Vegetation Monitoring Plots
Revegetation of the site includes planting bare root trees and controlling invasive species growth. Piedmont
Alluvial Forest is the target community type for all areas within the project. The community is defined by
Schafale and Weakely (1990). The initial planting of bare root trees occurred during mid -April 2016 and is
described in the BPDP. Initial Plot data is provided in Appendix B. Vegetation plots were installed in
November 2016.
3.3 Photo Documentation
Photo documentation is a key essential to monitoring the success criteria of the Bank Site. Photographs
provide a visual representation of the onsite vegetation conditions. Resource Environmental Solutions, LLC
will provide a photograph of each vegetation plot every monitoring year. Photographs are located in
Appendix B.
4.0 Monitoring Conditions
Site annual monitoring has been completed and the Site is being recommended for closeout. The Site is
performing as planned and has met its success criteria. Overall, the site's vegetation has established well
in Year 5. An abundant amount of herbaceous ground cover as well as volunteer tree species were present
during Year 5 monitoring activities. The narrow strip of encroachment along the edge of the easement was
replanted in 2017 and monitored through 2018. The gallon trees that were planted have established a well-
defined physical boundary to the easement. The second problem area was another encroachment area near
VP7 where the farmer mowed through the easement along the cornfield about 0.10 acres in size. Additional
information on the remedial action and correspondence regarding these areas is in Appendix E.
In 2020, a new area of encroachment was discovered. A path about 15 feet wide was mowed from the farm
field through the easement to a ford crossing in the preservation area. The encroached area totaled about
0.08 acres. The path was mowed so the landowner could access timber on the other side of the easement.
The landowner believed there was an access right of way on that part of the easement, however, this right
of way failed to make it into the final recorded easement. In 2021 and early 2022, RES had the conservation
easement amended to include a 25-foot break near where this encroachment took place. Updated credit
totals are in Section 5.0. RES has cleared the break and marked the easement along it as well as
supplemental planted container trees in the mowed area adjacent to the new break. During Year 5
monitoring, RES observed encroachment again near VP7. The farmer had mowed through the corner of the
easement, however, this time the area was much smaller only 0.04 acres. Additionally, another small area
(0.02 acres) of encroachment was observed east of VP4. RES has remarked and horse taped the whole
easement boundary along the agricultural field as well as replanted with container trees in the encroachment
areas. RES also met with the landowner and explained the issue. Additional information regarding the
encroachment repairs is located in Appendix E.
The Maple View Bank Site contains seven vegetative monitoring plots, all of which are monitored and
reported in general accordance with the CVS-EEP Protocol for Recording Vegetation (CVS-EEP, v4.2).
Seven ten (10) by ten (10) meter square plots have been permanently established following completion of
the planting phase and at least two opposing corners have been permanently installed and surveyed for
future use. The plant species, density, survival rates, and the cause of mortality, if identifiable, have been
recorded within each plot. All vegetation plots are sampled and reported annually. The primary focus of the
vegetative monitoring will be solely on the tree stratum, although shrub and herbaceous species encountered
may also be recorded but will not be counted towards the success criteria.

Success criteria is based on the survival of a minimum density of 320 trees per acre after five years of
monitoring. Year 5 vegetation monitoring activities occurred on November 15t'`. As of Monitoring Year 5,
the Maple View Bank Site yields 711 planted stems per acre and 1,416 total stems per acre counting
volunteer species. The average stem height was 20 feet. Vegetation monitoring data is in Appendix B.
5.0 Jordan Lake Nutrient Offset Mitigation
The Maple View Bank generates 4.44 acres of nutrient offset credits and preserves 3.08 acres of riparian
buffer for a contiguous conservation easement. The total nutrient offset credits that the Maple View Bank
generates are summarized in Table 1 and Figure 2.3. Credit totals were updated in 2022 to account for an
easement break that was added in the western portion of the project.

Per the September 29, 2017 email response from Katie Merritt (DWR) referencing the Year 1 Monitoring
Report for the Maple View Bank Parcel, RES is providing a summary for remediation as requested.
1. In the 0.23 acre encroachment area along the easement boundary RES shall conduct a
transect survey documenting height and species type of the trees within the "Replant Area".
Also RES is to install poles or wire fencing/T-posts as a means of more permanent marking.
On October 12, 2017, RES surveyed a 990 foot transect along the edge of the "Replant Area"
closest to the farm field. RES identified and measured 82 trees. The same trees will be identified
and measured in MY2. Transect data is attached along with a map and photos showing the
transect line. Please note, temporary easement markers (wooden stakes with pink flagging) were
installed for photographic purposes only. Permanent easement markers (T-posts with
conservation easement signs) were later installed on December 7, 2017.
2. In the 0.10 acre encroachment area near Plot 7, RES is to install poles or wire fencing/T-
posts as a means of more permanent marking.
On December 7, 2017, RES installed permanent easement markers around the encroachment area.
The easement markers are T-posts with conservation easement signs attached to them.
RES has performed all requested remedial action items and is requesting the remaining 5% credit release
for MY1 from the Maple View site. Please let me know if you have additional concerns or questions.

Regarding Ongoing Easement Encroachment
On August 13, 2018 RES (Brian Hockett) contacted Bob Nutter (Land Owner) of Maple View
Farms to discuss the ongoing encroachment issues with the conservation easement. Mr. Nutter
and RES discussed both occurrences (2017 and 2018) that had taken place and how to resolve
the encroachment. Mr. Nutter stated that the reason for removing the posts was primarily to
harvest the crops against the edge of the easement. Mr. Nutter offered to re -install the easement
posts; however, RES declined and re -installed the posts ourselves. Mr. Nutter was also informed
the mowing and driving within the easement was a violation of the easement terms. Mr. Nutter
agreed this problem would be resolved and would not continue.

Dear Katie Merritt,
Per the February 2022 phone conversation with Katie Merritt (DWR) referencing the Year 5 Monitoring
encroachment at the Maple View Bank Parcel, RES is providing a summary for remedial action as requested.
1. 0.03-acre encroachment on the west side of the easement that the landowner mowed to
access the ford crossing.
RES has amended the easement to include a break near this area. The new break (and entire
easement boundary along the agricultural field) has been marked with t-posts, signs, and horse
tape. Additionally, 10 three -gallon container trees were planted in the mowed area within the
easement.
2. 0.02-acre encroachment in the central portion of the easement where the landowner
scalloped into the easement while harvesting crops.
The entire easement boundary along the agricultural field has been marked with t-posts, signs, and
horse tape. Additionally, 10 three -gallon container trees were planted in the mowed area within the
easement.
3. 0.06-acre encroachment on the east side of the easement where the landowner scalloped into
the easement while harvesting crops.
The entire easement boundary along the agricultural field has been marked with t-posts, signs, and
horse tape. Additionally, 20 three -gallon container trees were planted in the mowed area within the
easement.
RES has performed all requested remedial action items as well as met with the landowner onsite and is
requesting a closeout site visit for the Maple View site. The amended conservation easement has been
recorded and the plat is attached. Please let me know if you have additional concerns or questions.
