My deepest apologies for moving forward on the property listed on the NOV number listed above. As we
discuss on May 16th. I've hired LL&J to fill out the application and designing the Sewer Extension. From my
understanding the paperwork has been sent into the State office.
Again, please forgive me for my lack of knowledge and for not following the correct procedure that should
have been followed. I know 1 was wrong but if there is any way you can waive and or reduce the penalty, it
would be greatly appreciated. Thank you in advance for helping.

Subject: NOTICE OF VIOLATION & INTENT TO ASSESS CIVIL PENALTY

Wastewater Collection System Extension
Project: David Parnell Street and Magnolia Street Unpermitted Sewer
Robeson County
Dear Mr. Mabe:
On a site visit on May 16, 2022, DWR staff observed a collection system installed without a permit
along David Parnell Street in Parkton, North Carolina. Construction was initiated prior to permit
issuance or application submittal. Therefore, Squire Properties LLC is in violation of NC General Statute
143-215.1(a)(2) for construction of a sewer system without a permit.
A Notice of Violation/Intent to Issue Civil Penalty is being issued for the noted violation of North
Carolina General Statute (G.S.) 143-215.1 and the facility's Collection System Permit. Pursuant to G.S.
143-215.6A, a civil penalty of not more than twenty-five thousand dollars ($25,000.00) per day may
be assessed against any person who violates or fails to act in accordance with the terms, conditions,
or requirements of any permit issued pursuant to G.S. 143-215.1.
If you wish to provide additional information regarding the noted violation and explain why the
Division though this office should not assess a civil penalty in this matter, please respond in writing
within ten 110) business days after receipt of this Notice. A review of your response will be
considered and you will then be notified of any civil penalties that may be assessed regarding the
violation. If no response is received in this Office within the 10-day period, a civil penalty
assessment may be prepared.
