Division of Water Resources' Central and Regional staff has reviewed the application package
received on April 18, 2022. However, additional information is required before the review may be
completed. Please address the items on the attached pages no later than the close of business on July 28,
2022.
Please be aware that you are responsible for meeting all requirements set forth in North Carolina
rules and regulations. Any oversights that occurred in the review of the subject application package are
still the Applicant's responsibility. In addition, any omissions made in responding to the outstanding items
in Sections A through N, or failure to provide the additional information on or before the above requested
date may result in your application being returned as incomplete pursuant to 15A NCAC 02T .0107(e)(2).

H. Attachment G — Easement, Encroachment, and Lease Agreements:
1. Pursuant to 15A NCAC 02T .0504(f), the Permittee has a lease agreement with Ammons Farmland,
LLC for wastewater treatment and irrigation on Parcel No. 9666-31-7056-00. The current
agreement will expire May 31, 2025, which will be within the next permitted renewal cycle.
Accordingly, please provide the following information:
a. Pursuant to 15A NCAC 02T .0504(0(3), an agreement to lease the property that is written,
notarized, and signed by both parties, indicating the intended use of the property, accompanied
by a plat or survey map. Lease agreements shall adhere to the requirements of 15A NCAC 02L
.0107.
b. Pursuant to 15A NCAC 02L .0107(k), if at the time a permit is issued after January 1, 1993,
the permittee is not the owner of the land within the compliance zone, it shall be a condition of
the permit issued or renewed that the landowner of the land within the compliance zone, if
other than the permittee, execute and file in the Register of Deeds in the county in which the
land is located, an easement running with the land that contains either a notice of the permit,
including the permit number, a description of the type of permit, and the name, address and
telephone number of the permitting agency; or a reference to a notice of the permit with book
and page number of its recordation if such notice is required to be filed by statute. The Director
shall, upon request by the landowner, file a document terminating the easement with the
appropriate Register of Deeds once the following conditions have been met:
(1) all required groundwater remediation has been completed;
(2) groundwater monitoring is no longer required pursuant to 15A NCAC 02L .0110(f); and
(3) monitoring wells have been abandoned pursuant to 15A NCAC 02C .0113.
